HomeMy WebLinkAboutO-11244J-94-871 11/4/94 ORDINANCE NO. 112 4 4 AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF THE COMPREHENSIVE NEIGHBORHOOD PLAN FOR PROPERTIES FRONTING FLORIDA AVENUE FROM MATILDA STREET TO MCDONALD STREET, EXCLUDING I KIRK MUNROE PARK, BY CHANGING THE LAND USE DESIGNATION FROM SINGLE FAMILY RESIDENTIAL TO MEDIUM DENSITY MULTIFAMILY RESIDENTIAL; MAKING FINDINGS; INSTRUCTING THE TRANSMITTAL OF A COPY OF THIS ORDINANCE TO AFFECTED AGENCIES; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning Advisory Board, at its meeting of October 12, 1994, Item No. 4, following an advertised hearing, { adopted by Resolution No. PAB 57-94, by a vote of six to two (6-2), RECOMMENDING DENIAL of an amendment to the Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, as hereinafter set forth; and WHEREAS, notwithstanding the Planning Advisory Board's recommendation, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of j the general welfare of the City of Miami and its inhabitants to grant this Comprehensive Plan change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, E i as 11244 W is hereby amended by changing the land use designation for the properties fronting on Florida Avenue from Matilda Street to McDonald Street, excluding Kirk Munroe Park, from Single Family Residential to Medium Density Multifamily Residential; more particularly described as Lots 13 through 20 of Block 1, and Lots 1 through 12 of Block 2, CHARLES H. FROW SUBDIVISION (13-53), of the Public Records of Dade County, Florida. Section 2. It is hereby found that this Comprehensive Plan designation change: (a) is necessary due to changed or changing conditions; (b) involves a residential land use of 10 acres or less and a density of 10 units per acre or less or involves other land use categories, singularly or in combination with residential use, of 10 acres or less and does not, in combination with other changes during the last year, produce a cumulative effect of having changed more than 60 acres; (c) is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; and (d) is one which does not involve the same owner's property within 200 feet of property that has been the subject of a Comprehensive Plan change within the last year. Section 3. The City Manager is hereby instructed to direct the Director of Planning, Building and Zoning to transmit a copy of this Ordinance immediately upon adoption on second reading to Linda Shelley, Secretary, Florida Department of 11244 Community Affairs, Tallahassee, Florida, The South Florida Regional Planning Council; The South Florida Water Management District; The Florida Department of Environmental Protection; and the Florida Department of Transportation, for statutorily mandated review and comment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. PLANNING Approval. RECOMMENDATION BACKGROUND AND The proposed amendment to the Future Land Use Plan Map of the Comprehensive Plan is ANALYSIS for the purpose of implementing the Florida Avenue Special District on the subject properties pursuant to City Commission Resolution No. 94-295, adopted on April 28, 1994, which approved the project in principle. October 12, 1994 11244 Page 1 CASE NUMBER 94-138 P A B - ITEM 14 October 12, 1994 ANALYSIS OF PROPOSED COMPREHENSIVE PLAN AMENDMENT No.94-11 Properties fronting Florida Avenue from Matilda Street to McDonald Street excluding Kirk Munroe Par . DISCUSSION The subject 2.8 acre parcel consists of eighteen (18) lots fronting Florida Avenue, twelve (12) lots in the north half of the block bounded by McDonald Street, Matilda Street, Grand Avenue and Florida Avenue and, six (6) lots on the -south half of the block bounded by McDonald Street, Matilda Street, Oak Avenue and Florida Avenue, in the Coconut Grove Planning District. MCNP Land Use Policy 1.6.1., establishes future land use categories according to the Future Land -Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The subject properties are currently designated Single Family Residential. The six lots north of the subject properties and lots to the west are similarly designated and to '-the north there is Residential Duplex Residential designated area. To the northeast is a Recreation designated property. To the east, there is a Major Public Facilities, Transportation and Utilities designation and to the south, is a Restricted Commercial designated area. The Single Family Residential land use category permits single family structures of one dwelling unit each to a maximum density of 9 dwelling units per acre. Supporting services such as foster homes and family day care homes for children and/or adults and community based residential facilities also be allowed. Places of worship, primary and secondary schools, child care centers and adult day care center are permissible in suitable locations within single family residential areas. PAB 10/12/94 Item #4 11244 Page 1 of 2 The Medium Density Multi -family Residential land use category permits multifamily structures up to low-rise apartment structures to a maximum density of 65 dwelling units per acre and lower density residential structures. Permissible uses include accessary commercial and office activities in the same building that are intended to serve the retailing and personal services needs of the immediately surrounding neighborhood and community -based residential facilities (14 clients or less). The proposed amendment to the Future Land Use Map of the Comprehensive Plan is for the purpose of implementing the Florida Avenue Special District on the subject properties pursuant to City Commission Resolution No 94-295, adopted on April 28, 1994, which approved the project in principle. This project was originally prepared by Dover, Kohl and Partners for the Florida Avenue neighbors and the City of Miami. At present, the subject properties consist of one and a half block area designated Single Family Residential which lies between Duplex Residential and Restricted Commercial designations; this petition is in order to create a Medium Density Residential as a transition between the Restricted Commercial and the Duplex Residential designations. MCNP Land Use Goal 1, requires the City to promote the efficient use of land use and minimize land use conflicts. The change also, would be consistent with Policy 1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies 1.1.5. and 1.2.7. require the City to preserve and enhance the general appearance and character of the City neighborhoods. Together these goals and policies support the position that the existing land use pattern in this neighborhood should be changed. In addition, Land Use Policy 1.1.1. requires new development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon the availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) Policy (Policy CI-1.2.3.). The attached Concurrency Management Analysis pertaining to concurrency demonstrates that no levels of service would be reduced below minimum levels.
