A RESOLUTION, WITH ATTACHMENT (S), DECLARING
THE NEED FOR A NON -AD VALOREM SPECIAL
ASSESSMENT AND EXPRESSING THE CITY
COMMISSION'S INTENT TO IMPOSE SUCH A SPECIAL
ASSESSMENT WITHIN THE INCORPORATED AREA OF
THE CITY OF MIAMI, FLORIDA, COMMENCING WITH
THE FISCAL YEAR BEGINNING ON OCTOBER 1, 1997,
FOR THE COST OF PROVIDING FIRE -RESCUE
SERVICES AND FACILITIES; FURTHER ELECTING TO
UTILIZE THE UNIFORM METHOD OF COLLECTING NON -
AD VALOREM SPECIAL ASSESSMENTS IN ACCORDANCE
WITH THE PROVISIONS OF SECTION 197.3632,
FLORIDA STATUTES, AS AMENDED; AND DIRECTING
THE CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE HEREIN DESIGNATED
OFFICIALS.
WHEREAS, the City Commission of Miami, Florida (the "City")
is contemplating the imposition of a non -ad valorem special
assessment to be levied upon real property within the
incorporated area of the City for the provision of fire -rescue
services and facilities; and
WHEREAS, commencing in November, 1997, the City intends to
collect the special assessment using the uniform method for levy,
collection and enforcement of non -ad valorem assessments as
authorized pursuant to Section 197.3632,
amended; and
Florida Statutes, as
WHEREAS, the City Commission has published notice- of its
intent to use the uniform method for collection of such

publication of such hearing being attached hereto as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby declares that the
levy of non -ad valorem special assessment is needed to fund the
cost of fire -rescue services and facilities within the
incorporated area of the City, more particularly legally
described on Exhibit "B" attached hereto and made a part hereof,
and hereby expresses its intention to impose such a special
assessment commencing with the fiscal year beginning on
October 1, 1997, utilizing the uniform method of collecting non -
ad valorem assessments authorized pursuant to Section 197.3632,
Florida Statutes, as amended.
Section 3. The City Clerk is hereby directed to transmit
a copy of this Resolution by United States mail by January 10,
1997, to the Florida Department of Revenue, the Dade County Tax
Collector, and the Dade County Property Appraiser.
Section 4. This Resolution shall become effective
immediately upon its adoption.

NOTICE OF INTENTTO USE UNIFORM METHOD OF COLLECTING NON AD -VALOREM ASSESSMENTS
The CityCommission of Miami, Florida (the "Commission") hereby provides notice, pursuant to Section
197.36323)(a), Florida Statutes, of its intent to use the uniform method of collecting non -ad valorem special
assessments to be levied within the incorporated area of Miami, for the cost of providing lire -rescue services and
facilities commencing for the Fiscal Year beginning'on October 1, 1997. The Commission will consider the
adoption of a resolution electing to use the uniform method of collecting such assessments authorized by Section
197.3632, Florida Statutes, at a public hearing to be held at 9:00 a.m., December 12, 1996, in the Commission
Chambers, City Hall, 3500 Pan American Drive, Miami, Florida. Such resolution will state the need for the levy
and will contain a legal description of the boundaries of the real property subject to the levy. Copies of the
proposed form of resolution, which contains the legal description of the real property subject to the levy, are on
file at the Office of the City Clerk of Miami, Florida, 3500 Pan American Drive, Miami, Florida. All interested
persons are invited to attend.
In the event any person decides to appeal any decision by the City Commission with respect to any matter
relating to the consideration of the resolution at the above -referenced public hearing, a record of the proceeding
may be needed and in such an event, such person may need to ensure that a verbatim record of the public
hearing is made, which record includes the testimony and evidence on which the appeal is to be based. In
accordance with the Americans with Disabilities Act, persons needing a special accommodation or an interpreter
to participate in this proceeding should contact the City Clerk's Office at (305) 250-5360 at least seven days prior
to the date of the hearing.

RECOMMENDATION
It is recommended that the City Commission adopt the attached Resolution which
elects to use the uniform method of collection for non ad -valorem assessments.
BACKGROUND
The Department of Fire -Rescue has undertaken steps to provide a new revenue
source by the assessment of a fee for fire services. The attached resolution is
submitted as a means of notification of intent to use the uniform method of
collection in Fiscal Year 97-98.
Section 197.3632, Florida Statutes, requires that the City must hold a public hearing
and adopt a resolution of intent to use the uniform method of collection for any
assessment program in the calendar year prior to any such collection. The
resolution, which does not obligate the governmental unit to use the method or
impose a special assessment, must be adopted by January 1 and sent to the Dade
County Tax Collector, the Dade County Property Appraiser and the Florida
Department of Revenue by January 10. If the Dade County Property Appraiser and
the Dade County Tax Collector agree, adoption of the resolution can occur as late
as March 1". However, we strongly recommend to you that the City adopt the
resolution prior to January 1 ", as the consent of the Dade County Property Appraiser
and Dade County Tax Collector is not required when the adoption occurs prior to
January 1.
