ORDINANCE NO.
AN ORDINANCE, WITH ATTACHMENTS, AMENDING THE
OFFICIAL ZONING ATLAS BY: (1) DELETING THE
EXISTING SD-18 MINIMUM LOT SIZE OVERLAY
DISTRICT AND SUBSTITUTING THEREFOR A NEW
SD-18.1 MINIMUM LOT SIZE OVERLAY DISTRICT
(REQUIRING A MINIMUM LOT SIZE OF 20,000
SQUARE FEET) FOR: (a) THOSE LOTS CURRENTLY
ZONED R-1 SINGLE FAMILY RESIDENTIAL, WITH THE
SD-18 OVERLAY, AND HAVING A MINIMUM OF 20,000
SQUARE FEET IN AREA AND LOCATED WITHIN THE
AREA GENERALLY BOUNDED BY SOUTHWEST 22ND
AVENUE TO THE WEST, NATOMA STREET TO THE
EAST, U.S. 1 (SOUTH DIXIE HIGHWAY) TO THE
NORTH, AND TIGERTAIL AVENUE TO THE SOUTH; (b)

UNPLATTED PARCELS CURRENTLY ZONED R-1 SINGLE
FAMILY RESIDENTIAL, AND HAVING A MINIMUM OF
20,000 SQUARE FEET IN AREA, WITHIN THE AREA
GENERALLY BOUNDED BY SOUTHWEST 27TH AVENUE TO
THE WEST, THE RICKENBACKER CAUSEWAY AND
FEDERAL HIGHWAY TO THE EAST, U.S. 1 (SOUTH
DIXIE HIGHWAY) TO THE NORTH, AND BISCAYNE BAY
TO THE SOUTH; CONTAINING A REPEALER
PROVISION, SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Planning Advisory Board, at its meeting of
November 16, 1994, Item No. 7, following an advertised hearing,
adopted Resolution No. PAB 72-94, by a vote of five to two (5-2),

RECOMMENDING APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration
of this matter, deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to
grant this zoning change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by:
(1) Deleting the existing SD-18 Minimum Lot Size Overlay
District (requiring a minimum lot size of 10,000 square
feet), and simultaneously substituting therefore, a
SD-18.1 Minimum Lot Size Overlay District (requiring a
minimum lot size of 20,000 square feet) for:
(a) those lots currently zoned R-1 Single Family
Residential with the SD-18 Overlay, and having a
minimum of 20,000 square feet in area located
within the area generally bounded by
Southwest 22nd Avenue to the west, Natoma Street
to the east, U.S. 1 (South Dixie Highway) to the
north, and Tigertail Avenue to the south, as
depicted on "Exhibit A" attached hereto and made a
part thereof (complete legal description on file
with the Hearing Boards Office); and

(b) those lots currently zoned R-1 Single Family
Residential with the SD-18 Overlay, and. having a
minimum of 20,000 square feet in area located
within the area generally bounded by the
Riokenbacker Causeway and Federal Highway to the
east, Vizcaya Museum And Gardens to the west,
South Miami Avenue to the north, and Biscayne Bay
to the south, as depicted on "Exhibit B" attached
hereto and made a part thereof (complete legal
description on file with the Hearing Boards
Office); and
(2) Adding the SD-18.1 Minimum Lot Size Overlay District
I
(requiring a minimum lot size of 20,000 square feet)
for those unplatted parcels currently zoned R-1 Single
Family Residential and having a minimum of 20,000
square feet in area within the area generally bounded
by Southwest 27th Avenue to the west, the Riekenbaoker
Causeway and Federal Highway to the east, U.S. 1 (South
Dixie Highway) to the north, and Biscayne Bay to the
south, as depicted on "Exhibit C" attached hereto and
made a part thereof (complete legal description on file
with the Hearing Boards Office).
Section 2. It is hereby found that these zoning
classification changes:

(a) are in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) are not contrary to the established land use pattern;
(o) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) are not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) are necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
areas;
(k) will not adversely affect property values in the
adjacent area;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner so as to compromise the protection of
the public welfare.
Section 3. Page Nos. 43 and 44 of the Zoning Atlas,
made a part of Ordinance No. 11000, as amended, by reference and

description of said Ordinance, are hereby amended to reflect the
changes made necessary by this amendment.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective after
final reading and adoption thereof pursuant to Section 163.3189,
Florida Statutes (1993).

RECOMMENDATION
BACKGROUND AND At the City Commission meeting of February 23, 1995, this proposed amendment to the
ANALYSIS atlas of Zoning Ordinance 11000 was passed on first reading with the exception that
the properties within the subject area that were located between S. Bayshore Drive
and Tigertail be continued as a separate item for additional review. Based on this
request, this fact sheet and backup have been revised to include only the areas
depicted on the attached Exhibits A, B, and C. The requested amendment to the
zoning atlas is in order to implement the intent of the SO-18.1. Minimum Lot Size
Overlay District (requiring a minimum lot size of 20,000 square feet) for all lots
which are currently zoned R-1 Single -Family Residential, have a minimum lot size of
20,000 square feet, and are located within the areas described in the attached
exhibits. This change has no effect on the uses of the underlying district, it is
an overlay district which only limits the minimum lot size permitted.
