AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S FINDING OF EMERGENCY
CIRCUMSTANCES AND AUTHORIZING AN INCREASE IN
THE CONTRACT DATED MARCH 28, 1995, IN AN
AMOUNT NOT TO EXCEED $37,033, BETWEEN THE
CITY OF MIAMI, AND W.P. AUSTIN CONSTRUCTION
CORPORATION FOR THE MIAMI POLICE HEADQUARTERS
3RD AND 4TH FLOOR ADDITIONS PROJECT, B-2920-
A; ALLOCATING FUNDS THEREFOR AS PREVIOUSLY
APPROPRIATED BY ORDINANCE NO. 11337, AS
AMENDED, FROM CAPITAL IMPROVEMENT PROJECT
NO. 312029.
WHEREAS, on March 28, 1995, the City of Miami and W.P.
Austin Construction Corporation, entered into a contract for
the Miami Police Headquarters 3rd and 4th Floor Additions
Project, B-2920-A, Capital Improvement Project No. 312029; and
WHEREAS, an increase in the contract, in an amount not to
exceed $37,033 was required to cover costs associated with
extra conduit, computer and phone outlets, window glazing,
additional drywall and replacing existing ceiling; and
WHEREAS, based on information supplied by the Director of
Public Works and pursuant to Section 18.52.6 of the Code of
the City of Miami, as amended, the City Manager made a written
finding that emergency circumstances existed justifying the
increase in the contract and the additional work was required
to satisfy the project particulars; and

WHEREAS, the funds for said increase will be allocated
from funds appropriated by Capital Improvements Ordinance
No. 11337, Project No. 312029 for the Miami Police
Headquarters 3rd and & 4th Floor Additions, Project, B-2920-A;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote
of the members of the City Commission after a duly advertised
public hearing, the City Manager's finding of emergency
circumstances is hereby ratified, confirmed and approved and
an increase in the contract, in an amount not to exceed
$37,033, between the City of Miami, Florida, and W.P. Austin
Construction Corporation dated March 28, 1995, for the Miami
Police Headquarters 3rd and 4th Floor Additions, Project
B-2920-A, is hereby authorized, with funds therefor hereby
allocated as previously appropriated by Capital Improvement
Ordinance No. 11337, as amended, Project 312029.
Section 3. This Resolution shall become
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution, after a
duly advertised public hearing; ratifying, approving and confirming the City Manager's finding of
emergency circumstances resulting in an increase in the amount of $37,033, from $261,461 to
$298,494 in the contract with W.P. Austin Construction Corporation, whose sole owner is William
Phillip Austin, President and Secretary, for the Miami Police Headquarters 3R1 & 41" Floor
Additions Project B-2920-A.

BACKGROUND:
On March 28, 1995, after a formal -competitive bidding process, the City of Miami and W.P. Austin
Construction Corporation entered into a contract for the Miami Police Headquarters 3RD & 4" Floor
Additions Project B-2920-A, Capital Improvement Project No. 312029.
The Project's scope of work consist of structural plumbing, mechanical and architectural
modifications to the third and fourth floors of the Miami Police Headquarters, 400 N.W. 2 Avenue.
The work involved merging some of the existing plumbing, mechanical and electrical systems with
the proposed addition. The plans for the project were prepared by an outside consultant. During
the construction several additional adjustments and modifications were necessary to
accommodate the floor additions required. Extra work required:
1. Rerouting of conduit bank which required extra conduit, circuit for box heater change to 3-
phase from 2 pole 1-phase, and increase in wire size from #12 to #10 AWG, change required
by the consultant.
2. Additional computer outlets, circuits, phone outlets, and conduit were installed on the fourth
floor, required by the Police Department.

3. Change in windows glazing as required by the Building Department.
4. The furring installation of drywall, taping, floating and painting of (3) walls on the fourth floor
and (2) walls on the third floor, required by the Police Department,
5. Replace 5/8" gypsum wall board in lieu of %2' with 16 gauge metal studs and tracks as
required by the Building Department and spray (2) additional beams with fireproofing.
6. Remove existing ceiling in corridors A, B and C on fourth floor to electrical conduit, and
replace with USG white firerated DXL grid and USG frost tile #415 for 3,136 sq. ft. plus cost of
dumpster and cleanup, required by the Police Department.
7. Additional duct work for unit connection due to relocation of air handler unit in fourth floor
mechanical room, required by the Consultant.
8. Settle contractor delay claims due to resolution of shutters requirements and selection of
exterior tile.
Consequently, based on the above information provided by the Department of Public Works and
pursuant to Section 18.52.6 of the City Code, the City Manager made a written finding that
emergency circumstances existed justifying the increase in the contract and the additional work in
order to safeguard the welfare of the City by bringing the Project to meet the requirements of the
South Florida Building Code. To keep the work proceeding as scheduled, in October, 1995
$25,000 was made available pursuant to the emergency provisions by the City Manager. This was
done to maintain the planned move of Fire Department Central Communications from the old
Administration Building to the Police Headquarters Building.
Finally, it is respectfully recommended that the City Commission adopt the attached Resolution in
its entirety, ratifying, approving and confirming the City Manager's finding of emergency
circumstances justifying an increase in the contract with W.P. Austin Construction Corporation.

Based on information supplied to me by the Director of the Department, of Public Works
and pursuant to Section 18.52.6 of the City Code, I have found that an EMERGENCY
exists justifying an increase in the contract for additional work for the Miami Police
Headquarters Third and Fourth Floor Addition Project, B-2920A.
The reason for the emergency need and subsequent authorization for the work is as
follows:
Miami Police Headquarters Third and Fourth Floor Addition Project, B-2920A, was
awarded to W.P. Austin Construction Corporation in the amount of $261,461.00 by the
City Commission on March 28, 1995. The project consists of structural, plumbing, and
architectural modifications to the third and fourth floors of the Miami Police
Headquarters, 400 N.W. 2nd Avenue.
During the construction, the following unexpected items occurred and extra work was
required: 11
1. Rerouting of conduit bank which required extra conduit, circuit for box

The aforementioned items resulted in an increase of $25,000. Funds for these
additional costs are available in Capital Improvement Project No. 312029.
