HomeMy WebLinkAboutO-11215J-95-20 1l5/95 ORDINANCE NO. 11215 AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "DERELICT VESSEL REMOVAL GRANT PROGRAM", AND APPROPRIATING FUNDS IN THE AMOUNT OF $28,057.00 FOR SAID FUND FROM MONIES RECEIVED BY A GRANT FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION; FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT THE AFOREMENTIONED GRANT AWARD AND EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT SAID GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Florida Department of Environmental Protection is authorized, pursuant to Chapter 823.11, Florida Statutes, to provide grants to local governments to remove derelict vessels from waterways; and WHEREAS, the City of Miami has designated specific derelict vessels in the Miami River and in Biscayne Bay which pose a threat to public health and safety, navigation, the environment and/or the aesthetic condition of the general vicinity; and WHEREAS, the City of Miami desires to remove hazardous derelict vessels; and WHEREAS, the State of Florida Department of Environmental Protection has made a grant available to the City of Miami in the amount of $28,057.00; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11215 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: FLORIDA DERELICT VESSEL REMOVAL GRANT AWARD RESOURCES: STATE OF FLORIDA DEPARTMENT OF $28,057 ENVIRONMENTAL PROTECTION FLORIDA MARINE PATROL: DERELICT VESSEL REMOVAL PROGRAM APPROPRIATION': DERELICT VESSEL REMOVAL GRANT AWARD $28,057 Section 3. The City Manager is hereby authorized`/ to accept the aforementioned grant and execute the necessary documents . with the Florida Department of Environmental Protection, in a form acceptable to the City Attorney, to implement said grant. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 11215 -2- Section 6. BACKGROUND The Department of Management and B:,..dget, recommends ratification of the attached ordinance. There are a number of derelict vessels in our waterways. These abandoned boats are a threat to public health and safety, navigation, the environment, and the aesthetic condition of the area. The grant funds will allow us to start removing these hazardous derelict vessels. City Commission ratification of the attached ordinance is recommended.
