A RESOLUTION REVERSING THE DECISION OF THE ZONING BOARD AND GRANTING THE VARIANCE FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, R-1 SINGLE FAMILY RESIDENTIAL, PERMITTED PRINCIPAL USES, TO PERMIT A STRUCTURE WITH THE HEIGHT OF 29'-8" (25'-0" MAXIMUM ALLOWED), PER PLANS ON FILE, FOR THE PROPERTY LOCATED AT 1840 SOUTH BAYSHORE LANE, MIAMI, FLORIDA, ZONED R-1 SINGLE FAMILY RESIDENTIAL. WHEREAS, the Miami Zoning Board at its meeting of April 22, 1996, Item No. 2, duly adopted Resolution No. ZB 40-96 by a four to one (4-1) vote, denying the variance, as hereinafter set forth; and WHEREAS, an appeal has been taken to the City Commission by the applicant from the denial of the variance; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the recommendation of the Zoning Board, finds that there are peculiar circumstances affecting this parcel of land and that practical difficulties and unnecessary hardships do exist which would impair the owner's right to the reasonable use of the property without the grant of variance as hereinafter set forth; CITY COMMISSION MEETII4C OF DEC 1 2 1996 Res t;cam I�jQ f j 1 r NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board in this matter is reversed and the request for a variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, R-1 Single Family Residential, Permitted Principal Uses, to permit a structure with the height of 29'-81, (25'-0" maximum allowed), per plans on file, to an existing single family residence located at 1840 South Bayshore Lane, Miami, Florida, more particularly described as Lot 1, and the northeast 42 feet of Lot 2, Block 9, CRYSTAL BLUFF ADDITION, as recorded in Plat Book 9 at Page 43 of the Public Records of Dade County, Florida, zoned R-1 Single Family Residential, is hereby granted. (a) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district in that: (list evidence to be produced and use additional sheets, if necessary.) There are special conditions with this lot that we feel cause hardship to justify our request for a variance with regards to the maximum height requirements in the "Zoning Ordinance of the City of Miami". The first unique condition has to do with the location of the property. The lot is situated one lot south (65"-0" away) from the bridge on Fair Isle Street that takes you to Grove Isle. As you stand on the seawall at the rear of the property and look to the north the bridge and the accompanying traffic which is considerable dominate the view. The bridge rises out of the water blocking the view of the bay in that direction and is a constant source of noise. As you pan from the bridge towards the bay you see the three large eighteen story condominium buildings that are situated on the isle. An additional condition that is unique to this property is the fact that the property is narrower than all other waterfront lots in the neighborhood. This also hinders the view from the rear of the property out to the bay. The lot to the north which is adjacent to Fair Isle Street is 65"-0" wide and has a three-story mediterranean home and coach house built in 1929. The lots to the south are all 100"-0" wide giving the property owners large unobstructed panoramas of the bay. We are asking for approximately a 5'-0" variance in the height of the roof in order to accommodate a mediterranean design which we feel is appropriate for the City of Miami and in particular for this location. The additional height is important in order for the proportions of mediterranean elements of the design such as french doors with arched glass transoms and cast stone columns to work together aesthetically. The mediterranean home adjacent to this property contains a lot of the elements that we are including in our design. This home if built today and built according to the flood requirements would also require a variance for the height. The height variance if granted would also help alleviate the visual barrier of the bridge allowing more of a view of the bay over the bridge. (b) The special conditions and circumstances do not result from the actions of the petitioner in that the location of the lot and the size of the lot are given. The special conditions are the proximity of the lot to the bridge on Fair Isle Street and the width of the lot which is 50"-011 , while most other lots on the water in the neighborhood are 100"-0" wide. (c) Literal interpretations of the provisions of the zoning ordinance would deprive the applicant of rights commonly enioyed by other properties in the same zoning district under the terms of the zoning ordinance and would work unnecessary and undue.hardships in the petitioner in that the property is adversely affected by the bridge to Grove Isle and its proximity to this lot. We are trying to soften the impact of the bridge and the three eighteen story condominium buildings by bringing the second floor a couple of feet higher than would be allowed normally. This is important for the balcony of the second floor facing the bay. We have only 40 feet of width for the house, so it is important that we try to utilize that 40 feet to take as much advantage of the waterfront as possible. The additional height gives us that chance as well as giving us the opportunity to provide a beautiful Mediterranean design which will only enhance the coastline of the bay. (d) Granting the variance requested will not confer on the petitioner any special privilege that is denied by the Zoning Ordinance to other lands, buildings, or structures in the same zoning district in that most other properties have 100 feet of waterfront to take advantage of and are not obstructed by the bridge to Grove Isle and the large buildings that comprise the Grove Isle Condominiums. (e) The variance, if granted, is the minimum variance that will make possible the reasonable use of the land, building, or structure in that we are only asking for a 5 foot variance for the main roof. This is the minimum that will allow us to achieve our goals on the waterfront elevation of the lot and allow us to provide our client with a beautiful Mediterranean design that will become a residence of distinction in Miami. Because we are asking for a variance of 5 feet for the main roof of the house and the Zoning Ordinance states that architectural elements or towers can only project 10'-0" above the maximum height allowed for the roof of the house we are also asking for a height variance for the open air observation tower. The tower is an important element to the design of the house. It balances the symmetry of the design for both the front elevation and the elevation from the waterfront. It has been designed to have a roof hatch that opens from the attic allowing the owner to step up to a 10'-0" by 10'-0" platform. It is covered by a small 7'-0" diameter dome and is totally open to the air. This space is important to the aesthetics of the Mediterranean design that we chose for the project. We intentionally made this space as small c� e 2.3 Ii as we could and still allow it to function as an observation tower. The tower is also located as low as possible to work with the roof line and the South Florida Building Codes and still be functional. We have deliberately minimized the size of the tower so that the height of the tower does not overwhelm the front elevation. The main house is also located as far back on the property as possible, which also helps to diminish the impact of the height from the street. We have a garage building that will front the main house as well as some mature, tall date palms, tall solitaire palms, and tall coconut palms that will attractively landscape the property while diminishing the affect of the height of the house. We have designed the landscaping, using taller palms, in order to complement the design of the house and to limit the impact of what otherwise could be perceived -as a tall, narrow structure. (f) The grant of the variance will be in harmony with the general intent and purpose of the Zoning Ordinance, and will not be injurious to the neighborhood, or otherwise detrimental to _ the public welfare. We have, given the size of the lot and the conditions surrounding the lot, designed a house, that when built will be in harmony with the intent of the Zoning Ordinance and will possibly become another beautiful landmark on the coastline in the City of Miami. Located on the same coastline as Viscaya and the newly restored Santa Maria and next door to a mediterranean home built in 1923 we felt that a new home on this particular lot should be designed in the mediterranean style, respecting the history of Miami and its elegant, older homes.
