A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING
THE USE THOSE PORTIONS OF WATSON ISLAND
DEPICTED IN EXHIBIT "A", ATTACHED HERETO AND
MADE A PART HEREOF, BY NATIONAL MARINE
MANUFACTURERS ASSOCIATION, INC. ("NMMA"), FOR
PARKING AND CONCESSION, IN CONNECTION WITH
THE 1997 INTERNATIONAL BOAT SHOW TO BE HELD
FEBRUARY 13-19, 1997, SUBJECT TO NMMA
OBTAINING A CLASS I SPECIAL PERMIT;
ESTABLISHING A SPECIAL FEE IN THE AMOUNT OF
$90,000 FOR SAID USE; AND AUTHORIZING THE
CITY MANAGER TO INSTRUCT THE DIRECTOR OF THE
DEPARTMENT OF PARKS AND RECREATION TO ISSUE A
PARK PERMIT, IN SUBSTANTIALLY THE ATTACHED
FORM.
WHEREAS, pursuant to prior City Commission authorization,
the National Marine Manufacturers Association, Inc., ("NMMA") has
successfully staged in the past its annual International Boat
Show on portions of City -owned Watson Island; and

WHEREAS, the NMMA uses the southeast side of Watson Island
for its "park and ride" facility and areas on the northeast side
for exhibit space, concession space and for exhibitor parking;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this

Section 2. The City Manager is hereby authorized to
instruct the Director of the Department of Parks and Recreation
issue a park permit, in substantially the attached form, to the
National Marine Manufacturers Association, Inc., for a period not
to exceed thirty (30) days, for the use of those portions of
Watson Island depicted in Exhibit "A", attached hereto and made a
part hereof, for parking and concessions in connection with the
1997 Miami International Boat Show to be held February 13-19,
1997, subject to the National Marine Manufacturers Association,
Inc., obtaining a Class I Special Permit from the City for such
use and occupancy of Watson Island.
Section 3. A special fee of $90,000 is hereby
established in connection with said permit.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that we deny the National Marine
Manufacturers Association, Inc.'s (NMMA) request to utilize portions of
Watson Island for exhibits, parking and concession sales in connection with
the Miami International Boat Show to be held on February 13-19, 1997.
BACKGROUND
As has been the case in the past two (2) years, NMMA is requesting to
utilize portions of Watson Island for exhibit, parking and concession sales in
connection with the 1997 Miami International Boat Show. It is proposing to
pay a fee in the amount of $75,000 for the permit. Additionally, NMMA will
pay for any other required city costs such as police and provide the
necessary insurance.
This represents a much needed revenue source to the City of Miami. It is for
a temporary use only and in the past, it has been a trouble -free event.
As a result of the attached October 23, 1996 memorandum from City
Attorney A. Quinn Jones III, we must recommend DENIAL. The City
Attorney's memorandum indicates that "Section 29-C provides, in pertinent
part, that no revocable use permit, or license agreement may be entered into
for the occupancy or use of the areas known as Watson Island - unless there
is public notice and the proposed transaction is approved by a majority of the
votes cast by the electoral at a referendum."

ENCLOSURES:
We are in receipt of, and have reviewed various documents provided by your office
pertaining to a request from National Marine Manufacturers Association, Inc. (NMMA) for
permission to utilize certain areas of Watson Island for purposes of operating a "park and ride", food
and beverage concession, and exhibitions in connection with the 1997 International Boat Show to be
held on February 13-19, 1997. NMMA has offered to pay a fee in the amount of $77,200.00 for the
permit. Please note that, as has been the position of this office in prior years, the use and occupancy
of Watson Island contemplated by NMMA is addressed in Section 29-C of the City of Miami
Charter. Section 29-C provides, in pertinent part, that no revocable use permit, or license agreement
may be entered into for the occupancy or use of the area known as Watson Island unless there is
public notice and the proposed transaction is approved by a majority of the votes cast by the
electorate at a referendum.
This office will review and approve the proposed resolution as to "form and correctness".
However, please note that in accordance with the foregoing, this office cannot opine that the award
of a "park permit" for such commercial use at Watson Island is permitted under the provisions of the
City of Miami CharEer absent* compliance with the notice 'and referendum 'requirements discussed
above.
