HomeMy WebLinkAboutR-96-0417RESOLUTION NO. 9 6 417 A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES, AND APPROVING THE CITY MANAGER'S AWARD OF CONTRACT TO VENECON, INC., TO PERFORM THE WORK REQUIRED FOR THE CAPITAL IMPROVEMENT PROJECT ENTITLED "ORANGE BOWL MODERNIZATION, PHASE III, RESTROOM IMPROVEMENTS (18) 1996, B-626211, IN AMOUNT OF $430,000.00; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 404240, AS APPROPRIATED BY CAPITAL IMPROVEMENT ORDINANCE NO. 11337, AS AMENDED, IN THE AMOUNT OF $390,000.00, AND THE ORANGE BOWL OPERATING BUDGET, ACCOUNT CODE NO. 350503-840, IN THE AMOUNT OF $40,000.00; FURTHER, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the Orange Bowl Stadium will host many of the 1996 Olympic Soccer Games; and the City of Miami received a donation of from the Miami Sports and Exhibition Authority for to eighteen (18) restrooms at the Orange Bowl Stadium which require immediate refurbishing in order to satisfy the public needs for the Olympics; and WHEREAS, the City of Miami's commitment to the Olympic Committee to have all the improvements completed in time for the Soccer Games resulted in the City Manager adopting a finding that ` said restrooms improvements constituted an emergency; and ,.CITY CONAVII38ION MEETING OF J U N 1 3 1996 Resolution No. 9 6 - 40 r i' WHEREAS, on April 18, 1996, the Department of Public Works received informal sealed bids for the Capital Improvement Project entitled "ORANGE BOWL MODERNIZATION, PHASE III, RESTROOM IMPROVEMENTS (18) 1996, B-626211, and the lowest responsible and responsive bid received was from Venecon, Inc., in the amount of $430,000.00; and WHEREAS, funds for said improvements are available from Fiscal Year 1995-1996 Capital Improvement Project No. 404240 and the Orange Bowl Operating Budget Account No. 350503-840; j NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: f� Section 1. The recitals and findings contained in the I Preamble to this Resolution are hereby adopted by reference i thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding of an emergency is hereby ratified, approved and confirmed, the requirements for competitive bidding procedures are hereby waived and the City Manager's award of contract to Venecon, Inc., to perform the work required for the Capital Improvement Project entitled "ORANGE BOWL MODERNIZATION, PHASE III, RESTROOM IMPROVEMENTS (18) 1996, B-6262" is hereby approved, with funds therefor hereby allocated from Capital Improvement Project No. 404240, as appropriated by - 2 - 96- 417 Ordinance No. 11337, as amended, in the amount of $390,000.00, and the Orange Bowl Operating Budget, Account Code No. 350503-840, in the amount of $40,000.00. Section 3. The City Manager is hereby authorized!' to execute an agreement, in a form acceptable to the City Attorney, 1 with Venecon, Inc. for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption. Because of the time restrictions imposed by the 1996 Olympic Games and the 1996 Football Season, the City Manager directed the Public Works Department to prepare plans and specifications and to receive informal bids. On April 18, 1996, the Department of Public Works received informal sealed bids for the project, and the lowest responsive and responsible bid received was from Venecon, Inc., in the amount of $430,000.00. It is now recommended that the City Commission adopt Resolution ratifying, approving and confirming the finding of the City Manager authorizing the emergency contracting for the project orange Bowl Modernization Phase III Restroom Improvements (18) 1996, B-6262 with Venecon, Inc. in the amount of $430,000.00. Odio REFERENCES: City Manager ENCLOSURES: Based on information supplied to me by the Director of the Department of Public Facilities, I have found that a valid EMERGENCY exists justifying additional work at the orange Bowl Stadium. The orange Bowl Stadium will host some of the 1996 Soccer Olympic Games and the City of Miami received a donation of $390,000.00 from the Miami Sports and Exhibition Authority for the improvement of the condition of eighteen (18) of the restrooms at the Stadium which require immediate refurbishing in order to satisfy the public needs for this kind of an event Since time is of the essence to meet the deadline date imposed by the 1996 Soccer Olympic Games, I directed the Department of Public Works to prepare plans and specifications and to receive informal bids for the improvement of the eighteen (18) restrooms at the Orange Bowl. On April 18, 1996, the Department of Public Works received informal sealed bids for the project "Orange Bowl Modernization, Ph. III, Restroom Improvements (18), Job B-6262. All interested persons are invited to appear and may be heard concerning this award. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon which any appeal may be based. f Walter J.
