HomeMy WebLinkAboutR-96-0677J-96-590 09/18/96 RESOLUTION NO. go- 677 A RESOLUTION, WITH ATTACHMENT(S), VACATING AND CLOSING THAT PORTION OF NORTHEAST 2ND COURT, LYING BETWEEN THE SOUTH RIGHT-OF-WAY LINE OF NORTHEAST 23R.D STREET, AND THE NORTH RIGHT-OF-WAY LINE OF NORTHEAST 22ND STREET, FOR A DISTANCE OF APPROXIMATELY 319.94'; AND ALL OF THE 10 FOOT ALLEYS CONTAINED WITHIN BLOCK 10 AND THE REMAINING PORTION OF BLOCK 14 OF EDGEWATER, AS SET FORTH IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF, SAID ACTION BEING A CONDITION OF APPROVAL OF TENTATIVE PLAT #1411-B "TERRANOVA BISCAYNE" FOR THE PROPERTY LOCATED AT APPROXIMATELY BISCAYNE BOULEVARD, NORTHEAST 2ND AVENUE, NORTHEAST 22ND AND 23RD STREETS. WHEREAS, the Miami Zoning Board at its meeting of June 17, 1996, Item No. 3, duly adopted Resolution No. ZB 66-96 by a six to three (6-3) vote, thus constituting a recommendation of DENIAL; and WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants, notwithstanding the recommendation of the Zoning Board, to grant the vacation and closure of that portion of Northeast 2nd Court, lying between the south right-of-way line of Northeast 23rd Street and the north right-of-way line of Northeast 22nd Street, and all of the 10 foot alleys contained within Block 10 and the remaining portion of Block 14 of EDGEWATER, Plat Book 2 at Page 31 and being more particularly described on the attached Exhibit "A", and deemia it advisable to do so; 'ATTACHMENT (S) CONTAINED CITY COMMISSION MEETING OF SEP 2 6 1995 Readutirn No. 9 6 - 677 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Those portions described in Exhibit "A" attached hereto and made a part hereof, as a condition of approval of Tentative Plat #1411--B "TERRANOVA BISCAYNE" for the property located at approximately Biscayne Boulevard, Northeast 2nd Avenue, Northeast 22nd Street and 23rd Street, legally described in Exhibit "B" attached hereto and made a part hereof, are hereby closed, vacated, abandoned and discontinued for public use, said closure, vacation, abandonment and discontinuance being a condition for the approval of Tentative Plat: No. 1411--B, "TERRANOVA BISCAYNE". L Street and the alleys contained within these blocks and determined that the closure of these ,rights of way will not adversely affect traffic circulation or access for public service vehicles such as trash ,and garbage trucks, fire, police and/or other emergency vehicles. OTX. 2" court currently ends at N.F. 22'd Street and is not part of the critical pedestrian and vehicular transportation nct*ork for the neighborhood. The Plat and Street Committee has reviewed the tentative plat of Terranova.
