AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 618 TO INTRODUCE AND MAKE PROVISIONS FOR A NEW MINIMUM LOT SIZE OVERLAY DISTRICT (REQUIRING A MINIMUM LOT SIZE OF 20,000 SQUARE FEET) ENTITLED SD-18.1.; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of November 16, 1994, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 71-94 by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Cca:mission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MUM, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows : '/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Ellipsis and asterisks indicate omitted and unchanged material. 11240 "ARTICLE 6. SPECIAL DISTRICTS Sec. 618. SD-18, SD-18.1: Minimum Lot Size Overlay District. Sec. 618.1. Intent SD-18. It is the intent of these special district regulations to restrict the minimum lot size to 10,000 square feet and the minimum lot width to 100 feet in order to preserve the character of certain neighborhoods in the city. (Ord. No. 10863, e.1, 3-28-91) Sec. 618.2. Effect of SD-18 district designation. The effects of these SD-18 regulations shall be to modify regulations within portions of other zoning districts included within the SD boundaries to the extent indicated herein. 618.2.1. Limitations on size of lot. Uses permitted on lots designated as SD-18 shall be the same as those of the R-1 Single -Family Residential District, except that minimum lot size shall be ten thousand (10,000) square feet and minimum lot width shall be one hundred (100) feet. 618.2.2. Limitations on yards. All yards adjacent to South Bayshore Drive for properties designated SD-18 shall be a minimum of seventy (70) feet. Sec. 618.3. Intent SD-18.1. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. Pzu-13 PETITION Consideration of amending Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, by amending Article 6, Special Districts, Section 618, to add provisions for a new twenty thousand (20,000) square foot minimum lot size overlay district entitled SD-18.1. PLANNING Approval. RECOMMENDATION BACKGROUND AND Per Motion 94-680, at its meeting of Sept. 22, 1994, the City Commission directed ANALYSIS the Administration to initiate amending zoning legislation to establish 20,000 square foot minimum lot sizes in the Biscayne Park Terrace Subdivision, which is generally bounded by U.S. 1 (South Dixie Highway), S.W. 22 Avenue, S. Bayshore Drive and Natoma Street. The Cocoanut Grove Village Council had previously passed a resolution urging the City Commission to adopt amending legislation establishing a 20,000 square foot minimum lot size overlay district in the areas of Coconut Grove which have platted lots of 20,000 square feet or more. This legislation, along with the accompanying atlas amendment(s), provides for a new SD-18.1 Overlay District with 20,000 square foot minimum lot sizes for different sub -areas of the Grove located east of S.W. 27th Avenue, and south of U.S. 1 (South Dixie Highway). The purpose of this legislation is two -fold: 1) to control residential densities in Coconut Grove; and 2) to give assurances to new homeowners buying houses on large lots that the immediate neighborhood will retain the original residential character sought in the original subdivision (see history attached). November 16, 1994 11240 Page 1 0 HISTORY BISCAYNE PARK TERRACE was platted in 1912; most lots were platted to a minimum lot size of 20,000 square feet. Prior to approximately 1978, these lots could be sub -divided to a minimum lot size of approximately 5,000-6,000 square feet, through the subdivision process. Since then, the following chronology has pertained: 1977-1978 BEGONIA VILLAS, at the southeast corner of Secoffee Street SW 22nd Avenue, was replatted with 6,000 square foot lots. BEGONIA VILLAS SECTION ONE, on SW 22nd Avenue was replatted with 6,000 square foot lots. 1978 The lots in BISCAYNE PARK TERRACE (including BEGONIA VILLAS) were rezoned from R-1 to R18 or from a minimum lot size of 6,000 square feet to 10,000 square feet, the same as the large lots in South Grove, south of Poinciana, in Comprehensive Zoning Ordinance 6871. 1983 Coincident with the onset of Zoning Ordinance 9500, the nomenclature was changed to RS-1/1, but the minimum lot size remained at 10,000 square feet. 1990 Coincident with the onset of Zoning Ordinance 11000, the nomenclature was changed to R-1 with an SO-18 overlay district, but the minimum lot size remained at 10,000 square feet. March 31, 1994 Petitions from BISCAYNE PARK TERRACE were forwarded to Planning, Building and Zoning, Department requesting 20,000 square foot minimum lot size overlay district. June 2, 1994 Administration requests legal opinion on 20,000 square foot minimum lot size district. August 9, 1994 Law Department issues legal opinion that the establishment of 20,000 square foot minimum tot size district does not constitute exclusionary zoning. September, 1994 Cocoanut Grove Village Council supports a zoning amendment to provide 20,000 square feet minimum lot sizes for areas in Grove platted at 20,000 square foot.
