A RESOLUTION, WITH ATTACHMENT(S), APPROVING A
PARTIAL RELEASE OF A UNITY OF TITLE, AND
DIRECTING THE CITY MANAGER OR HIS DESIGNEE TO
EXECUTE THE "AGREEMENT RE: RELEASE OF LOT
FROM UNITY OF TITLE" AS SUBSTANTIALLY SET
FORTH IN EXHIBIT "A", ATTACHED HERETO AND
MADE A PART HEREOF, FOR THE PROPERTY OWNED BY
C.G.C. PROPERTIES, INC. AND LOCATED AT
77 NORTHWEST 36TH STREET, MIAMI, FLORIDA.
WHEREAS, C.G.C. PROPERTIES, INC. (the "Owner"), is the
fee simple owner and record titleholder of the property
located at 77 Northwest 36th Street, Miami, Florida (the
"Property"), which is encumbered by a Unity of Title executed
by Luciano Cacciamani as President of C.G.C. Properties, Inc.,
in favor of the City, dated March 6, 1989, recorded in
Official Records Book 14062 at Page 3007, a copy of which is
attached hereto and made a part hereof as Exhibit "B" (the
"Unity of Title"); and
WHEREAS, the City Administration recommends the release
of Lot 15, Block 10, PRINCESS PARK, according to the Plat
thereof, as recorded in Plat Book 6, Page 87 of the Public
Records of Dade County, Florida ( "Lot 1511) from said Unity of
Title; and
WHEREAS, the City Commission, following a public hearing,
finds that it is in the best interest of the general welfare

of Lot 15 from the Unity of Title and to authorize the City
Manager or his designee to execute the "Agreement Re: Release
of Lot from Unity Of Title", in substantially the form
attached hereto as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. A partial release of a Unity of Title is
hereby approved and the City Manager or his designee is hereby
directed to execute the "Agreement Re: Release of Lot From
Unity of Title", as substantially set forth in Exhibit "A"

attached hereto and made a part hereof, for the property owned
by C.G.C. Properties, Inc. and located at 77 Northwest 36th
Street, Miami, Florida, subject to its execution and
recordation at Owner's expense, releasing Lot 15 from the
IUnity of Title.
Section 3. Except as modified herein, all other
provisions set forth in the Unity of Title shall remain

binding on Owner and in full force and effect.
Section 4. This Resolution shall become effective
immediately upon its adoption.

AGREEMENT RE: RELEASE OF LOT FROM UNITY OF TITLE
THIS AGREEMENT made and entered into on this _ day of August,
1996 by and between C.C.G. PROPERTIES INC., a Florida Corporation
(hereinafter referred to as "C.C.G.") and the CITY OF MIAMI# a
Municipal Corporation thereinafter referred to as "CITY"];
W I T N E S S E T He
WHEREAS# C.C.G. is the owner of certain real property located
in Dade County, Florida and described as:
Lots 13, 14 and 15, Block 10, PRINCESS PARK, according to
the Plat thereof, as recorded in Plat Book 60 page 87 of
the public records of Dade County, Florida
WHEREAS, C.C.G. entered into a certain Unity of Title Agreement
dated March 6, 1989 and recorded on April 71 1989 in O.R. Book 14062
at page 3007 of the public records of Dade County, Florida, and
WHEREAS, C.C.G. desires to release Lot 15 aforedescribed from
said Unity of Title Agreement, and
WHEREAS, the City agrees to the release of Lot 15 aforedes-
cribed from said Unity of Title Agreement.
NOW THEREFORE, in consideration of the sum of Ten Dollars
($ 10.00) and other good and valuable considerations in hand paid
receipt of which is hereby acknowledged, the parties hereto covenant
and agree as follows:
1. The above and foregoing is true and correct.
2. The parties hereto hereby release the following real
property from the Unity of Title dated March 6, 1989 and recorded on
April 7, 1989 in O.R. Book 14062 at page 3007 of the public records

RECOMMENDATION
It is respectfully recommended that the City Commission approve the attached request to
release a unity of title for the property located at 77 N.W. 36 Street (Lot 15, Block 10,
PRINCESS PARK, according to the plat thereof, as recorded in Plat Book 6, page 87 of
the public records of Dade County, Florida).
The requested release of a unity of title is in order to release lot 15 from the remaining
lots (13 and 14) which were tied together through a recorded unity of title agreement in
1989 for the purpose of a unified development that was never realized. The Department
of Building and Zoning finds that the unity of title is no longer required and therefore has
no objections to the requested release thereof.

Grove Central Commercial District) of the City of Miami
Zoning Code
Dear Mr. Luft:
The Florida Department of State is the owner of the Coconut Grove
Playhouse located at 3500 Main Highway, Miami, Florida. It has
recently been brought to my attention that the City of Miami
Commission will be considering on second reading certain proposed
amendments to Article 6, Section 602 (SD-2 Coconut Grove Central
Commercial District) of the City of Miami Zoning Code on
Thursday, November 21, 1996.
Section 602.10A (Off -Site Parking) of the proposed amendments
appears to exclude the Coconut Grove Playhouse property (G/I
District) from the approved off -site parking area contemplated in
the amendment. As one of the few properties in Coconut Grove
that remains a viable option for alleviating the ever-increasing
shortage of off -site parking, it is in the public interest to
include the G/Z district, in which the Coconut Grove Playhouse
property is located, within the proposed off -site parking area.
Accordingly, subsection (1) of section 602.10.4 should be changed
to include the G/I district which includes the Coconut Grove
Playhouse property. Likewise, subsection (2) of section 602.10.4

should be changed to state that only those off -site parking
arrangements "outside the SD-2 District and the G/x District"
will be affected. To the extent that any of these changes would
necessitate a zoning or land use change to the Coconut Grove
Playhouse property, the Department of State withdraws same.
Although the Department of State was not officially notified of
the proposed amendments prior to first reading, we have agreed to
waive any past notice requirements pertaining to these proposed
amendments to the extent that the above -described changes are
incorporated therein and are approved by the City Commission.
