AN EMERGENCY ORDINANCE, WITH ATTACHMENT, ESTABLISHING A SPECIAL REVENUE FUND ENTITLED: "GEOGRAPHIC TARGETING PROGRAM"; APPROPRIATING FUNDS FOR ITS OPERATION IN AN AMOUNT NOT TO EXCEED $40,000; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT OF $40,000 FROM THE MONROE COUNTY SHERIFF'S DEPARTMENT AND TO EXECUTE ANY NECESSARY DOCUMENTS FOR SAID GRANT; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department is continuing its efforts in combatting narcotics trafficking; and WHEREAS, the funds will be used to target these organizations based on geographical location; and WHEREAS, funding will be through a Grant from the Monroe County Sheriff's Department with no matching funds from the City of Miami; and WHEREAS, any purchases would have to comply with applicable City Code purchase requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: ATTAC.N AIKNT��� CON TAINED 11261 FUND TITLE: RESOURCES: APPROPRIATIONS: Geographic Targeting Program Monroe County Sheriffs Dept. $40,000 Overtime Compensation $35,000 Equipment $ 3,000 Miscellaneous Expenditures $ 2,000 Section 2. The City Manager is hereby authorized to accept the Grant as set forth in the Preamble to this Ordinance and to enter into the necessary contract(s) and/or agreement(s), in a form acceptable to the City Attorneys, for the acceptance of the aforesaid monies for the compensation of overtime to various state and local law enforcement personnel. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 11261 of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. BACKGROUND: The Miami Police Department is continuing its efforts at combatting narcotics trafficking. The Monroe County Sheriff's Department, has awarded the City of Miami Police Department a grant of $40,000 as an incentive to target organizations involved in narcotics trafficking based on geographic location. No matching funds are required by the City. This Ordinance is being requested on an emergency basis on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, by curtailing narcotics trafficking. / 11261 �/ 36-I
