HomeMy WebLinkAboutR-96-0656J-96-1009 08/23/96 RESOLUTION NO. 9 6 r 6 J 6 A RESOLUTION, WITH ATTACHMENT, APPROVING, IN PRINCIPLE, THE COINERSION OF A PORTION OF ANTONIO MACEO PARK WITHIN THE CITY OF MIAMI, FLORIDA., FROM RECREATIONAL USE ONLY TO PUBLIC RIGHT-OF-WAY; AND AUrAORIZING THE CITY MANAGER TO NEGOTIATE WITH THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION AND THE UNITED STATES NATIONAL PARK SERVICE 'ME TERMS NECESSARY TO ACCOMPLISH THE CONVERSION OF SAID PARK PROPERTY; FURTHER DIRECTING THE CITY MANAGER TO PRESMU THE NEGOTIATEtD TERMS TO THE CITY COMMISSION FOR APPROVAL PRIOR TO EXECUTION AND RECORDATION OF A RIGHT-OF-WAY DEED. WHEREAS, ON July 23, 1979, the City Commission adopted a Resolution authorizing the acquisition of approximately 3.4 acres of land for, a park, named Pmtonio Maceo Park., on the southern shoreline of Tatmiami Canal to provide Miami residents with boat access to Blue Lagoon; and WHLRFA:S, an access road has been developed by the City of Miami on the easterly side of Antonio Maceo Park to provide boat access for the general public; and. WHEREAS, the City of Miami. has received a, request, from a property owner, abutting the east side of Antonio Mac:eo F'ark for ingress and egress to private property from the access road within the park; and OTY Ty LFATT if E NT 7OLa"jG-I�SFI As 4 WHEREAS, the City of Miami desires to provide access to private property by converting a portion of the park from, recreational purposes only to public right-of-way; and WHEREAS, Antonio Maceo Paris was purchased with the use of Federal Land and Water Conservation Funds and said conversion of a portion of the park from recreational purposes only to public might -of -way is subject to conditions imposed by the State of Florida Department of Environmental Protection and the United States National, Park Service; and MIEREM, the City Commission finds that the herein conversion of a portion of Antonio Maceo park is in the best interest of the public; WHEREAS, a legal description shall be prepared upon authorization by the City cotmnissi.on to proceed with negotiations with State cuid Federal officials. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this section. Section 2. The conversion of a portion of Antonio Maceo Park within the City of Miami, Florida, as described on the attached legal description, from, recreational use only to public right -of - way its hereby approved, in principle. Section 3. The City Manager is hereby authorized to negotiate the terttis necessary to accomplish said conversion of -2- 96- 656 park property with the State of Florida Department of Environmental Protection and the United States National Park Service. Section 4. Immediately following the conclusion of they aforedescribed negotiations, the City Manager is directed to present the negotiated teznw for said, conversion to the City Commission for its approval prior to they execution and recordation of a right-of-way deed.
