A RESOLUTION REVERSING THE DECISION OF THE ZONING BOARD AND THEREBY DENYING A SPECIAL EXCEPTION AS LISTED IN ZONING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, O-OFFICE, TO ALLOW A FINANCIAL DRIVE -THROUGH FACILITY FOR THE PROPERTY LOCATED AT 2200 SOUTH DIXIE HIGHWAY, MIAMI, FLORIDA, ZONED O-OFFICE, SD-19 DESIGNATED FLOOR AREA RATIO OVERLAY DISTRICT AND SD-3 COCONUT GROVE MAJOR STREETS OVERLAY DISTRICT. 4 WHEREAS, the Miami Zoning Board at its meeting of March 4, 1996, Item No. 4, duly adopted Resolution No. ZB 2.5-96 by a five to zero (5-0) vote, granting a special exception as hereinafter set forth; and i WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning I Ordinance of the City of Miami, Florida, requires City Commission s approval of the special exception as hereinafter set forth; and j j S WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning s Board, finds that the application for a special exception does f not meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best CITY COMMISSION MEETING OF 0 C T 2 It 1996 y Resolution No. 96-" 0 J4 Fil interest of the general welfare of the City of Miami and its inhabitants to reverse the Zoning Board and deny the Special Exception; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: f i Section 1. The recitals and findings contained in the r Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this i Section. Section 2. The decision of the Zoning Board to grant a I f Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, 0-Office, to allow a financial drive -through facility for the I 1 property located at 2200 South Dixie Highway, Miami, Florida, legally described as Lots 17 through 25, Block C, SILVER BLUFF { I ESTATES, as recorded in Plat Book 10, at Page 65 of the Public Records of Dade County, Florida, zoned O-Office, SD-19 Designated Floor .Area Ratio Overlay District and SD-3 Coconut Grove Major Streets Overlay District, is hereby reversed and the Special Exception is hereby denied.
