A RESOLUTION APPOINTING EDWARD MARQUEZ AS
CITY MANAGER OF THE CITY OF MIAMI, FLORIDA,
EFFECTIVE NOVEMBER 16, 1996, AND SETTING
FORTH THE COMPENSATION, BENEFITS AND
EMOLUMENTS TO BE RECEIVED BY EDWARD MARQUEZ
AS CITY MANAGER.
WHEREAS, the City of Miami, Florida has undertaken a
nationwide competitive search for the most qualified candidate
for the position as City Manager; and
WHEREAS, the Miami City Commission appointed EDWARD MARQUEZ
as City Manager of the City of Miami, Florida, effective
November 16, 1996; and
WHEREAS, it is the desire of the City Commission to provide
certain benefits, establish certain conditions of employment, set
forth working conditions and to provide EDWARD MARQUEZ with a
level of assurance and job security recognizing that
EDWARD MARQUEZ left a secure position elsewhere to assume the
position of City Manager;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Effective November 16, 1996, EDWARD MARQUEZ
is hereby appointed as City Manager of the City of Miami,
Florida.
Section 3. The compensation, benefits and emoluments to
be received by EDWARD MARQUEZ as City Manager are hereby set
forth as follows:
I. EDWARD MARQUEZ shall be paid an annual salary of
$139,000.00.
TT,Apn1jal Executive Benefits Package:
A. The City shall pay the sum of $13,000.00 for a
Cafeteria Plan (Deferred Compensation, Legal,
Disability and Optional Life Insurance, etc.)
B. The City shall pay a car allowance of
$6,500.00 a year.
C. The City shall pay EDWARD MARQUEZ an
Individual Retirement Account (IRA) contribution
of $1,500.00 per annum.
III, Annuity: In lieu of pension payments, the City
shall annually provide and pay for an annuity or
such other retirement vehicle selected by
EDWARD MARQUEZ at the rate of 22.24% of his base
salary. Initial payment shall be made during the
month of November, 1996. Thereafter, the annual
payment shall be made on the anniversary date of
jhis appointment (November 16, 1996).
IV. Vacation: Vacation leave shall accrue at the rate
of four (4) weeks per annum.

V. Si ck T.Pave:
Sick leave shall consist of 96 hours per year with
the first 48 hours of unused leave convertible to
additional vacation leave up to a maximum of 12.5
weeks;
VI. Health Insurance: The City shall pay the premiums
and costs associated with membership in the Cigna
Executive Health and Dental Plan commensurate with
that offered to other executives in the City of
Miami employ.
VII . T,i fe Tnsurance: The City shall provide a life
insurance policy equal to twice the amount of base
salary.
VIII . Education, Professional a1_ and Travel xp enaes : The
City shall pay for membership fees, dues and
subscriptions required for continuation and full
participation in regional, state and local
associations and organizations necessary and i
desirable for the City Manager s continued

professional participation, growth and
advancement. In addition, the City shall pay for 4
all travel expenses and reasonable costs
associated with professional and educational
meetings, seminars and workshops.

City shall provide the necessary computer, fax and
business telephone setup at the City Manager's

home including hardware and software to allow
accessibility and interfacing with the City
Manager's Office at Miami Riverside Center or
where otherwise designated.
RtaiMblirSement of Cprtain Expen_�s : The City
Manager shall be reimbursed by the City for
reasonable expenses incidental to conducting City
business.
Severance:
(A) Should dismissal by the City Commission
without cause as defined in Section D of Paragraph
XI occur prior to May 16, 1999, EDWARD MARQUEZ
shall be entitled to severance pay equal to the
base salary he would have earned if he remained in
the City employ until November 16, 1999.
(B) Should dismissal by the City Commission occur
on any date after May 16, 1999, EDWARD MARQUEZ
shall be entitled to severance pay equal to six
months of his base salary.
(C) Should the services of EDWARD MARQUEZ not be
continued beyond November 16, 1999, EDWARD MARQUEZ
shall be entitled to severance pay equal to six
months of his base salary.
(D) "For cause', shall constitute the City Manager
being convicted of any crime, including
malfeasance or misfeasance in carrying out his
official responsibilities and duties. Further, in
the event of the arrest or indictment of the City
Manager, the City Commission may suspend the
Manager with or without pay. Removal from office
shall be in accordance with Section 15 of the City
of Miami Charter which sets forth the
procedures(s) for removal from office.
Section 4. The compensation benefits and emoluments to
be received by EDWARD MARQUEZ as City Manager, and as more
particularly set forth herein, are hereby authorized.
.Section 5. This Resolution shall become effective
immediately upon its adoption.

Current Compensation (Package

I - Salary - $131,620;
11- Longevity Bonus - CuJrenty at 1.5% of Salary ($1,974);
IN - Executive benefits Package:
(A) Cafeteria Plan $10,000 (Deferred Compensation, Legal, Disability, and Optional
Life Insurance, etc.);
(B) Car Allowance $6,500;
(C) Individual Retirement Account contribution - $1,500;
(D) Free Parking or Metrorail Pass;
IV - Contributions to the Florida Retirement System (Senior Management Service Class) at
22.24 % of Base Salary;
V- Four (4) weeks of vacation;

A) 96 hours per year with first 48 hours of unused leave convertible to additional vacation
time;
0) Payout of unused sick leave at termination equal to 70% of unused sick leave.
Percentage of payout increases by 5% per year until 100% is reached;
Vii - Health Insurance for employee;
Vlll - Life insurance so at one-time annual salary;
TX - Pickup of costs related to Continuing Education requirement; and
X - Provision of computer setup for home.

Pursuant to the authority vested in me as Mayor of the City of Miami, I hereby call a
Special Meeting of the City Commission to take place at 8:00 a.m. on Tuesday,
November 5, 1996 in the City Commission Chambers, City Hall, 3500 Pan American
Drive, Miami, Florida to discuss and approve a compensation and benefits package for
the new City Manager. This is a result of Motion 96-815 directing the City Attorney to
bring back a Resolution for the terms of employment of Edward Marquez who was
appointed as City Manager for the City of Miami.
