HomeMy WebLinkAboutR-96-0502J-96-557 7/2/96 RESOLUTION NO _ 5 02 A RESOLUTION AUTHORIZING UNCLAIMED, LOST OR ABANDONED PROPERTY OR UNCLAIMED EVIDENCE ("PROPERTY"), WITH A VALUE OF $500.00 OR LESS, IN THE CUSTODY OF THE POLICE DEPARTMENT, TO BE DONATED TO CHARITABLE ORGANIZATIONS; DONATIONS OF SAID PROPERTY TO CHARITABLE ORGANIZATIONS TO BE AT THE DISCRETION AND DIRECTION OF THE CHIEF OF POLICE, ON A PER REQUEST BASIS, UPON SATISFACTION OF ALL LEGAL REQUIREMENTS, AND EXECUTION OF THE APPROPRIATE RELEASE DOCUMENTS. WHEREAS, from time to time, the Police Department receives requests frorr charitable organizations for the donation of items such as television sets, video players, etc.; and WHEREAS, the Department may have stored within the Property Bureau these types of items; and WHEREAS, there is a quantity of unclaimed lost or abandoned property anc- unclaimed evidence that would fulfill the needs of these organizations; and WHEREAS, Chapter 705, Florida Statutes (1995), Sections 705.103 (2)(b)(1) ant 705.105 (1)(a)(3) specifically authorizes the Police Department to donate said property tt a charitable organization; and WHEREAS, it is the intention of the City Commission that unclaimed, lost r abandoned property or unclaimed evidence, with a value of $500.00 or less be donated t charitable organizations on a per request basis; CITY Co NEETINt JUL 1 �Reesolutiioo :l- — NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Unclaimed, lost or abandoned property or unclaimed evidence (Property), with a value of $500.00 or less, in the custody of the Miami Police Department, is hereby eligible to be donated to charitable organizations pursuant to Chapter 705, Florida Statutes, (1995). Section 3. Donations of said Property to charitable organizations to be at the discretion and direction of the Chief of Police, on a per request basis, upon satisfaction of I all legal requirements, and the execution of the appropriate release documents. BACKGROUND: From time to time, the Police Department receives requests from charitable organizations seeking donations of such items as; televisions, video players, etc. The Department has numerous items within the Property Bureau that would suffice their needs. The items are either found property or evidence that has gone unclaimed. As such, they are surplus supplies and are not needed by the Department. By authorizing the Chief of Police to donate items of this nature, with a value of $500.00 or less, it would expedite receipt of the property and put the surplus articles to good use. 1 96- 502
