ORDINANCE NO. 112 6 3
AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11127,
ADOPTED MARCH 24, 1994, WHICH ESTABLISHED INITIAL
RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL
REVENUE FUND ENTITLED "HAITIAN NARCOTICS ENFORCEMENT";
AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT IN THE
AMOUNT OF $75,000 FROM THE U.S. DEPARTMENT OF JUSTICE,
OFFICE OF JUSTICE PROGRAMS, AND TO EXECUTE ANY
NECESSARY DOCUMENTS TO ACCEPT SAID GRANT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Police Department continues to investigate
narcotics trafficking; and
WHEREAS, there is a need to target specific geographical areas; and
WHEREAS, the Department of Justice, Office of Justice Programs, has
approved an additional award of $75,000 toward the payment of overtime, and
travel, with no matching funds from the City of Miami to accomplish these
investigations; and

WHEREAS, any purchases would have to comply with applicable city code
purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adapted by reference thereto and incorporated herein as
if fully set forth in this Section.

Section 2. Section 2 of Ordinance No. 11127, adopted March 24, 1994, is
hereby amended in the following particulars:1
"Section 2. The following Special Revenue Fund is hereby established
and resources are hereby appropriated as described herein:

Section 3. The City Manager is hereby authorized to accept the grant as

set forth in the Preamble to this Ordinance and to enter into the necessary

contract(s) and/or agreement(s), in a form acceptable to the City Attorney,
for the acceptance of the aforesaid monies for the compensation of personnel.
` Section 4. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 5. If any section, part of section, paragraph, clause, phrase,
or word of this Ordinance is declared invalid, the remaining provisions of
this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami, and upon the further grounds of the
necessity of the City of Miami to make the required and necessary payments to

its employees and officers, payment of its debts, necessary and required
purchases of goods and supplies, and to generally carry on the functions and
duties of municipal affairs.
Section 7. The requirement of reading this ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -
fifths of the members of the Commission.
Section 8. This Ordinance shall become effective immediately upon its
adoption.

It is respectfully recommended that an Ordinance amending
Ordinance No. 11127, which established initial resources and
initial appropriations for a Special Revenue Fund entitled:
"Haitian Narcotics Enforcement," accepting an additional grant
from the U.S. Department of Justice, Office of Justice Programs,
in the amount of $75,000 and appropriating funds for the
operation of same, be adopted.
BACKGROUND:
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking and has received assistance in
this endeavor from the Federal Government, through High Intensity
Drug Trafficking Area Grants. These grants provide an additional
incentive for the City of Miami Police Department to target
organizations involved in narcotics trafficking based on
geographic location. This specific grant targets narcotics
trafficking in the Haitian community. To accomplish this task
the Department of Justice has authorized an additional $75,000
toward the payment of overtime and rental vehicles. No matching
funds are required by the City.
This Ordinance is being requested on an emergency basis on the
grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, by curtailing
narcotics trafficking.

By accepting this award, the grantee assumes certain administrative
and financial responsibilities including the timely submission of
all financial and programmatic reports, resolution of all interim
audit findings, and the maintenance of a minimum level of grant
cash -on -hand. Should your organization not adhere to the terms and
conditions of this award, it is subject to termination for cause or
other administrative action as appropriate.

SPECIAL CONDITIONS
1. The grantee agrees to comply with the financial and
administrative requirements set forth in the effective
edition of the "Financial and Administrative Guide for
Grants," OJP M 7100.1D.
2. Equipment acquired under the grant program must be used by
the grantee in the program or project for which it was
acquired as long as needed, whether or not the project or
program continues to be supported by Federal funds. When no
longer needed for the original program, the equipment may be
used in other activities supported by the Federal agency.
They grantee may dispose of the original equipment when no
longer needed or supported by the Federal agency.
Items with a current per -unit fair market value of less than
$5,000 may be retained, sold, or otherwise disposed of with
no further obligation to the grantor agency.
Items in excess of $5,000 may be retained or sold and the
grantor agency shall have a right to an amount as stated in
the &Financial and Administrative Guide for Grants#, OJP
M7100.1D.
3. In order to provide for compatibility, integration,
coordination, and cost effectiveness in the use,
procurement, and operation of ADP systems, equipment, and
software, grantees are encouraged and authorized to enter
into joint purchase or service agreements on a reimbursable
or nonreimbursable basis with other HIDTA grantees, the
COMPACT, or any RISE project, as appropriate.
4. where furniture has been approved in the budget, the grantee
will make every effort to utilize existing State and local
surplus property prior to the purchase of any furniture,
including computer furniture or items of a similar nature.
5. The grantee will be permitted to designate funds that would
be matched or shared, however, these matched or shared funds
will notconstitute an obligation on behalf of the grantee.
6. No funds shall be used to supplant state or local funds that
would otherwise be made available for such purposes.

