HomeMy WebLinkAboutR-96-0530A J-96-577 6/26/96 RESOLUTION NO. 9 6- 530 A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, j APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE PURCHASE OF A WATER HEATER FOR THE POLICE ADMINISTRATION BUILDING FROM KEN CLARY & COMPANY, A NON -MINORITY, NON/LOCAL VENDOR IN THE AMOUNT OF $5,523.04;. ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT OF POLICE FY' 95-96 OPERATING BUDGET, ACCOUNT CODE NO. 290201-850. , WHEREAS, the hot water heater to the locker facilities within the Police Administration Building was broken and not repairable; and WHEREAS, without the water heater, officers are unable to shower and OSHA regulations require the provision of shower facilities in case of possible contamination to the personnel; and WHEREAS, due to the inability to provide adequate hot water for this purpose the water heater had to be replaced on an emergency basis; and WHEREAS, the City Manager waived the requirements for the formal competitive bidding process and used informal quotes; and WHEREAS, the replacement of the water heater was accomplished by Ken Clary & Company a non-minority/non-local vendor; CITY COMMISSION MEETING OF J U L 1 1 1996 Resolution No. 90- 530 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAM1, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, ratifying, approving and confirming the City Manager's finding that a valid emergency need existed, waiving the requirements for competitive sealed bids, and accepting the informal bid of Ken Clary & Company for the replacement of the water heater at the Police Administration Building, in the amount of $5,523.04, for the Department of Police, with funds therefor hereby allocated from the Department of Police Account Code No. 290201-850. BACKGROUND: The hot water heater, which supplies hot water to the locker facilities within the Police Administration Building, was broken and not repairable. Without this water heater, officers are unable to shower. OSHA regulations require that we provide shower facilities, in case of possible contamination, to any of our employees. Warshaw REFERENCES : Water Heater Chief of Police ENCLOSURES: The Police Department is in immediate need of a new water heater. The hot water heater, which supplies the locker facilities within the Police Administration Building, is broken and not repairable. Without the water heater, personnel are unable to shower. OSHA regulations require that we provide shower facilities, in the event of contamination, to our personnel. The Department has located a supplier, Ken Clary & Company, who can supply a suitable replacement. The water heater is manufactured by PVI, model # 270 N 125 A-E 480 volt, 3 phase and costs $5,523.00. Due to our inability to meet OSHA requirements and the delay inherent in the bidding process, I am requesting your authorization for the emergency purchase of this water heater.
