HomeMy WebLinkAboutO-11251J-95-277 4/17/95 ORDINANCE NO. 11251 AN EMERGENCY ORDINANCE CREATING A NEW SPECIAL REVENUE FUND ENTITLED: "PROGRAMS FOR THE DEVELOPMENTALLY DISABLED - 1995--96" AND APPROPRIATING FUNDS FOR ITS OPERATION IN THE ESTIMATED TOTAL AMOUNT NOT TO EXCEED $494,594 CONSISTING OF AN ESTIMATED $350,750 GRANT FROM THE STATE OF FLORIDA, DEPARTMENT OF HEALTH ARID REHABILITATIVE SERVICES (HRS), $43,844 AS A CONTRIBUTION FROM THE GENERAL FUND FOR THE REQUIRED LOCAL MATCH, AND $100,000 IN CARRY-OVER FUND BALANCE FROM THE SPECIAL REVENUE FUND ENTITLED "RECREATION PROGRAMS FOR THE DEVELOPMENTALLY DISABLED - FY '95"; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, pursuant to Resolution No. 95-298 adopted May 1 , 1995, the City has accepted a grant for an estimated amount not to Exceed $350,750 from the State of Florida Department of Health and Rehabilitative Services (hereinafter referred to as HRS) for funds to support programs for the developmentally disabled during ' the coming year; and WHEREAS, said programs will be provided to individuals with disabilities by the Parks and Recreation Department through its Programs for Persons with Disabilities during the period July 1, 1995 through June 30, 1996; and WHEREAS, said grant requires a 12.5% local match, or an estimated total amo,_.nt not to exceed $43,844, which amount is available from the existing General Fund Operating Budget of said Division; and 11251 WHEREAS, a fund balance in the amount of $100,000 is anticipated from the Special Revenue Fund entitled "Recreation Programs for the Developmentally Disabled - FY '95" which should be carried over into the new fund; and WHEREAS, the aggregate of these funds, for the total estimated amount not to exceed $494,594 will allow the program to continue through June 30, 1996; NOW, THEREFORE, BE IT -.ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund is hereby established as described herein: FUND TITLE: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED - 1995-96: RESOURCES: UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES (RANT THROUGH THE FLORIDA DEPARTMENT OF HEALTH AND REHABILITATIVE SERVICES $350,750 CONTRIBUTION FROM THE GENERAL FUND $ 43,844 CARRY-OVER FUND BALANCE FROM FY '95 SPECIAL REVENUE FUND "RECREATION PROGRAMS FOR THE MENTALLY RETARDED" $100,000 APPROPRIATION: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED - 1995-96 $494,594 Section 2. This appropriation is contingent upon the approval of the City's application for said grant by the State of Florida Department of Health and Rehabilitative Services and the City Manager's acceptance thereof. 11251 -2- A Section 3. All Ordinances or parts of.Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. Background: The Department of Parks and Recreation - Programs for Persons with Disabilities has received grant funds from the State of Florida Department of Health and Rehabilitative Services for the past seventeen years. These monies have been used to provide community recreation, developmental training, supported employment and transportation services to more than one hundred fifteen (115) developmentally disabled adults on a. weekly basis. Due to the high quality of service provided by the City of Miami, it is expected that the State of Florida will again award grant funds. The contract period for the grants will run from July 1, 1995 through June 30, 1996.