7. with respect to information, criminal intelligence systems
operating with support of Federal funds, 28 CPR Part 23
shall apply.
S. Grantee agrees not to use designated aircraft assigned to
BIDTA approved task operations and initiatives for the
transport of VIP Executive(s) or similar circumstances not
relating to the goals and objectives of the State and local
law enforcement grant programs.
9. Prior to the expenditure of confidential funds, the
subgrantee shall sign a certification indicating that he or
she has read, understands, and agrees to abide by all of the
conditions pertaining to confidential fund expenditures as
set forth in the "Financial and Administrative Guide for
Grants,n OJP M 7100.1D, Attachment 7.
10. The recipient agrees not to obligate, expend or drawdown
funds until a revised budget and budget narrative are
submitted to the Office of the Comptroller, OJP for review
and approval.
11. Grantee may make budget adjustments up to ten (10) percent
of the grant award within any approved budget category
within the specific award initiative. Adjustments in excess
of ten (10) percent must be approved by the Office of
Justice Programs.
12. Budget item submissions for equipment and other contract
items are accepted as best estimate only and are not deemed
approved at that price. Grantees are required to assure
such items are not currently available, are not duplicative
or excessive, and should make market surveys and obtain the
best prices available.
13. The recipient agrees to comply with the organizational audit
requirements of OMB Circular A-128, "Audits of State and
Local Governments." In conjunction with the beginning date
of the award, the audit report period of the 'state or local
governmental entity to be audited under the single audit
requirement is Oct 1, 1994 to Sept. 30, 1995. The audit
report must be submitted no later than Oct. 31, 1996 and for
each audit cycle thereafter covering the entire award period
as originally approved or amended. The management letter
must be submitted with the audit report. Subsequent audits
must be submitted no later than thirteen (13) months after

the close of the recipient organization's audited fiscal
year. The submission of the audit report shall be as
follows:
An original and one copy of the audit report shall be sent
to the Department of Housing and Urban Development. Also, a
copy of the audit report shall be sent to DEPARTMENT OF
JUSTICE, ATLANTA REGIONAL INSPECTOR GENERAL FOR AUDIT, 101
MARIETTA STREET, SUITE 2322, ATLANTA GA 30323-2401, and a
copy of your audit transmittal letter addressed to the
Federal regional inspector general's office shall be sent to
Audit Services, Office of the Comptroller, Office of Justice
Programs, DOJ, Room 942, 633 Indiana Avenue, N.W.,
Washington, D. C. 20531.
14. The grantee agrees to account for and use program income in
accordance with the regulations as mandated in the Common
Rule, "Uniform Requirements for the Administration of
Grants and Cooperative Agreements" and the "Financial and
Administrative Guide for Grants," OJP M 7100.1D. The
grantee must use program income for any purpose consistent
with the National Drug Control Strategy. Program income
includes but is not limited to asset forfeitures.
15. For the periods ending September 30 and February 29, each
implementing agency/subgrantee will provide a brief
narrative statement describing the benefits of the HIDTA
funding support received, including accomplishments, with
statistics as appropriate. This information will be used by
the Office of National Drug Control Policy to determine the
effect which HIDTA funding has had on the recipient's
ability to support the National Drug Control Strategy. The
statement is due 15 calendar days after the end of the
reporting period.

The following is a synopsis of Agenda Item 11 and Agenda Item 12
for the March 24, 1994 City Commission meeting.
Agenda Item 11 is a request to accept a grant titled Haitian
Narcotics Enforcement Team from the High Impact Drug Trafficking
Area's grant programs for $135,000. The grant is designed for
the Miami Police Department to work mid -level narcotics cases
with the US Customs Service, the Federal Bureau of Investigation,
and the Drug Enforcement Administration that impact the Haitian
Community within the City of Miami. The money will be used to
purchase and lease equipment and to fund overtime.
Agenda Item 12 is a request to accept $34,519 from the Monroe
County Sheriff's Office. The Monroe County Sheriff's Office was
awarded a High Impact Drug Trafficking Grant to fund the South
Florida Investigative Support Center. Within this grant was $34,
519 for the city of Miami Police Department to provide all
Support Center agencies with Dade County public records research.
The money will be used to purchase and lease equipment and to
fund overtime.
It should be noted that no matching City funds will be required.

It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "Haitian Narcotics Enforcement,"
accepting a grant from the U.S. Department of Justice, Office of
Justice Programs, in the amount of $135,000 and appropriating
funds for the operation of same, be adopted.
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking and has received assistance in
this endeavor from the federal government, through High Intensity
Drug Trafficking Area Grants. These grants provide an additional
incentive for the City of Miami Police Department to target
organizations involved in narcotics trafficking based on
geographic location. This specific grant targets narcotics
trafficking in the Haitian community. No matching funds are
required by the City.
This Ordinance is being requested on an emergency basis on the
grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, by curtailing
narcotics trafficking.

It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "HIDTA Public Documents Research,"

Justice Programs, in the amount of $34,519 and appropriating
funds for the operation of same, be adopted.
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking and money laundering, and has
received assistance in this endeavor from the federal government,
through High Intensity Drug. Trafficking Area Grants. These
grants provide an additional incentive for the City of Miami
Police Department to target organizations involved in narcotics
trafficking based on geographic location. This specific grant is
being administered by the Monroe County Sheriff's Department, and
the Miami Police Department's role will be to provide public
records research, perform public records searches, perform
analytical investigations, and assist in the analytical and
forfeiture process through public records researching for all
HIDTA members -in need of such information. No matching funds are
required by the City.

HAITIAN NARCOTICS ENFORCEMENT TEAM
SUMMARY OF THE GRANT INITIATIVE
The purpose of this grant is to investigate narcotics activities
within a growing Haitian Community in the City of Miami. The
funded activities will result in the identification and disruption
of narcotics structures and organizations, the arrest and
prosecution of their members, and the identification and seizure of
their assets. This will be accomplished through the coordinated
efforts of all the participants of the police department and other
City of Miami governmental departments. A secondary result of the
project will be its expansion to other areas of South Florida with
large Haitian populations.
Additionallt, other jurisdictions are beginning to experience large
migrations of Haitians to their areas. This grant will allow the
assistance to these jurisdictions of Haitian personnel for
translation and other law enforcement purposes.
