REQUEST Change of Zoning as listed in the Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, Schedule of District Regulations, from R-2 Two -Family Residential to 0 Office. Case No: N/A Last Hearing Date: N/A Found: N/A Violation(s) Cited: N/A Ticketing Action: N/A Affidavit of Non -Compliance issued on: N/A Daily Fine: $0.00 Lien Recorded On: N/A Total Fines To Date: N/A CEB Action: N/A HISTORY The Zoning Board recommended approval on 3/20/95 by a vote of 6-0. ANALYSIS The subject property is an empty lot designated R-2 Two -Family Residential. The adjacent empty property is also under the same ownership and designated (0) Office. The Miami Comprehensive Neighborhood Plan (MCNP) has the same designation of (0) Office for both properties. In this case, the subject application do s not need a companion land use change petition (see attached memo). This petition proposes to[extend the boundary line west and include the subject property into the (0) Office designation in order to be consistent with the zoning and the MCNP designation for the entire property. The change to (0) Office will allow the development of the subject and adjacent property as one site with the same zoning designation and with no additional impact on the adjacent residential area. Based on these findings, the Planning, Building and Zoning Department is recommending approval of the application as presented. ZONING BOARD Recommended to CC for approval. (Res. No. 029-95) APPELLANT N/A. CITY COMMISSION Passed First Reading on CC 5/1/95. Block 2 McAllister Terrace Ewxosum : Amended (PB 41-24) The subject property currently has a land use designation of 0 (Office) and a zoning designation of R-2 (Two-family residential). Therefore, while a change of zoning from R-2 to 0 is required, there is no need for an accompanying land use amendment since the comprehensive plan already designates the area as 0 (Office). SR/sa 11265 r ANALYSIS OF PROPOSED ZONING CHANGE APPLICATION NUMBER 94- 366 Yes No N/A X The proposed change is in harmony with the adopted Miami Compre- hensive Neighborhood Plan, 1989-2000, and does not require a plan amendment. X The proposed change is in harmony with the established land use pattern. X The proposed change is related to adjacent and nearby districts. X The change suggested is within scale with the needs of the neigh- borhood or the City. X The proposed change maintains the same or similar population density pattern and thereby the load on public facilities such as schools, utilities, streets, etc. is the same. X Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. X There are changes or changing conditions that make the passage of the proposed change necessary. X The proposed change positively influences living conditions in the neighborhood. X The proposed change has the same or similar impact on traffic and does not affect public safety as the existing classification. X The proposed change has the same or similar impact on drainage as the existing classification. X X X X X The proposed change has the same or similar impact on light and air to adjacent areas as the existing classification. The proposed change has the same or similar impact on property values in the adjacent areas as the existing classification. The proposed change will contribute to the improvement or deve- lopment of adjacent property in accord with existing regulations. The proposed change conveys the same treatment to the individual owner as to the owner within the same classification and the immediate area; and furthers the protection of the public welfare. There are substantial reasons why the use of the property is unfairly limited under existing zoning. X It is difficult to find other adequate sites in the surrounding area for the proposed use in districts already permitting such use. i12s5 March 20, 1995 ''5 Mr. Gary M.
