Approved on 3/20/95 by Res. ZB 028-95 with a vote of 7-0. ANALYSIS The petition is to change the zoning designation from C-1 Restricted Commercial to C-2 Liberal Commercial in order to extend the existing grandfathered hardware store use into the eastern part of the block. The Planning, Building and Zoning Department contends that the increased densities created by this amendment will not have additional impact on the existing conditions in the area and is recommending approval of the application with the condition that a one foot (1'-0") strip around the portions of the property which abut a less intense district remain C-1; this is in order to prevent this change from beginning a domino effect of changes within the area. ZONING BOARD APPELLANT CITY COMMISSION APPLICATION NUMBER Recommended to CC for approval. (Res. No. 028-95) Passed First Reading on CC 5/1/95. 94- 308 Page 1 March 20, 1995 11267 AN ANALYSIS OF PROPOSED ZONING CHANGE APPLICATION NUMBER 94- 308 Yes No N/A X The proposed change is in harmony with the adopted Miami Compre- hensive Neighborhood Plan, 1989-2000, and does not require a plan amendment. X The proposed change is in harmony with the established land use pattern. X The proposed change is related to adjacent and nearby districts. X The change suggested is within scale with the needs of the neigh- borhood or the City. X The proposed change maintains the same or similar population density pattern and thereby the load on public facilities such as schools, utilities, streets, etc. is the same. X Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. X There are changes or changing conditions that make the passage of the proposed change necessary. X The proposed change positively influences living conditions in the neighborhood. X The proposed change has the same or similar impact on traffic and does not affect public safety as the existing classification. X The proposed change has the same or similar impact on drainage as the existing classification. X The proposed change has the same or similar impact on light and air to adjacent areas as the existing classification. X The proposed change has the same or similar impact on property values in the adjacent areas as the existing classification. X The proposed change will contribute to the improvement or deve- lopment of adjacent property in accord with existing regulations. X The proposed change conveys the same treatment to the individual owner as to the owner within the same classification and the immediate area; and furthers the protection of the public welfare. X There are substantial reasons why the use of the property is unfairly limited under existing zoning. X It is difficult to find other adequate sites in the surrounding area for the proposed use in districts already permitting such use. 11267 March 20, 1995 Item# 5 0 Mr. Gary M. LONGACRE 00 COUN$6L Re: Lawrence Application for Amendment to Zoning Atlas and Application to Amend the Miami Comprehensive Neighborhood Plan Our File No. 1638.0001 Dear Ms. Fernandez: In accordance with your request, the following is a brief statement as to why the current zoning for the above -referenced property is inappropriate and why the proposed zoning is appropriate. Considering the business surrounding the subject property, a change from C-1 to C-2 is entirely compatible with the area and shall not adversely affect the neighborhood. The subject site is in an existing commercial area and is not a further intrusion into a residential neighborhood. The current zoning is too restrictive because the subject property is fronting on a highly commercialized roadway and C-2 will be more compatible with the land uses in the vicinity of such property. A majority of the businesses surrounding the subject property are business that can only operate in a C-2 zoning district or with special exceptions or special permits (i.e. used auto sales, wholesaling, repair shops, service stations, bars, etc.) [a 00 2 WED 11: 48 FAX 305 379 '8 KLUGER PERETZ ET AL Teresita Fernandez, R.A., A.I,C,P.
