UNITY OF TITLR AS A nounwrviT FoR Tm RECORMTION OF 'THR PLAT OF NEW ORANGR BOWL SUBDIVISION; AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECtrM THE UNITY OF TITLE; AND PROVIDING FOR THE RBCORDATION' OF SAID UNITY OF TITLE IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. RRA5, the City Plat and Street Comittee approved the plat of NEW ORANGE BOWL SUBDIVISION on September 1, 1994; aged WHERR-AS, the City Coamission passed and adopted Resolution No. 95-505, dated July 13, 1995, accepting the plat of NEW ORANGE BOWL SUBDIVISION and authorizing and directing the City Manager and City Clerk to execute the said plat and to cause it to be recorded in the Public Records of made County, Florida; and WHEREAS, on Aprils. 11, 1996, the City Department of Public: Works forwarded the plat of NEW ORANGE BOWL SUBDIVISION to the Metropolitan bade County Subdivision Control Office for review and recordation; ,and VERBS, the said Metropolitan Dade Counter Subdivision Control Office is requiring the City of Miami. to execute and record a Unity of Title in the Public Records of Dade County, Florida,,,, because the plat of NEW ORANGE FOWL SUBDIVISION will create Landlocked. parcels of :sand upon its recordation; and ,ATTACHMVI ` CONTAINED CO SSION CMG or SEP12IM Ad$Wutiau No. 2 �r lwwnq®�w/�e..n•uNo.r�wr�s�.�r„ WHRREAS, upon the Unity of Title's execution by the City Manager and city Clerk and its subsequent recordation in the Public Rer rds of Dade County, Florida, the properties described in the F IBIT "A" of the Unity of Title, and also described on the attached ATTA(300= 1, will be considered one plot and parcel of land; and 'W'HBRRU, the properties described in the EXHIBIT "A" of the Unity of Title, and also described on the attached ATTALIDGM 1, will remain as one plot and parcel of land u Atil such time as the Unity of ' Title is released in writing by the Director of the Public Works Department of the City of Miami., Florida, or the executive officer or the successor of such Department, or in the absence of such director or executive officer, by his assistant in charade of the office in his absence. However, such release shall not be executed until the premises are made to conforms with applicable zoning regulations or use or the derange Bowl Stadium structure is removed from the premises and there is no further mason to maintain the Unity of Title on the public records; and WHEREAS, the City Department of Public Worms recommends the acceptance of the Unity of Title; NOW, THmEFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adapted by reference 96- 621 M thereto and incorporated herein as if fully set forth in this Section. Section 2,. The City Manager and City Clerk are hereby authorized and directed to execute a unity of Title in conjunction with the plat of New Orange Bowl Subdivision and to cause the sate to he recorded in the Public Records of Dade County, Florida. Section 3. This Resolution shall. become effective immediately upon its adoption. BACKGROUND: The Department cif Law has reviewed this Unity of Title, and it has advised the Department of Public Works that the Unity of Title is now in order for acceptance by the City Commission. On July 13,. 1995, the City Commission passed and adopted Resolution No. 95-505 accepting the plat of NEW ORANGE BOWL SUBDIVISION and authorizing and directing the City Manager and City Clerk to execute the said plat and to cause it to be {� recorded in the Public Records of Dade County, Florida; and on April 11, 1996, the City Department of Public. Works forwarded. the plat of NEW ORANGE BOWL SUBDIVISION to the Dade County Subdivision Control Office for review and recordation. Upon reviewing the plat of NEW ORANGE BOWL SUBDIVISION, the Dade County Subdivision Control Office is requiring the City of Miami to execute and record a Una.ty of Title in the Public Records of Dade County, Florida, because the said plat will create landlocked parcels of land when it is recorded,.
