HomeMy WebLinkAboutR-96-0438J-95-964 4/1/96 RESOLUTION NO.9 4 3 8 A RESOLUTION AMENDING RESOLUTION NO. 95-761, ADOPTED OCTOBER 26, 1995, WHICH AUTHORIZED THE CITY MANAGER TO EXECUTE PROFESSIONAL SERVICE AGREEMENTS BETWEEN THE CITY OF MIAMI AND VARIOUS PROFESSIONAL ARCHITECTURAL AND LANDSCAPE ARCHITECTURAL FIRMS IN CONJUNCTION WITH CITY OF MIAMI PROJECTS, THEREBY CHANGING THE TERMS FOR EACH AGREEMENT FROM ONE YEAR TO TWO YEARS. WHEREAS, on October 26, 1995, the City Commission adopted Resolution No. 95-866 for the provision of Architectural and Landscape Architectural Services for various City of Miami projects for one year terms; and WHEREAS, it has been determined that one year terms are not practical as the various projects require lengthy detailed services to be performed by the firms; and WHEREAS, it is therefore necessary to amend said Resolution,, thereby changing the terms for the individual agreements from one .� year periods to two year periods; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY J OF MIAMI, FLORIDA: CITY COMMSSXON MEETING OF J U N 1 3 1996 Resolution No. 96- 438 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 95-761, adopted October 26, 1995, is hereby amended in the following particulars:l/ M Sectip 2. The City Manager is hereby authorized- to execute five professional service agreements, in substantially the attached form, but subject to review and approval by the City Attorney, between the City of Miami and the individual firms of Bermello Ajamil & Partners, Inc., Andres Duany & Elizabeth Plater-Zyberk, Laura M. Perez & Associates, Inc., Sequeira & Gavarette, P.A., and The Architectural Design Consortium, Inc., to provide professional general architectural services, each for a ene two year period in conjunction with City of Miami projects, with funds therefor hereby allocated from the individual project accounts as appropriated for said projects. Perez Associates, Charles A. Asterisks indicate omitted and unchanged material. 96- 438 APPROVED AS TO FORM AND CORRECTNESS: j CITY OF MIAMI, FLORIDA ' INTER -OFFICE MEMORANDUM 4Q To : The Honorable Mayor and Members DATE : MAY 7 1998 FILE of the City Commission SUBJECT : Resolution to Extend the Terms of the Architectural Professional Services Agreements for Various FROM : CesaVner REFERENCES;City of Miami Projectsfrom One City ErJCLosuREs :Year to a Two Year Term RECOMMENDATION It is respectfully recommended that a resolution be adopted amending Resolution No. 95-761 adopted October 26, 1995, which authorized the City Manager to execute Professional Services Agreements between the City and various professional Architectural and Landscape Architectural firms in conjunction with City of Miami projects, thereby changing the terms for each Agreement J from one year to two years. BACKGROUND To provide professional Architectural and Landscape Architecture Services on a variety of City of Miami projects for which the City does not have sufficient professional staff, the Public Works Department conducted a formal consultant selection process to select five (5) Architectural firms and three (3) Landscape Architectural firms. A "Request for Qualifications for Professional Services" (RFQ) was issued in December of 1994. The RFQ and selection process was in accordance with the City Code and the State of Florida Consultants Competitive Negotiations Act, and had specific requirements for the utilization of City Certified MIWBE's among the firms selected to perform the architectural professional services. The selected firms were to be utilized on a rotational basis during the two (2) year period and the maximum amount of fees earned by any one firm is to be limited to $250,000. A Selection Committee, comprised of three private sector architects and four City staff members, made a recommendation for the selection of qualified firms which was approved by the City Commission at their May 1, 1995 meeting, by Resolution No. 95-320. The City Manager was authorized to negotiate a contract with each of the selected firms and submit them to the Commission for approval. At the October 25, 1995 Commission meeting, Professional Services Agreements with the selected firms were submitted for approval. A discussion took place on whether the approved firms fulfilled the City's MIBWE goals and requirements. Rather than delay the approval process, the City Commission authorized the City Manager to execute these agreements with the selected firms but reduced the term from two (2) years to one (1) year. 96— 438 Page two The Honorable Mayor and Members of the of the City Commission In making the motion to change the term to one (1) year, it was indicated that the item would have to come back to the Commission if there was any problem. One of the firms expressed their objections in a letter to the City in which they pointed out that the selection process is rather lengthy (in this case about a year), and all the firms invest considerable time and money in participating in this process. They also pointed out that the RFQ was originally for a two (2) year period and there is a concern that some of the firms could not fully participate with only one year term. In this particular selection process for Professional Architectural Services, the City's Minority/Women Business Enterprise (WIMBE) requirements were more titan met. There were one (1) black firm, two (2) female firms, and two (2) hispanic firms selected as defined in Ordinances 10062 & 10538. Unfortunately, there were no Black owned Landscape Architecture firms that are registered with the City or that responded to the RFQ. One of the other firms i selected is also hispanic owned, but exceeded the employee maximum under the City's ordinances. All of the selected firms are well qualified to provide the required architecture or landscape architectural services needed by the City. It is recommended that the City Commission reconsider the term of these Professional Services Agreements for a two year term. 2 96- 438
