AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING: SECTION 401, "SCHEDULE OF DISTRICT REGULATIONS," TO AMEND THE R-2 TWO FAMILY RESIDENTIAL ZONING DISTRICT IN ORDER TO DELETE THE PROVISION ALLOWING FOR LOTS WITH MORE THAN FIVE THOUSAND SQUARE FEET, ONE ADDITIONAL DWELLING UNIT FOR EACH TWO THOUSAND FIVE HUNDRED SQUARE FEET, BY SPECIAL EXCEPTION ONLY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of January 18, 1995, Item No. 3, following an advertised hearing adopted Resolution No. PAB 5-95 by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11246 Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance .of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:i/ ARTICLE 4. ZONING DISTRICTS R-2 Two Family Residential. Conditional Principal Uses: Same as for R-1 Single Family Residential and in addition:. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Ellipsis and asterisks indicate omitted and unchanged material. 11246 -2- invalid, the .remaining provisions of this Ordinance shall not be affected. Section 5. PETITION Consideration of amending Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by amending Article 4, Section 401, Schedule of District Regulations, to amend the R-2 Two -Family Residential Zoning District in order to delete the conditional principal use which allows for lots with more than five thousand square feet, one additional dwelling unit for each two thousand five hundred square feet, by Special Exception only. RECOMMENDATION BACKGROUND AND At the July 26, 1994 City Commission Meeting, Motion No. 94-594 was approved which ANALYSIS directed the administration to study the issue of a proposed amendment to the Zoning Ordinance which would eliminate the provision that allows, by Special Exception, one additional dwelling unit for each•2,500 square feet, for lots with more than 5,000 square feet. The Planning Division has revisited the issue and has concluded that this provision should be eliminated due to the potentially overall negative effect that such densities could cause in stable duplex residential areas.
