HomeMy WebLinkAboutR-96-0708[A r J-96-1111 10/10/96 RESOLUTION NO. 9 6" 7 0 8 A RESOLUTION DISCLAIMING AND RENOUNCING ANY INTEREST IN A PORTION OF THAT CERTAIN UNPLATTED .ALLEY OWNED BY METROPOLITAN DADE COUNTY AND LOCATED NORTH OF AND PARALLEL TO NORTHEAST 31Sa STREET, EAST OF NORTHEAST 7TH AVENUE, MIAMI, FLORIDA; FURTHER REQUESTING THAT METROPOLITAN DADE COUNTY NO LONGER SET ASIDE AND DEDICATE SAID LAND FOR PUBLIC STREET OR PUBLIC ALLEY PURPOSES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Metropolitan Dade County is the fee simple owner of the following legally described strip of .land located within the City of Miami lying north of and parallel to Northeast 31st i Street and east of Northeast 7th Avenue, hereinafter referred to as "County -owned land": i A strip of land being 16.221, more or less, on East end and 14.901, more or less, on West end, lying between Lot 14, Block 5, ELWOOD COURT, BAY FRONT SECTION, Plat Book 16, Page 70; and Lot 9, HAINES BAY FRONT SUB., Plat Book 29, Page 55, of the Public Records of Dade County; and i WHEREAS, on or before December 10, 1946, the City of Miami, by Resolution, requested that Dade County set aside and dedicate i said strip of County -owned land for public streets or alley purposes; and WHEREAS, on December 10, 1946, pursuant to Resolution No. 2347 the Dade County Commission set aside and dedicated the ' j MSSION OF 1996 No.08 1-i n land "for public street or public alley purposes, the same to continue until further resolution of the Board"; and WHEREAS, the owner of lands abutting the County -owned land has requested that the County and the City disclaim and renounce their respective interests in the said County -owned land; and WHEREAS, on March 26, 1992, pursuant to Resolution No. 92-204, the City of Miami released all interests to the continuation of the alleyway herein described from Northeast 7th Avenue in a westerly direction to Biscayne Boulevard; and WHEREAS, the City has determined that the County -owned land is not being used for public street or public alley purposes and it is no longer in the public interest that said land be set aside for said purposes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City of Miami hereby disclaims and renounces any interest in a portion of that certain unplatted alley owned by Metropolitan Dade County and located north of and parallel to Northeast 31St Street, east of Northeast 7th Avenue, Miami, Florida, and further hereby requests that Metropolitan Dade County no longer set aside and dedicate said land for public street or public alley purposes. - 2 96- 708 A MA CITY OF MiAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : Honorable Mayor and Members DATE : SEP 3 0 1996 FILE of the City Commission SUBJECT : interest Disclaimer in Alley North of N.E. 31 Street FROM : #' REFERENCES: /6p �htja ger ENCLOSURES: Resolution, Location Map f RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution disclaiming any interest in a portion of that certain unplatted alley lying north of and parallel to N.E. 31 Street and east of N.E. 7 Avenue. BACKGROUND: A request has been made to the City• by the owner of the property located at 3117 and 3121 N.E. 7 Avenue, to disclaim any interest in a portion of a certain unplatted alley lying north of and parallel to N.E. 31 Street and east of N.E. 7 Avenue. The Department of Public Works has investigated this request and determined that the alley is not presently used by the public for street purposes. The land is actually too narrow to accommodate vehicular traffic, being only 14.9 feet in width at the westerly end. Several structures also encroach into the alley. The owner of the property at 3117 and 3121 N.E. 7 Avenue, who owns the lands adjacent to the alley on both the north and south sides, is proceeding forward with plans for development of the site and has identified this narrow strip of unplatted property running through the middle of the site which is owned in fee simple by Metropolitan Dade County. In 1946, the City of Miami requested that Dade County set aside this strip of land for public street and public alley purposes. At the request of the developer, the County has agreed to disclaim their interest in this strip of land subject to the City passing a Resolution that it no longer wishes for this land to be set aside for public alley and public street purposes. On March 26, 1992 the City Commission adopted Resolution No. 92-204 releasing all interests to the remainder to this alley between N.E. 7 Avenue and Biscayne Boulevard for the ` development of the Walgreens store. r I (—.e�i._.J L_�6__J L i c In Y N.
