ORDINANCE NO.
AN EMERGENCY ORDINANCE, WITH ATTACHMENT, ESTABLISHING
INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A
SPECIAL REVENUE FUND ENTITLED "HIDTA ASSET FORFEITURE
RESEARCH"; AUTHORIZING THE CITY MANAGER TO ACCEPT THE
GRANT OF $25,000 FROM THE MONROE COUNTY SHERIFF'S
DEPARTMENT AND TO EXECUTE ANY NECESSARY DOCUMENTS TO
ACCEPT SAID GRANT; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Police Department continues to investigate
narcotics trafficking, and money laundering; and
WHEREAS, there is a need to target specific geographical areas; and
WHEREAS, the Monroe County Sheriff's Department, has awarded the City of
Miami Police Department $25,000 to be used for the payment of overtime,
vehicle rental, necessary equipment, travel and miscellaneous expenses, with

no matching funds from the City of Miami; and

WHEREAS, any purchases would have to comply with applicable city code
purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.

Section 2. The following Special Revenue Fund is hereby established and
resources are hereby appropriated as described herein:
FUND TITLE: HIDTA ASSET FORFEITURE RESEARCH
RESOURCES: Monroe County Sheriff's Dept. $25,000
APPROPRIATIONS: Personnel Overtime $14,000
Travel $ 8,000
Equipment $ 2,000
Miscellaneous $ 1,000
Section 3. The City Manager is hereby authorized to accept the grant as
set forth in the Preamble to this Ordinance and to enter into the necessary
contract(s) and/or agreement(s), in a form acceptable to the City Attorney, 1/
for the acceptance of the aforesaid monies for the compensation of personnel,
and other related costs.
Section 4. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 5. If any section, part of section, paragraph, clause, phrase,
or word of this Ordinance is declared invalid, the remaining provisions of
this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami, and upon the further grounds of the
necessity of the City of Miami to make the required and necessary payments to
its employees and officers, payment of its debts, necessary and required

purchases of goods and supplies, and to generally carry on the functions and
duties of municipal affairs.
Section 7. The requirement of reading this ordinance on two separate
days is hereby dispensed with by an affirmative vote of not less than four -
fifths of the members of the Commission.
Section S. This Ordinance shall become effective immediately upon its

It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "HIDTA Asset Forfeiture Research,"
accepting a grant from the Monroe County Sheriff's Department, in
the amount of $25,000 and appropriating funds for the operation
of same, be adopted.
BACKGROUND:
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking and money laundering, through
High Intensity Drug Trafficking Area Grants (HIDTA). These
grants provide an additional incentive for the City of Miami
Police Department to target organizations involved in narcotics
trafficking based on geographic location. This specific grant is
being administered by the Monroe County Sheriff's Department, and
the Miami Police Department's role will be to provide public
records research, perform public records searches, perform
analytical investigations, and assist in the analytical and
forfeiture process through public records researching for all
HIDTA members in need of such information. No matching funds are
required by the City.
This Ordinance is being requested on an emergency basis on the
grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, by curtailing
narcotics trafficking.
