AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 608, "SD-8 DESIGN PLAZA COMMERCIAL RESIDENTIAL DISTRICT," TO ALLOW "OUTDOOR PHOTOGRAPHIC STAGE SETS" AS A CONDITIONAL PRINCIPAL USE BY CLASS II SPECIAL PERMIT; BY AMENDING SECTION 2502 TO DEFINE OUTDOOR PHOTOGRAPHIC STAGE SETS"; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 15, 1995, Item No. 4, following an advertised hearing, adopted Resolution No. PAB 14-95 by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set i forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, I FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Ellipsis and asterisks indicate omitted and unchanged material. I.IZ70 W "ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS * * Sec. 608. SD-8 Design Plaza Commercial -Residential District. * * Sec. 608.4. Permitted principal uses and structures. 608.4.1. Permitted generally. As for C-1 except that: * M 2. Cutting, polishing and finishing of marble, granite and other natural stones for counter and table tops, subject to a Class I Special Permit to restrict storage materials to the marble, granite or stone actually used in the manufacture of the counter or table tops and subject to the complete enclosure of storage visible from a public street or adjacent to a residentially used lot by a solid textured wall (a maximum of eight (8) feet in height); all work shall be conducted within an entirely enclosed building, shall be subject to compliance with all City noise ordinances, and shall be subject to the installation of filters to eliminate air pollution. 3 Outdoor photographic stage sets, as defined in Sec. 2502, shall be permitted by Class II Special Permit only. 608.4.2. Limitations on outdoor uses. All sales, display, and service activities of permitted or conditional uses shall be conducted within completely enclosed buildings except for parking lots; outdoor photographic stage sets; plant nurseries; outdoor dining areas; arts and crafts exhibits, including demonstrations and performances; flowers, plants, and shrubs; objects of art; and handicrafts, but not mass-produced items. Specific definitions. * -2- * * * * 112'70 Outdoor Photo ra hic Stage Sets: An Outdoor Photographic Stage Set is a physical reproduction of a buildingfacade of an architectural or historicalperiodwhich prove es the photographer with a controlled setting exposed to natural lighting and the elements; where certain effects can be obtained that would otherwise not be feasible given the constraints of an indoor studio. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. PLANNING Approval. RECOMMENDATION BACKGROUND AND On September 16, 1994, the Zoning Administrator received a letter from Centerstage ANALYSIS Inc. (see attached), requesting permission to utilize a specific piece of property within the SD-8 Design Plaza Commercial Residential District, which goes back to the C-1 Restricted Commercial Zoning District for permitted uses, for Outdoor Photographic Stage Sets; pursuant to Section 904 of Zoning Ordinance 11000, the Zoning Administrator then requested a Determination of Use not Specified from the Director of the Planning, Building and Zoning Department on December 21, 1994. After conducting an analysis of the proposed use, the Director issued the attached Determination of Use #95-003, on February 27, 1995, in which it was determined that the use, as defined in the attached legislation, would be appropriate as a conditional principal use within the SD-8 Design Plaza Commercial Residential District by Class II Special Permit; the purpose of the special permit is in order to ensure compliance with the intent of the district and compatibility of each proposal with existing Conditions. . An Outdoor Photographic Stage Set is a physical reproduction of a building facade of an architectural or historical period which provides the photographer with a controlled setting exposed to natural lighting and the elements; where certain effects can be obtained that would not be feasible given the constraints of an indoor studio. The fashion and commercial photo industry are thriving activities in the City of Miami; for this reason it is in the best public interest to facilitate their success, by providing accommodations which suit their needs well. As SO-8 is a primarily commercial district created with the intent of serving the design and arts community, there is little doubt that the use described above will be an appropriate one for the district, however, by requiring a• Class 11 Permit compliance with the intent of the district and compatibility of each proposal could be ensured with existing conditions. At the next opportunity, this department will amend the Zoning Ordinance to appropriately reflect this determination. Lopez, Managing Partner of Centerstage Productions, concerning a use not specified, please be advised of the following. The property in question is located on the North side of NE 36 Street, East of North. Miami Avenue. The site is currently Zoned SD-8 (Design Plaza Commercial Residential -District), they will be using the building located: at. this address for offices and indoor studio, and the empty. lot surrounding the building for the outdoor shooting area and backlot. The indoor studio has .been set up as a general rental' studio that will be marketed to the fashion and commercial photo industry. However, these uses are meant to be located within a completely enclosed building and not open area -as being proposed. Under Section 904., of Zoning Ordinance 11000, "Determinations of uses or characteristics of uses not specified", the following is stated. "Where there is substantial doubt as to whether a particular use or uses, or classes of use, or characteristics of use not specifically identified in this zoning ordinance are of the same general character as those listed as permitted or conditional -uses, the director of. the department of planning, building and zoning, upon request from any administrative agency or officer of the city or on his, own initiative, shall make' a determination in the matter". Bayshore Dr. that extends south from N.E. 20th terrace to where it dead ends into the N.E. 20th St. alley. None of these roads are currently servicing zany homes or, businesses, and would not cause any inconvenience to anyone in the surrounding neighborhood. By enclosing the property, we will not only stop the illegal garbage dumping; that: is now happening daily, but we can also help to eliminate some of the many problems that come from having vagrantsand homeless peop l E'. living and sleeping on this property. Second, we would request your help on getting an overlay and eventual replatting of the property so that the zoning becomes uniform and consistent for the entire property. Currently, somewhat less than half the property is correctly zoned for what we need. We call easily begin our project on the section available but we would like to be fairly secure with the idea that after the first year of our three year lease we would be Able to use the entire site. Third, any help that your office could give us so that we can acquire permits for office trailers would be greatly appreciated. As we discussed at our meeting, we would need to put two to three trailers on the site to use as production and administrative offices, hair and make-up areas, and wardrobe storage facilities. I would like to stress that at no time will there be anyone living in these trailers. They will strictly be used for production by our clients during normal business hours. We feel that if these three points can be resolved, the CENTRE STAGE project can become a successful new business in the Edgewater neighborhood. Even though we have a relatively short lease period( 3 years ), We're confident that our presence in the area will greatly help the ongoing effort to revitalize the Edgewater community. Not only will we be bringing in a business that will benefit the surrounding hotels, restaurants, etc., we will also be adding another service to the Miami area that r_an be used to attract more of the Photo and Film industry. Installing gates at each road entry to permit easy access so the city may meet its needs. To do this we would like the city to allow us to barricade on a temporary basis, the entrance to 20th terrace from Biscayne Blvd., the entrance to 20th street alley from both side and the short dead end section of North Bays Shore Drive. • Securing a zoning overlay for the entire property as to permit the use for the still picture and or the movie industry. We would also appreciate any help your office can give us to place two or three temporary trailers. These trailers will not house anyone but will be used for production and administrative offices plus other facilities like make-up areas wardrobe storage facilities, etc. I am sure that a business of this type would bring a positive contribution to Miami, revitalize the area and would help other interests in the.Edgewater community.
