A RESOLUTION RESCINDING RESOLUTION NO. 96-61, ADOPTED JANUARY 25, 1996, IN ITS ENTIRETY AND SUBSTITUTING IN LIEU THEREOF THE HEREIN RESOLUTION AUTHORIZING THE CITY MANAGER TO NULLIFY THE CONTRACT BETWEEN THE CITY OF MIAMI AND W. P. AUSTIN CONSTRUCTION CORPORATION FOR THE PROJECT ENTITLED: MIAMI POLICE DEPARTMENT HEADQUARTERS BUILDING CONCRETE REPAIRS AND EXTERIOR RESTORATIONS, A, B AND C, B-6248. WHEREAS, sealed bids were received December 5, 1995, for the project entitled Miami Police Department Headquarters Building Concrete Repairs and Exterior Restorations, A, B and C, B-6248; and WHEREAS, on January 25, 1996, the City Commission adopted Resolution No. 96-61 accepting the bid of W. P. Austin Construction Corporation and authorizing the City Manager to execute a contract with said firm for the Miami Police Department Headquarters Building Concrete Repairs and Exteriors Restorations, A, B and C, B-6248; and WHEREAS, during the award process and, in violation of the City's Instructions to Bidders, W. P. Austin Construction Corporation failed to execute the construction contract presented by the City as approved by the City Commission; and t7n Com mssioN MEETING OF J U L 2 5 1996 Resolution No. 96- 569 t -- jl WHEREAS, the City Manager has determined that it is in the best interest of the City of Miami to reject all bids received for the Miami Police Department Headquarters Building Concrete Repairs and Exterior Restorations, A, B and C, B-6248, and that the project be re -bid; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 96-61, adopted on January 25, 1996, is hereby rescinded in its entirety. Section 3. The City Manager is hereby authorized to nullify the contract between the City of Miami and W. P. Austin Construction Corporation for the project entitled: "Miami Police Department Headquarters Building Concrete Repairs and Exterior Restorations, A, B and C, B-6248." Section 4. A, B, SL C Cesa B-6248 City*ager ENCLOSURES: Resolution RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution rescinding Resolution No. 96-61 and authorizing the City Manager to nullify the contract between the City of Miami and W. P. Austin Construction Corp. for the Miami Police Department Headquarters Building (M.P.D.) Concrete Repairs and Exterior Restorations, A, B, & C, B-6248 for failure to execute a contract in violation of the Instructions to Bidders. All other bids received exceeded the budget, therefore, the project must be re -bid in order to remain within budget. BACKGROUND: On December 5, 1995 at 10:30 a.m., the Clerk of the City of Miami received and publicly opened and read sealed bids for Miami Police Department Headquarters Building Concrete Repairs and Exterior Restorations, A, B, & C, B-6248. W. P. Austin Corporation submitted the lowest bid, and, based on the proposal and corporate documentation submitted with the bidding package, the City Commission adopted Resolution No. 96-61 on January 25, 1996 accepting the bid submitted by that firm and authorizing the City Manager to execute a contract, in a form acceptable to the City Attorney, with W. P. Austin Construction Corporation. Subsequent to the Commission's authorization to award a construction contract, the Department of Public Works prepared the contract and presented it to the W. P. Austin Construction Corp. for execution. The W. P. Austin Construction Corporation never executed the contract in accordance with their bid and in violation of the requirements in the City's Instructions to Bidders. Due to this failure to execute a contract, it is respectfully recommended that the City Commission adopt the attached resolution rescinding awarding Resolution No. 96-61 and authorizing the City Manager to nullify the contract between the City and W. P. Austin Construction Corporation for the Miami Police Department Headquarters Building Concrete Repairs and Exterior Restorations, A, B, & C, B-6248. If bidders wish, a set of plans and specifications will be mailed to them by writing to the Department of Public Works and including a separate check for $8. Deposits will be refunded only upon the return of one set of plans and specifications to the Department of Public Works, unmarked and in good condition within two (2) weeks after the opening of the bids. Bidders are alerted to the provisions of Ordinances No. 10062 as amended, regarding allocation of contracts to minority vendors, contractors and subcontractors. The City of Miami has adopted Ordinance No. 10032, which implements the "First Source Hiring Agreements.
