A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
PLAT ENTITLED-BUENA VISTA ELEMENTARY SCHOOL,
A SUBDIVISION IN THE CITY OF MIAMI, SUBJECT
TO ALL OF THE CONDITIONS OF THE PLAT AND
STREET COMMITTEE, AND ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT; AUTHORIZING
AND DIRECTING THE CITY MANAGER AND CITY CLERK
TO EXECUTE THE PLAT; AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends
the acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled BUENA VISTA ELEMENTARY
SCHOOL, is a resubdivision of the lands described in
Attachment 1, attached hereto, which plat by reference is made
a part hereof as if fully incorporated herein, and, subject to
all of the conditions required by the Plat and Street
Committee as set forth as Exhibit "A" attached hereto is
hereby accepted. The dedications shown on the plat together
with the dedications to the perpetual use of the public of all
existing and future planting, trees and shrubbery on said
property, are also hereby accepted and confirmed by the City
of Miami, Florida.

BUENA VISTA ELEMENTARY SCHOOL - TENTATIVE PLAT #1469
The City of Miami Plat and Street Committee, at its meeting of
December 8, 1994, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
- Lots 18-23, Block 10 are not labeled correctly.
- Lot 22, Block 13 is not labeled correctly.
- Lot 1, Block 17 is not labeled correctly.
- 25-foot corner radii will be required for dedication
along N.W. 5 Avenue.
- N.W. 3 Avenue must remain as an emergency access
easement.
- A 12-inch water main extension along N.W. 30 Street
from N.W. 5 Avenue to N.W. 3 Avenue will be required.
A minimum 12-foot easement will be required for the
existing 8-inch water main in N.W. 3 Avenue.
- Miami Fire, Rescue and Inspections Services Department
requires the installation of three (3) new fire
hydrants.
- Include all zoning designations in the location map.
- Surveyor's Note No. 2 include the following: As per
City of Miami Zoning Ordinance 11000, as amended."

Buena vista Elementary School
- There are substantial utilities in the right of way of
N.W. 3 Avenue. Although this plat will abandon this
right of way, N.W. 3 Avenue should remain as a public
utility easement, as well, unless all utilities are to
be relocated.
- The Plat & Street Committee has reviewed the public
interest requirements set forth in Sec. 54.5.16 of the
Miami City Code for the vacation and closure of N.W. 3
Avenue and finds said vacation and closure to be in the
best interest of the public.
In addition to the above requirements, you should be aware of
the followings
1. State and local laws require the installation of various
physical improvements in the public rights -of -way when
property is platted. These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial investment
on your part.
2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be issued on the property being
platted until the final plat is recorded. Also, the
Certificate of Occupancy for any building construction will
be issued only after all the required subdivision
improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and Inspection Services Department prior
to the issuance of a building permit.
5. Additional items must be provided to the City of Miami
Department of Public Works before the final plat is
submitted to the City Commission for approval. You will be
notified in writing as to what these items are after the
amount of the bond has been determined for the necessary
subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.

REPORT OF PROPOSED RECORD PLAT OF
BUENA VISTA ELEMENTARY SCHOOL
Located on Northwest 3 Avenue and Northwest 5 Avenue between
Northwest 29 Street and Northwest 30 Street
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled BUENA VISTA ELEMENTARY SCHOOL was prepared
by Biscayne Engineering Company, Inc. It is in correct form for submission to the City Commission
and is forwarded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1) The property platted is a resubdivision of Lots 8 through 17, Block 11, and all of Block 12,
NORTHERN BOULEVARD TRACT, Plat Book 2 at Page 29, and that portion of N.W. 3
Avenue lying between the North right-of-way line of N.W. 29 Street and the South right-of-way
line of N.W. 30 Street, all lying in Section 25, Township 53 South, Range 41 East, City of
Miami, Dade County, Florida. The area platted consists of one (1) tract containing 5.45 +
acres. It is zoned C-2.
2) The location of the streets and their widths conform with the standards of the Department of
Public Works of the City of Miami, Florida.
3) As certified to by Registered Surveyor and Mapper, this Plat
complies with the plat filing laws of the State of Florida.

