AN EMERGENCY ORDINANCE, WITH ATTACHMENTS, ESTABLISHING
INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A
SPECIAL REVENUE FUND ENTITLED "VIOLENT CRIME/SEXUAL
BATTERY"; AND AUTHORIZING THE CITY MANAGER TO ACCEPT
THE GRANT OF $20,268 FROM THE FLORIDA DEPARTMENT OF
LAW ENFORCEMENT AND TO EXECUTE ANY NECESSARY DOCUMENTS
TO ACCEPT SAID GRANT; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Police Department's Sexual Battery/Child
Abuse Unit has been conducting a complex and lengthy investigation into the
brutal sexual battery of an elderly woman; and
WHEREAS, there is funding available through the Florida Department of
Law Enforcement to assist in this type of investigation; and
WHEREAS, the Florida Department of Law Enforcement, has awarded the City
of Miami Police Department $20,268 to be used for the payment of overtime,
contractual services and miscellaneous expenses, with no matching funds from
the City of Miami, for use in this investigation; and
WHEREAS, any purchases would have to comply with applicable city code
purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.

Section 2. The following Special Revenue Fund is hereby established and
resources are hereby appropriated as described herein:
FUND TITLE: VIOLENT CRIME/SEXUAL BATTERY
RESOURCES: Florida Department of $20,268
Law Enforcement
APPROPRIATIONS: Personnel Overtime $16,068
Contractual Services $ 2,000
Miscellaneous $ 2,200
Section 3. The City Manager is hereby authorized to accept the grant as
set forth in the Preamble to this Ordinance and to enter into the necessary
contract(s) and/or agreement(s), in a form acceptable to the City Attorney, 1/
for the acceptance of the aforesaid monies for the compensation of personnel,
and other related costs.
Section 4. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 5. If any section, part of section, paragraph, clause, phrase,
or word of this Ordinance is declared invalid, the remaining provisions of
this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami, and upon the further grounds of the
necessity of the City of Miami to make the required and necessary payments to
its employees and officers, payment of its debts, necessary and required

purchases of goods and supplies, and to generally carry on the functions and
duties of municipal affairs.
Section 7. The requirement of reading this ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -
fifths of the members of the Commission.
Section S. This Ordinance shall become effective immediately upon its
adoption.

Additional Requirements
1) Any agency which receives funds from the Violent Crime Emergency Account must
make quarterly reports of expenditures to the Chairman of the Florida Violent
Crime Council.
21 All agencies which receive funds must retain documentation supporting
expenditures from the Account and make them available during the annual evaluation
and audit of the trust fund.
3) Within 60 days of the conclusion of the investigation or trial, the agency
shall return any unexpended funds to the Chairman of the Florida Violent Crime
Council for re -deposit into the Account.

It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "violent Crime/Sexual Battery,"
accepting a grant from the Florida Department of Law Enforcement,
in the amount of $20,268 and appropriating funds for the
operation of same, be adopted.
BACKGROUND:
The Miami Police Department's Sexual Battery/Child Abuse Unit has
been conducting a complex and lengthy investigation into ths--,
sexual battery of an elderly woman. The grant will pay fc••.,
overtime so that detectives may dedicate time solely to thin•
case. By doing so, additional investigative avenues will be
explored. Detectives, additionally, will use funds, set aside in
the grant, to seek the assistance of medical professionals with
the hope that treatment may assist the victim in recalling
information. This specific grant will be administered by the
Miami Police Department's Sexual Battery/Child Abuse Unit. No
matching funds are required by the City.
This Ordinance is being requested on an emergency basis on the
grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, by curtailing
narcotics trafficking.
