AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, BY CHANGING THE ZONING CLASSIFICATION FROM R-2 TWO-FAMILY RESIDENTIAL TO C-1 RESTRICTED COMMERCIAL FOR THE PROPERTY LOCATED AT 2720/28/40 SOUTHWEST 6TH STREET, AND 2725/35/45 SOUTHWEST 7TH STREET, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN); AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 33 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board at its meeting of January 9, 1995, Item No. 4, following an advertised hearing, adopted Resolution No. ZB 004-95, by a six to two (6-2) vote, RECOMMENDING APPROVAL of a change of zoning olassification, as hereinafter set forth; and WHEREAS, the City Commission, after oareful oonsideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning olassifioation as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1123'7 Section 1. The Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, is hereby amended by changing the zoning classification from R-2 Two -Family Residential to C-1 Restricted Commercial for the property located at 2720/28/40 Southwest 6th Street, and 2725/35/45 Southwest 7th Street, Miami, Florida, legally described as Lots 8 through 18, Block 1, HARDING HEIGHTS SUBDIVISION, as set forth in Plat Book 6 at Page 138 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (c) will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) is necessary due to changed or changing conditions; (g) will not adversely influence living conditions in the neighborhood; (h) will not create or excessively increase traffic congestion or otherwise affect public safety; 11237 -2- (i) will not create a drainage problem; (j) will not seriously reduce light and air to adjacent area; (k) will not adversely affect property values in the adjacent area; i (1) will not be a deterrent to the improvement or development of adjacent property in accord with i existing regulations; and (m) will not constitute a grant of special privilege to an 4H1 individual owner so as to compromise the protection of the public welfare. 1 Section 3. Page No. 33 of the Zoning Atlas, made a part 1 of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said 1 Ordinance, is hereby amended to reflect the changes made i i necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in oonfliot with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective after final reading and adoption thereof pursuant to Section 163.3189, i Florida Statutes (1993). This letter will serve as the Applicants' letter of intent and response to questions No. 9 and 10 of the application. The Property. The Property is, presently zoned R-2 Two - Family Residential. It is.located immediately to the west of lands on S.W. 27th Avenue that are presently zoned C-1, Restricted -Commercial, also owned by the Applicants. The Property and the additional land owned by the Applicants are located acroas- from Miami -Dade Community College's Inter American Center, near the intersection of two major commercial corridors, S.W.-';'77th Avenue and S.W. 8th Street. The Property is presently utilized as a parking lot for Miami -Dade Community College. To the south of the Property is an area which is presently zoned C-1• Restricted -Commercial and is occupied by a restaurant, shopping center and a parking lot. Directly north and west of the Property are areas zoned R-2 Two -Family Residential District. Various other properties along 27th Avenue to the north are zoned Office. Justification for Zoning Change. It is the Applicants' position that the existing Two -Family Residential District zoning for the Property is unsuitable and inappropriate in light of the existing commercial land uses immediately adjacent to the Property, the intense commercialization of the area, and the Property's proximity to the intersection of two major commercial corridors, S.W. 27th Avenue and S.W. 8th Street. In the present case a number of factors make the Property unsuitable for residential development. For instance, the existing parking lot located to the south makes the Property a less desirable site for residential development. Additionally, the SD-12 Overlay District is located across S.W. 7th Street, and to the west of the Property. More important, approval of this. application would extend the Commercial -Restricted zoning from S.W. 27th Avenue west to a point which aligns with the western boundary of the commercial zoning district of the Property to the south. This would also make the Property more compatible with the properties located east and southeast across S.W. 27th Avenue which are zoned almost entirely C-1 Restricted -Commercial. Aside from the Property's incompatibility with the surrounding area, the Applicants also believe that the requested zoning change is justified since First Union which presently owns property on the east side of 27th Avenue between S.W. 5th Street and S.W. 6th Street, intends to exchange that property with the Applicants' Property contingent upon the approval of this zoning change. This land swap would allow all of Miami-Dade's College facilities to be located on the east side of S.W. 27th Avenue. First Union would relocate its existing bank operation to the Property and adjacent land on S.W. 27th Avenue subject to the requisite z®n4ng approvals.
