HomeMy WebLinkAboutR-96-0437i t YS i� t J-96-615 . 06/13/96 RESOLUTION NO .g 43 A RESOLUTION RESCINDING RESOLUTION NO. 94-820, ADOPTED NOVEMBER 17, 1994, IN ITS ENTIRETY AND SUBSTITUTING IN LIEU THEREOF THE HEREIN RESOLUTION DECLARING MARLER AVENUE BETWEEN DOUGLAS ROAD AND PLAZA STREET, MIAMI, FLORIDA, TO BE OPENED AS A PUBLIC STREET AND FOR INGRESS AND EGRESS TO THE ADJACENT ST. HUGH OAKS DEVELOPMENT; DIRECTING THE ADMINISTRATION TO TAKE ALL ACTIONS NECESSARY TO IMPLEMENT SAID OPENING AND USE BY VEHICULAR TRAFFIC OF SUCH PORTION OF MARLER AVENUE SUBJECT TO COMPLIANCE WITH CONSTRUCTION AND ENGINEERING STANDARDS REQUIRED BY THE PUBLIC WORKS DEPARTMENT; AND AUTHORIZING THE EXPENDITURE OF FUNDS, IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND ($50,000.00) DOLLARS TO FACILITATE SAID ACTIONS. WHEREAS, the City Commission adopted Resolution No. 94-820 on November 17, 1994 temporarily restricting vehicular access to Marler Avenue at its intersection with Douglas Road in the City of Miami, Florida, subject to the provisions contained therein; and WHEREAS, the City Commission finds that such prohibition of vehicular access to Marler Avenue is no longer necessary; and WHEREAS, the City'Cgmmission further finds that ingress and 1 egress to St. Hugh Oaks via Marler Avenue is in the best interest of the public; t NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY 'i OF MIAMI, FLORIDA: ;CITY COMMISSION MEETING OF J U N 1 3 1996 Resolution No. 96- 437 k. Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this L: Section 3. Marler Avenue between Douglas Road and Plaza Street, Miami, Florida, is hereby declared to be open as a public street for vehicular traffic and ingress and egress to the adjacent St. Hugh Oaks housing development. Section 4. The City administration is hereby directed to take all actions necessary to implement said opening and use by vehicular traffic of such portion of Marler Avenue, subject to compliance with the construction and engineering standards required by the Public Works Department. Section 5. Expenditure of funds in an amount not to exceed Fifty Thousand ($50,000.00) Dollars is hereby authorized to facilitate said action. Section 6. This Resolution shall become effective of June 1996. The purpose of the June 13, 1996 discussion is to hear comments and consider a i resolution approving, in principle, the City of Miami's joining in a plat with the adjacent property owners to close and vacate a portion of Marler Avenue in Coconut Grove and authorizing the City Manager to execute the necessary documents related to the joinder of the City in the plat. 4 BACKGROUND Marler Avenue between Douglas Road and Plaza Street in South Coconut grove is an undeveloped public right of way occupied by dense vegetation. In response to concerns from property owners abutting Marler Avenue regarding unsafe conditions in the undeveloped right of way, the City Commission adopted Resolution No. 94-820 authorizing the temporary restriction of vehicular access to Marler Avenue at its intersection with Douglas Road. A condition of the Resolution 1 requires that the prohibition of vehicular access be instituted until such time as Marler Avenue is closed and vacated in accordance with the subdivision regulations contained in Chapter 54.5 of the City code. The abutting property owners now desire to begin the platting process to close and vacate Marler Avenue. In accordance with the subdivision regulations, all property owners abutting the public right of way proposed for closure and vacation are required to join in. the plat. Since the City of Miami owns property abutting the north side of Marler Avenue, the City must join in the plat in order for the process to proceed. It is respectfully recommended that the City Commission adopt the attached Resolution approving in principle the city of Miami's joining in a plat with the adjacent private property owners to close and vacate a portion of Marler Avenue and authorizing the City Manager to execute the necessary documents related to the joinder of the City in the plat. 96- 437 MUM 1111 HWG GARVIEN NiON-5 Wool.
