ORDINANCE NO. 11271
AN EMERGENCY ORDINANCE AMENDING ORDINANCE
NO. 11205, ADOPTED NOVEMBER 17, 1994, THE
CAPITAL IMPROVEMENTS APPROPRIATIONS
ORDINANCE, AS IT PERTAINS TO SPECIFIED PUBLIC
SAFETY AND PARKS AND RECREATION PROJECTS, BY
REVISING PREVIOUSLY APPROVED APPROPRIATIONS
TO SCHEDULED CAPITAL IMPROVEMENTS PROJECTS;
BY ESTABLISHING NEW CAPITAL IMPROVEMENT
PROJECTS IN THE SUMS AND FUNDED FROM THE
SOURCES SPECIFIED HEREIN; AND CLARIFYING
NUMBERING; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11205 on
November 17, 1994 to establish appropriations for capital
improvements, continue previously approved capital improvement
projects and establish new capital improvement projects to begin
during fiscal year 1994-95; and
WHEREAS, subsequent to the adoption of said Ordinance, the
City of Miami was advised by the Florida Department of
Environmental Protection ("FEPA") that two (2) grant applications

to FEPA's Special Waterway Projects Program for the amount of
$5,000 each had been approved for dock renovations at Legion Park
and the construction of a dock facility at Morningside Park,
respectively; and
WHEREAS, the City Commission, on February 23, 1995, adopted
Resolution No. 95-151, ratifying, approving and confirming the

City Manager's finding that a valid public emergency existed,
thereby waiving formal competitive sealed bidding procedures for

the procurement of roof repair services for the Virrick Park Pool
Building at a total cost not to exceed Thirty Eight Thousand One
Hundred and Forty -One Dollars ($38,141.00); and
WHEREAS, said Resolution authorized the reallocation of
Thirty Eight Thousand One Hundred and Forty -One Dollars ($38,141)
in Community Development Block Grant ("CDBG") funds from the
Eighteenth (18th) year CDBG project entitled "Grand Avenue Park
Renovations" to Capital Improvement Project No. 331316, entitled
"Virrick Park Renovations", to fund said roof repairs; and
WHEREAS, on May 11, 1995 the City Commission accepted a
grant in the amount of Seventy Nine Thousand Dollars ($79,000)
from the Mildred and Claude Pepper Foundation for repairs and
renovations to the Mildred and Claude Pepper Fountain in Bayfront
Park; and
WHEREAS, the Administration has prepared this appropriations

Ordinance to reflect these project funding modifications and to
make said funds immediately available for the continuation of the
specified projects;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
preamble to this Ordinance are hereby incorporated by reference

thereto and adopted herein as if fully set forth in this
Section.
Section 2. Section 1 of Ordinance No. 11205, the Capital
Improvements Appropriations Ordinance adopted November 17, 1994,
is hereby amended as followsl/:
"Section 1. The herein appropriations are
hereby made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin during
fiscal year 1994-95. The herein appropriations which
are hereby designated by reference to descriptive
project title and number also include appropriations
for previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations with revenues therefor being set
forth for seven program (I-VII) areas based upon use or
functional category within said areas, as follows:

Section 2. All ordinances, Code sections, or parts of
ordinances thereof in conflict herewith, insofar as they are in
conflict with the provisions of this Ordinance are hereby
repealed.
Section 3. If any section, part of this section,
paragraph, sentence, clause, phrase, or word of this Ordinance is

for any reason declared invalid, the remaining provisions of this
Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and welfare of the City of
Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the commission.
Section 6. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached ordinance to amend Ordinance No. 11205, the Capital
Improvements Appropriations Ordinance, by revising previously
approved appropriations to scheduled capital projects and by
establishing a new project in the Parks and Recreation program
area.
BACKGROUND
Subsequent to the adoption of the Capital Improvement
Appropriations Ordinance for fiscal year 1994-95, the City has
received additional monies from various sources and has needed to
reallocate funds for new and continued capital improvements in
the Parks and Recreation program area.
The Administration has prepared this appropriations Ordinance to
reflect these project funding modifications and to make said
funds immediately available for the continuation of the specified
projects.
This ordinance is being presented as an emergency measure so that
funds are immediately in place for the continuation of
improvement projects and the award of bids and contracts.
