HomeMy WebLinkAboutR-96-0839G J-96-1188 11/13/96 RESOLUTION N0 9 6 ° 8 A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF EMERGENCY CIRCUMSTANCES AND AUTHORIZING AN INCREASE IN THE CONTRACT, IN AN AMOUNT NOT TO EXCEED $16,411.13, BETWEEN THE CITY OF MIAMI, FLORIDA, AND ALPHA ENGINEERS, INC., FOR THE "CONTAMINATION REMEDIATION, N.W. 4 STREET OIL RECLAIM FACILITY PROJECT B-5579(I)"; ALLOCATING FUNDS THEREFOR AS PREVIOUSLY APPROPRIATED BY CAPITAL IMPROVEMENT PROJECT ORDINANCE NO. 11337, AS AMENDED, PROJECT NO. 311009. WHEREAS, a contract exists between the City of Miami, Florida, and Alpha Engineers, Inc., for the "Contamination Remediation, N.W. 4 Street Oil Reclaim Facility Project B- 5579(1)", with funds allocated from Capital Improvement Ordinance No. 11337, as amended, Project No. 311009; and WHEREAS, an increase in the contract not to exceed $16,411.13 is required to cover the cost of extra work required for additional environmental testing to delineate underground contamination; and WHEREAS, the Director of Public Works, the Coordinator of Capital Improvement and the City Manager recommend the increase in contract to cover the additional costs; CITY COMMISSION MEETING OF NOV 2 1 1996 Resolution No. 96- 839 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this i ISection. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission after a duly advertised public hearing, the City Manager's finding of emergency i circumstances is hereby ratified, confirmed and approved and an increase in the contract, in an amount not to exceed $16,411.13, between the City of Miami, Florida, and Alpha Engineers, Inc. for the "Contamination Remediation, NW 4 i Street Oil Reclaim Facility Project, B-557911, is hereby 1 authorized, with funds therefor hereby allocated as previously appropriated by Capital Improvement Ordinance No. 11337, as amended, Project 311009. BACKGROUND The City Commission, at its meeting of December 1, 1994, adopted Resolution NO. 94-878, authorizing a contract, under CIP Project No. 311009, with Alpha Engineers, Inc., for the removal of one (1) 18,000 gallon underground waste oil tank, delineation of underground contamination and submittal of required reports to Dade County Department of Environmental Resources Management (DERM) and/or Florida Department of Environmental Protection (FDEP)., for the sum of $130,667.00. The contract amount included a construction contingency (i.e., cash allowance): The contingency monies have been exhausted and additional funds are needed to pay for the required additional environmental testing. Funds are available in the Capital Improvement Appropriation ordinance, Project No. 311009.
