HomeMy WebLinkAboutR-96-0483RESOLUTION NO. 94 6 r 483 A RESOLUTION GRANTING THE APPEAL FILED BY THE CITY OF MIAMI DEPARTMENT OF COMMUNITY PLANNING AND REVITALIZATION AND THUS REVERSING THE DECISION OF THE ZONING BOARD, AND AFFIRMING DETERMINATION OF USE NO. 96-001 OF THE DIRECTOR OF THE DEPARTMENT OF COMMUNITY PLANNING AND REVITALIZATION REGARDING RIVE RMONT HOUSE, TO ALLOW A SPECIAL HOUSING PROJECT TO BE LOCATED AT 789 NORTHWEST 13TH AVENUE, ZONED R-4 MULTIFAMILY HIGH -DENSITY RESIDENTIAL. WHEREAS, the Miami Zoning Board at its regular meeting of March 4, 1996, Item No. 6, following an advertised hearing, adopted Resolution ZB 27-96 by a six to zero (6-0) vote, reversing Determination of Use No. 96-001 of the Director of the Department of Community Planning and Revitalization as hereinafter set forth; and WHEREAS, the Director of the Department of Community Planning and Revitalization of the City of Miami has taken an appeal to the City Commission from the Zoning Board's decision; and WHEREAS, the City Commission, after careful consideration of this matter, determines that there is no error on the part of the Director of the Department of Community Planning and Revitalization in issuing Determination of Use No. 96-001, and thus finds no basis for upholding the Zoning Board's decision which reversed Determination of Use No. 96-001; e" CITY COMMISSION MEETING OF JU N 2 7 1996 Resolution No. 96- 483 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The appeal by the City of Miami Department of Community Planning and Revitalization is hereby granted, the decision of the Miami Zoning Board to affirm the Determination of Use No. 96-001 of the Director of the Department of Community Planning and Revitalization regarding Rivermont House, to allow a special housing project to be located at 789 Northwest 13th Avenue, Miami, Florida, legally described as Lots 5 through 10, inclusive, RIVERMONT PARK SUBDIVISION, as recorded in Plat Book 4, at Page 46 and Lots 7 through 10, inclusive, GLENSIDE SUBDIVISION, as recorded in Plat Book 7, Page 142, Public Records of Dade County, Florida, zoned R-4 Multifamily High -Density Residential, is hereby reversed, and the Determination of Use No. 96-001 is hereby affirmed in its entirety.
