(THE "ASSOCIATION') TO INSTALL AN IDENTIFICATION SIGN FOR THE HUGHES COVE SUBDIVISION WITHIN THE DEDICATED PUBLIC STREET RIGHT-OF-WAY ON THE NORTHERLY SIDE OF DEVON ROAD EAST OF MAIN HIGHWAY, MIAMI, FLORIDA, SAID APPROVAL CONTINGENT UPON THE i ASSOCIATION (1) ASSUMING ALL COSTS FOR THE DESIGN, MANUFACTURE, INSTALLATION, MAINTENANCE, AND RELATED INCIDENTAL EXPENSES FOR SAID SIGN; AND (2) EXECUTING A COVENANT RUNNING WITH THE LAND, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. } WHEREAS, Hughes Cove Owners Association, Inc. (the "Association"), a not -for -profit Florida Corporation, is the owner of all common areas in the Hughes Cove Planned Development i located within Tract "A" of Hughes Cove, according to the plat I thereof, as recorded in Plat Book 144 at Page 75 of the Public Records of Dade County, Florida; and WHEREAS, the Association has requested permission from the City to install a free-standing sign identifying the Hughes Cove Subdivision within the dedicated public: street right-of-way on the northerly side of Devon Road east of Main Highway, Miami, Florida; and WHEREAS, the City of Miami is responsible for the maintenance of the public street right-of-way on Devon Road; and (ATTACHMENT (S)� CONTAINED 1 CITY COMMISSjobf MEETING of J U t 1 1 1996 Resolution No. 96- 52'7 WHEREAS, the Association agrees to execute a written agreement, in a form acceptable to the City Attorney, assuming complete responsibility for the design, manufacture, installation and maintenance of the sign, subject to the requirements of the Director of the Department of Public Works; and WHEREAS, the City Commission finds that the herein identification sign will assist the public in locating the Hughes Cove Subdivision; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The request of Hughes Cove Owners Association, Inc. (the "Association") to install an identification sign for the Hughes Cove Subdivision within the dedicated public street right-of-way on the northerly side of Devon Road east of Main Highway, Miami, Florida, in substantial compliance with the conceptual sketch attached hereto and made a part hereto as "Exhibit All, is hereby approved!' contingent upon the Association (1) assuming all costs for the design, manufacture, installation, maintenance, and related incidental expenses for said sign; and (2) executing a Covenant Running With i� The herein approval is further subject to compliance with all requirements that may be imposed by the City Attorney as prescribed by applicable City Code provisions. - 2 - 9s_ '59 the Land, in a form acceptable to the City Attorney, for said i purpose. BACKGROUND On November 23, 1993, the Plat of Hughes Cove was approved by the Miami City Commission with the adoption of Resolution No. 93-727. Subsequently, a development of a planned unit nature (PUN) was also approved by the Miami City Commission for the same site, identifying 25 separate units for development. The project is located at the easterly dead end of Devon Road and is not readily seen from the main thoroughfare of Main Highway, presenting a problem for visitors and deliveries. The Hughes Cove Owners Association, Inc. is the owner of the common areas in the Hughes Cove Subdivision and PUN at Hughes Cove, and is requesting that the City of Miami approve the installation of an identification sign for Hughes Cove Subdivision on the north side of Devon Road east of Main Highway. The Association has indicated that it is willing to execute a covenant assuming installation and maintenance responsibility and indemnification for the City. 9 6 - 52-1
