HomeMy WebLinkAboutR-96-0683J-96-1030 8/26/96 RESOLUTION NO.9 6 — 683 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE MEMORANDUM OF AGREEMENT, DATED APRIL 1, 1996, WITH ECONOMIC OPPORTUNITY FAMILY HEALTH CENTER., INC., (CENTER), ALLOCATING AN ADDITIONAL AMOUNT, NOT TO EXCEED $1,200,000, FROM FISCAL YEAR '95 HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) PROGRAM FUNDING, TO PROVIDE LONG TERM, CLIENT BASED HOUSING ASSISTANCE TO ELIGIBLE PERSONS WITH HIV/AIDS OR RELATED DISEASES, SUBJECT TO CERTAIN CONDITIONS AS HEREIN SPECIFIED. WHEREAS, in March of 1995, pursuant to Resolution No. 95-179, the City Commission authorized the submittal of the 1995 - 1996 Consolidated Plan, which included the Housing Opportunities for Persons With AIDS (HOPWA) Program Plan, to the United States Department of Housing and Urban Development; and WHEREAS, in May of 1995, the City Commission appropriated the funds for the 1995 HOPWA Program by adopting Ordinance No. 11252, and, pursuant to Resolution No. 05-413, authorized the City Manager to execute amendments to the aforementioned Consolidated Plan and to execute the necessary agreements in a form acceptable to the City Attorney; and WHEREAS, in January of 1996, pursuant to Resolution No. 96-41, the City i Commission, after a duly advertised public hearing, waived conflicts of interest as applies I j to some HOPWA Advisory Board members who are eMployed by the Economic Opportunity Family Health Center, Inc., in connection with the 1995 HOPWA Program, and 4 WHEREAS, in January of 1996, through Resolut on,No. 96-44, the City Commission awarded $500,000 to Economic Opportunity Family Health Center, Inc., to provide long � i i i CITY GobDUSSION ZVOCIPING or SEP 2 6 1996 Resolution No. 96- 683 tr- client based housing assistance to very low income persons with HIV/AIDS, in connection with the 1995 HOPWA Program; and WHEREAS, in February of 1996, through Resolution No. 96-128, the City Commission awarded $1,345,000 to Economic Opportunity Family Health Center, inc., to provide long term, client based housing assistance to low income persons with HIV/AIDS, in connection with the 1995 HOPWA Program; and WHEREAS, because of the overwhelming countywide demand for long term, client based housing assistance by low income persons with HIV/AIDS, the HOPWA Advisory Board and the City Administration recommend that Economic Opportunity Family Health Center, Inc. be awarded an additional amount of fiscal year 1995 HOPWA funds, not to exceed $ 1,200,000, to provide this service; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to execute an Amendment, in a form acceptable to the City Attorney, to the Memorandum of Agreement with Economic Opportunity Family Health Center, Inc., (Center), dated April 1, 1996, thereby allocating an additional amount, not to exceed $1,200,,000, to said Center from Fiscal Year 1995 Housing Opportunities for Persons With Aids (HOPWA) Program funding. Section 3. Said increase to be used solely for the purpose of providing long term, client based housing assistance, none of which may be used by the Center for service delivery costs, nor administrative costs. Section 4. Said Amendment shalt include the provision that Economic Opportunity Family Health Center, Inc., shall not enroll any new clients in the HOPWA long term, client based housing assistance program without the express written preapproval of the City of Miami. Additionally, Economic Opportunity Family Health Center shall not enroll any new clients without the express written preappmval of the City of Miami. It is the recommendation of the HOPWA Advisory Board and the City Administration that Economic Opportunity Family Health Center, Inc. be awarded an amount not to exceed $1,200,000 from the 1995 HOPWA Program to provide long terns, client based housing assistance to very low income persons with HIVIAIDS.
