ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 40-239 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY PROVIDING AN INCENTIVE RETIREMENT
PROGRAM TO THOSE MEMBERS OF THE CITY OF MIAMI
GENERAL EMPLOYEES' AND SANITATION EMPLOYEES'
RETIREMENT TRUST WHO ARE REPRESENTED BY THE
LABORERS' INTERNATIONAL UNION OF NORTH
AMERICA, AFL-CIO, LOCAL 800, THEREBY
PROVIDING THREE (3) YEARS SERVICE CREDIT TO
THOSE MEMBERS ELIGIBLE TO RETIRE UNDER
SERVICE RETIREMENT OR RULE OF 70 RETIREMENT
AND TO THOSE NON -ELIGIBLE MEMBERS WHO, WITH
THE ADDITIONAL THREE (3) YEARS SERVICE
CREDIT, WOULD QUALIFY UNDER SERVICE
RETIREMENT, OR RULE OF 70 RETIREMENT AND
PROVIDING FOR HEALTH INSURANCE COVERAGE;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Miami's administration and the
Laborer's International Union of North America, AFL-CIO, Local
800 ("L.I.U.N.A."), the certified bargaining agent, have entered
into a labor agreement concerning certain pension benefits to
members of the bargaining unit represented by L.I.U.N.A.; and
WHEREAS, the administration recommends certain modifications
to Section 40-239 of the Code of the City of Miami, to Implement
the modifications agreed upon In the labor agreement;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained In the
Preamble to this Ordinance are hereby adopted by reference
thereto and Incorporated herein as If fully set forth In this
Section.
Section 2. Section 40-239 of the Code of the City of
Miami, Florida, as amended, is hereby amended In the following
particulars1/:
"Sec. 40-239. Benefits
(A) Service Retirement
(5) Eligible members in service of the City of
Miami General Employees' and Sanitation
Employees' Retirement Trust represented by
the Laborers' International Union of North
America, AFL-CIO, Local 800, hereinafter
referred to as "L.I.U.N.A.", shall have a one
time window period In which to apply under
the Retirement Incentive Program set forth
hereinbelow In subsections 5(a), (b ), and
(c)
(a) Members in service who are members of
the L.I.U.N.A. bargaining unit and are
eligible for service retirement or Rule
of 70 retirement will receive three (3)
years of service credit upon exercising
the option to retire under the herein
Incentive Retirement Program.
(b) Members In service who are members of
the L.I.U.N.A. bargaining unit and are
not eligible for service retirement or
Rule of 70 retirement may add three (3)
years of service credit to qualify under
service retirement or Rule of 70
retirement so as to exercise the option
to retire under the herein incentive

Retirement Program. The retirement
benefit shall be enhanced by that
portion of service credit which is in
excess of the requirements for a service
retirement or Rule of 70 retirement.
(c) Members in service who are members of
the L.I.U.N.A. bargaining unit who
retire under the herein Incentive
Program shall receive one (1) year paid
health Insurance coverage similar to
that which the employee is currently
enrolled with the City. The health
Insurance coverage_shalI be of the same
_quality presently afforded retirees.
(S 6) A member eligible for service retirement may
choose any one (1) of the optional allowances
available to him or her on the date of
retirement, as provided in Section 40-239(L).

Section 3. All ordinances or parts of ordinances Insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance Is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

RECOMMENDATION
It Is respectfully requested that the City Commission approve theattached
ordinance amending Section 40-239 of the Miami Code by establishing a "one-
time" retirement window for members of the Laborer's International Union of
North America.
BACKGROUND
The City of Miami and the Laborer's International Union of North America
(LIUNA), AFL-CIO, Local 800, have entered into a bargaining agreement
containing certain pension benefits to members of the bargaining unit.
Article number 41 of the labor agreement creates a "one-time" retirement
window for eligible LIUNA members. The retirement window establishes three
(3) years of service credit which may be used by members eligible for Rule of
Seventy Retirement to enhance their pension benefit or by employees not
eligible for Rule of Seventy retirement to qualify for Rule of Seventy Retirement.
Any portion of the three (3) years of service credit remaining after qualifying for
Rule of Seventy Retirement may be used for enhancing the member's retirement
benefit.
Assuming a participation rate of 100%, the annual salary savings from the
retirement window are $1,563,680, $4,065,561, and $4,065,561 for FY'95,
FY'96, and FY'97 respectively. The annual cost of the retirement window is $0,
$1,010,000, and $1,010,000 for FY'95, FY'96, and FY'97 respectively; assuming
100% participation. In addition, the City will fund health insurance coverage for
retirement window participants for one (1) year at a cost of $98,950, $138,530,
and $0 for FY'95, FY'96, and FY'95 respectively; based upon 100% participation.
