AN ORDINANCE AMENDING SECTION 22-12(a) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "GARBAGE AND TRASH/ARTICLE 1/WASTE FEES", THEREBY REFLECTING THE PURPOSE FOR WASTE FEES AND PROVIDING FOR INCREASES, WHEN NECESSARY, OF SAID FEES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the application of the annual fee assessed upon all residential units has changed due to changing technology and Florida statutory requirements; and WHEREAS, constituents must be made aware of the actual assessment and application of their residential waste fees; and WHEREAS, such fees enable the City to dispose of the solid waste collected from City residenoes in a legal and economically efficient manner; and WHEREAS, it is the City's intention to insure the most economically efficient cost for the disposal of the City's waste; and WHEREAS, the City Commission wishes to maintain fair and equitable costs for City services, but must also inform constituents of the actual cost of City services; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11233 f` Section 1. Section 22-12 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:.i/ "Sec. 22-12. Waste fees. (a) An annual fee of one hundred sixty dollars ($160.00) is hereby assessed upon all residential units as defined in section 22-1. Of the assessed fee forty- the total amount shall represent scale fees charged to the city by Dade--Comrty #U disposal facilityuresenti y en a ed by the city and These fees shall apply to residential units within the city not serviced by private sanitation companies and shall serve to defray the cost of said scale fees, waste collection and disposal. One half of said annual fee amount, eighty dollars ($80.00), shall be due and collectible on the first day of January and on the first day of July of each calendar year. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. The ordinance does not increase the fee, but re -describes it to reflect current use and provides for future increases in disposal fees and, therefore, costs to the City over which we have no control. BACKGROUND On an average nationally, a family of four (4) produces approximately four (4) tons of solid waste annually. Our historic data indicates that on an average we collect and dispose of, garbage, trash and recycling materials included, approxi- mately this amount of material per single family residence annually. Our current disposal options are as follows: LOCATION AMOUNT PER TON Dade County's Resource Recovery Plant $59 Dade County's Transfer Station $68 Wheelabrator Incinerator in Broward County $44 Kimmins Recycling Facility in Dade County $45 The average single residence annual disposal costs to the City are $236, $272, $170 or $130 annually, respectively, at these facilities. Currently, the Code of the City of Miami Sec. 22-12 Waste Fees, assesses a $160 annual waste fee per single family unit for all residential units. Of the assessed fee, Forty -Five Dollars ($45) represents scale fees charged to the City by'Dade County and One Hundred Fifteen Dollars ($115) is reflected as garbage collection fees. 112333,5 1 Honorable Mayor and Members of the City Commission Page 2 As you know, we intend to pursue achieving the lowest disposal cost per ton that we can provide for our residents. It is -for that reason that we are not currently recommending an increase in this fee to reflect this fiscal reality. As you can see, however, we are no longer able to attribute any- of the operational cost of collection to this fee. The attached ordinance, therefore, indicates that the $160 per single-family residence annual solid waste fee represents scale fees charged to the City by the disposal sites which it uses and further codifies automatic increases which will be based solely upon increases which the City may be forced to pay at disposal sites in the future. { 11233 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : Cesar H.
