A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE; WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND
APPROVING THE ENGAGEMENT OF MOTOROLA, INC.
FOR THE RELOCATION OF THE CITY'S 6 GHZ
MICROWAVE SYSTEM AT A PROPOSED COST OF
$174,510.00 FOR THE DEPARTMENT OF GENERAL
SERVICES ADMINISTRATION/COMMUNICATIONS
DIVISION; ALLOCATING FUNDS THEREFOR FROM THE
CAPITAL IMPROVEMENT PROGRAM, ACCOUNT CODE
NO. 429402-340, PROJECT NO. 311018; AUTHORIZING
THE CITY MANAGER TO INSTRUCT THE CHIEF
PROCUREMENT OFFICER TO ISSUE A PURCHASE
ORDER FOR THIS SERVICE.
WHEREAS, the Department of General Services
Administration/Communications Division needs to relocate its 6 GHz microwave
system and equipment from its present location within the Hickman Administration
Building that was leased to Dade County, Florida; and
WHEREAS, this relocation can be done only by Motorola, Inc. in order to
preserve the quality and reliability of the operation, as all written documentation
concerning this technology is proprietary and confidential to Motorola, Inc.; and

WHEREAS, said funds are available from the Capital Improvement Program,
Account Code No. 429402-340, Project No. 3110181; and
WHEREAS, the Chief Procurement Officer has adopted a finding that
Motorola, Inc. is the sole source provider for the relocation services of the City's 6
Ghz Microwave System as requested by the Department of General Services
Administration/Communications Division; and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive formal sealed bids be waived
and the acquisition of services for the relocation of the City's 6 GHZ Microwave
System from Motorola, Inc. be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Resolution are hereby adopted by reference thereto and incorporated herein as if
fully set forth in this section.
Section 2. By a 4/5ths affirmative vote of the members of the City
Commission, after a duly advertised public hearing, ratifying, approving and
confirming the City Manager's finding that Motorola, Inc. is the sole source
provider of the services required to relocate the City's 6 GHZ Microwave System
as required by the Department of General Services Administration/Communications
Division.
Section 3. The requirement for competitive sealed bids is hereby waived
and the acquisition of relocation services from Motorola, Inc. is hereby approved,

with funds therefor hereby allocated, in a total proposed amount of $174,510.00,
from the Capital Improvement Program, Project No. 311018, Account No.
429402-340.
Section 4. The City Manager is hereby authorized to instruct the Chief
Procurement Officer to issue a purchase order for this service.
Section 5. This Resolution shall become effective immediately upon its
adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission approve
the waiving of the requirements for competitive sealed bids and
award the sole source procurement of technical services for the
relocation of the City of Miami's 6 GHz microwave system located
at the Hickman Administration Building, to Motorola, Inc., at
5580 N.W. 36th Avenue, Suite A, Ft. Lauderdale, Florida, at a
total proposed cost of $174,510.00. Funds are available from the
Capital Improvement Program, Account Code No. 429402-340, Project
Code No. 311018.
BACKGROUND:
The Department of General Services Administration and Solid
Waste, Communication Services Division, needs to relocate the
City's radio communication microwave system and associated
equipment from its present location within the Hickman
Administration Building that was leased to Dade County.
The microwave relocation is due to changes in the configuration
of the microwave system as a result of the sale of the Hickman
Administration Building and the correction of technical problems
caused by that sale.
This work is to be completed as soon as possible as we have
contractual obligation to vacate the building before September 1,
1996.

ENCLOSURES:
An investigation was conducted by the Procurement Management
staff to determine whether Motorola, Inc. a non-minority/non-
local vendor is the sole source vendor able to dismantle,
transport and rebuild the City's 6 GHz Microwave Systems, which
was exclusively designed and built by Motorola, Inc.
The relocation efforts consist of moving the system microwave
site to a new location. Motorola, Inc. is the sole manufacturer
of the existing microwave system. The engineering, original
design. and installation of the system were executed by Motorola,
and the system is proprietary to Motorola, Inc.
Accordingly, I am recommending that the requirements for
competitive bidding be waived and the above findings be approved
that Motorola, Inc. is the sole source supplier of the requested
services.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City
of Miami, Florida on , at in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of considering a waiver of the
requirements of obtaining sealed bids for the engagement of
Motorola, Inc., to provide for the relocation of the City of
Miami's 6 GHz microwave system located at the Hickman
Administration Building for the Department of General
Services/Solid Waste-9 Communication Services Division, at a total
proposed cost of $174,510.00.
Inquiries from other potential sources who feel that they might
be able to satisfy the City's requirements in the provision of

All interested persons are invited to appear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at this hearing, that person shall ensure that a
