HomeMy WebLinkAboutR-96-0573J-96-664 7/17/96 RESOLUTION NO. 95- 573 A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDINGS THAT A VALID EMERGENCY EXISTS FOR THE PURCHASE AND INSTALLATION OF AN AIR CONDITIONING SYSTEM FOR PEOPLE UNITED TO LEAD THE STRUGGLE FOR EQUALITY, INC. (PULSE), LOCATED ON CITY -OWNED PROPERTY AT 150 NORTHEAST 19TH STREET, MIAMI, FLORIDA, AT A TOTAL COST NOT TO EXCEED $10,000.00; WAIVING COMPETITIVE BIDDING PROCEDURES; AND AUTHORIZING THE CITY MANAGER TO SOLICIT QUOTES FOR SAID PURCHASE AND INSTALLATION AND TO AWARD A CONTRACT TO THE MOST RESPONSIVE AND RESPONSIBLE VENDOR, AS DEEMED APPROPRIATE; ALLOCATING FUNDS THEREFOR IN THE AMOUNT OF $10,000.00 FROM ACCOUNT NUMBER 921201-840 FOR SAID PURPOSE. WHEREAS, on March 15, 1996, the City executed a Revocable License Agreement with People United to Lead the Struggle for Equality, Inc. (PULSE) for City -owned property located at 150 Northeast 191h Street, Miami, Florida, for the purpose of educating the public about the needs of low to moderate income people in the community in order to enhance the economic and social status of Black citizens in our community; and WHEREAS, the air conditioning equipment at 150 Northeast 19th Street was vandalized prior to execution of the Revocable License Agreement with PULSE and the City CITY COMMISSIOI3 MEETING OF J U L 2 5 1996 Resolution No. _96 - 573 Manager agreed to replace the missing air conditioning equipment; and WHEREAS, the City Manager has determined that the immediate purchase and installation of an air conditioning system for said City -owned property is an emergency due to the need to protect the health, safety and welfare of the citizens of Miami who visit the office of PULSE; and WHEREAS, the City Manager will solicit various firms for quotes to determine the most responsive and responsible firm to provide said services; and WHEREAS, funds are available in the amount of $10,000.00 from Account Number 921201-840 for said services. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, the City Manager's findings 2 96- 573 that a valid public emergency exists for the purchase and installation of an air conditioning system and related components for PULSE, located at 150 Northeast 19th Street, Miami, Florida, at a total cost not to exceed $10,000.00 is hereby ratified, approved and confirmed, and competitive bidding procedures for said acquisition are hereby waived. Section 3. The City Manager is hereby authorized' to solicit for quotes, and award a contract to the most responsive and responsible firm for said acquisition and installation, as deemed appropriate, with funds therefor hereby allocated from Account Number 921201-840. Section 4. This Resolution shall become effective immediately upon its adoption. FILE SUBJECTRatification of Manager's Findings of Emergency FROM : Cesar REFERENCES: City r For July 25, 1996 ENCLOSURES: Commission Meeting RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution, by a 4/5ths affirmative vote of the members of the City Commission, to ratify, approve and confirm the City Manager's findings that a valid emergency exists for the purchase and installation of an air conditioning system, for People United to Lead the Struggle for Equality, Inc. (PULSE), located on City -owned property at 150 Northeast 19th Street, at a total cost not to exceed $10,000.00, and waive competitive bidding procedures and authorize the City Manager to solicit quotes for said purchase and installation, and award a contract to the most responsive and responsible vendor, as deemed appropriate. Funds in an amount not to exceed $10,000.00 are available from Account Number 921201-840 for said purpose. BACKGROUND: On March 15, 1996, the City executed a Revocable License Agreement with PULSE, for the City -owned property located at 150 Northeast 19th Street, Miami, Florida, for the purpose of educating the public about the needs of low to moderate income people in the community in order to enhance the economic and social status of Black citizens in our community. The City Manager agreed to replace the air conditioning equipment at the property, which was vandalized prior to the execution of the Revocable License Agreement. An emergency situation currently exists as PULSE is occupying the property and air conditioning is a necessity in the summer months for the protection of the health, safety and welfare of the citizens of Miami who visit the PULSE office. 96-- 573 1
