ORDINANCE NO.
AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: "STREET TREE
INVENTORY," AND APPROPRIATING FUNDS FOR THE
OPERATION OF SAME IN THE AMOUNT OF $25,000,
CONSISTING OF A $25,000 GRANT FROM THE
FLORIDA DEPARTMENT OF AGRICULTURE AND
CONSUMER SERVICES, FORESTRY DIVISION;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission pursuant to Resolution
No. 94-56, adopted March 24, 1994, authorized the City Manager to
submit a grant application in the amount of $25,000, for the
preparation of a street tree inventory under the "Hurricane
Andrew Urban Reforestation Grant Program" from the Florida
Department of Agriculture and Consumer Services, Forestry
Division, and to execute the necessary documents to accept and
implement said grant, should said grant be awarded; and
WHEREAS, said grant was awarded to the City of Miami and a
Hurricane Andrew Urban Reforestation Grant Memorandum of
Agreement between the Florida Department of Agriculture and
Consumer Services, Forestry Division, and the City of Miami for a
"City of Miami Street Tree Inventory" was signed on September 28,
1994; and
WHEREAS, activities to be accomplished under this grant
program include the design and implementation of an urban tree

inventory system within the City of Miami's Geographic
Information System; and
WHEREAS, a local match is not a requirement for said grant;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CI`i'Y
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: STREET TREE INVENTORY
RESOURCES: Florida Department of Agriculture and
Consumer Services, Forestry Division,
Hurricane Andrew Urban Reforestation
Grant $25,000
APPROPRIATION: STREET TREE INVENTORY $25,000
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the

preservation of peace, health, safety, and property of the City
of Miami, as an agreement for professional services to perform

the duties associated with the grant must be signed prior to
June 1, 1995.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the attached
Emergency Ordinance establishing a new Special Revenue Fund entitled: "Street
Tree Inventory," and appropriating funds for the operation of same in the
amount of '25,000.
BACKGROUND
On March 24, 1994, the City Commission adopted Resolution No. •94-156
authorizing the City Manager to submit a grant application for a street tree
inventory to the Florida Department of Agriculture and Consumer Services,
Forestry Division, under the Hurricane Andrew Urban Reforestation Grant
Program. The City requested $25,000 to contract with a private firm .for an
inventory of trees within the public rights -of -way. The resolution also
authorized the City Manager to execute the necessary documents to accept and
implement the grant, if it should be awarded.
The City was awarded the grant for the entire requested amount, and a
Hurricane Andrew Urban Reforestation Grant Memorandum of Agreement was signed
on September 28, 1994.
No local match is required for this grant.
Justification for the emergency ordinance is based on the fact that a
professional services agreement must be signed immediately in order for the
consultant to have sufficient time to complete the scope of services required
by the grant.