4) The City Zoning Board of Miami, Florida, after Public Hearing, has recommended the closing
of that portion of Northwest 3 Avenue lying between the North right-of-way line of Northwest
29 Street and the South right-of-way line of Northwest 30 Street. This action was confirmed by
City Commission Resolution No. 95-432.
5) The Certificate of Title Examination dated S�joZlerr�6er3�/y�6, signed by-,V.4,71
Attorney, indicates that the fee simple title to the property platted is correctly vested in The
School Board of Dade County, Florida, and The City of Miami, Florida, and the Plat has been
correctly executed.
6) The area platted is not encumbered by mortgages.
7) In accordance with the requirements of Chapter 54, of the Code of The City of Miami, Florida,
the bond normally required will be waived due to the fact that this is a Dade County School
Board and City of Miami plat. However, an Agreement has been executed by The School
Board of Dade County, Florida, for the construction of subdivision improvements at BUENA
VISTA ELEMENTARY SCHOOL. These improvements are listed as follows: construction of
concrete sidewalk, concrete curb and gutter, the milling and resurfacing of asphaltic concrete
! pavement, the installation of solid sod, and the removal of concrete sidewalk and concrete
curb and gutter.
8) The attached Resolution has been prepared for the acceptance of the Plat by the City
Commission of Miami, Florida.

AGREEMENT FOR CONSTRUCTION OF CERTAIN IMPROVEMENTS
WHEREAS, THE SCHOOL BOARD OF DADE COUNTY, FLORIDA (OWNER),
concurrently with the delivery of this Agreement, has applied to THE CITY OF MIAMI,
FLORIDA (CITY), for the acceptance and confirmation by the Commission of said City, of
a certain proposed plat of a subdivision to be known as Buena Vista Elementary School
located at 401 N.W. 29 Street a copy of which proposed plat is attached hereto and made
a part hereof as Exhibit "A".
WHEREAS, the execution of this Agreement by the OWNER does not waive his
immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to the OWNER'S intention
to plat and install the required improvements as set forth herein; and
WHEREAS, the completion of the improvements as set forth herein will not be
required prior to the acceptance of the plat by the City Commission.
NOW, THEREFORE, the OWNER hereby covenants and agrees with the CITY as
follows:
1. Within one (1) year from the effective date of the acceptance and confirmation
of said plat by the Commission of the City of Miami, the OWNER will construct or cause
to have constructed, at his own expense and in accordance with standard specifications of
the CITY, the following listed improvements, all as shown on the Improvement Sketch, a
copy of which is attached hereto as Exhibit "B" and made a part hereof.
Although one (1) year is allowed for the completion of the aforementioned

improvements, it is not in the public interest that such construction work should be prolonged
to the extent that it would have a disorganizing effect upon the neighborhood. After the work
is started, the OWNER hereby agrees to prosecute said work progressively so as to complete
it in a reasonable length of time as determined by the City's Department of Public Works.
2. The OWNER will fully and faithfully perform the work in accordance with the
terms of this Agreement and submit to the City's Department of Public Works a letter from
a Registered Surveyor and Mapper certifying that the Permanent Reference Monuments
indicated on the plat have been installed and properly placed.
IN WITNESS WHEREOF, the OWNER has authorized this Agreement to be
executed this 7 day of 1996.

It is respectfully recommended that the City Commission adopt a resolution accepting the plat
BUENA VISTA ELEMENTARY SCHOOL and approving recording the same in the Public Records
of Dade County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has determine that it is now in order
for acceptance by the City Commission.
The proposed record plat entitled BUENA VISTA ELEMENTARY SCHOOL is a resubdivision of
Lots 8 through 17, Block 11, and all of Block 12, NORTHERN BOULEVARD TRACT, Plat Book 2
at Page 29, and that portion of N.W. 3 Avenue lying between the North right-of-way line of N.W. 29
Street and the South right-of-way line of N.W. 30 Street, all lying in Section 25, Township 53
South, Range 41 East, City of Miami, Dade County, Florida. The area platted consists of one (1)
tract containing 5.45 + acres. It is zoned C-2.
