HomeMy WebLinkAboutR-96-0362J-96-273(a) 04/10/96 RESOLUTION NO. t� b A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD TO DENY CARRFOUR CORPORATION'S "OBJECTIONS TO AND REQUEST FOR DISMISSAL OF PENDING APPEAL" PERTAINING TO THE DETERMINATION OF USE NO. 96-001 OF THE DIRECTOR OF THE DEPARTMENT OF COMMUNITY PLANNING AND REVITALIZATION REGARDING RIVERMONT HOUSE, TO ALLOW A SPECIAL HOUSING PROJECT TO BE LOCATED AT 789 NORTHWEST 13TH AVENUE, ZONED R-4 MULTIFAMILY HIGH -DENSITY RESIDENTIAL. i WHEREAS, the Miami Zoning Board at its regular meeting of March 4, 1996, Item No. 6, following an advertised hearing, adopted Resolution ZB 27A-96 by a six to zero (6-0) vote, denying i Carrfour Corporation's "Objections to and Request for Dismissal of Pending Appeal" as hereinafter set forth; and WHEREAS, the Carrfour Corporation has taken an appeal to the City Commission from the Zoning Board's decision denying its j i "Objections to and Request for Dismissal of Pending Appeal"; and k WHEREAS, the City Commission, after careful consideration of (, this matter, finds no basis for overturning the Zoning Board's decision; j i NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the i l CITY COMMISSION MEETING OF MAY 2 3 1996 Resolution No. Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The appeal from the decision of the Miami Zoning Board to deny Carrfour Corporation's "Objections to and Request for Dismissal of Pending Appeal" of Zoning Determination of Use No. 96-001 filed by the "Residents of Miami," to allow a special housing project to be located at 789 Northwest 13th Avenue, Miami, Florida, legally described as Lots 5 through 10, inclusive, RIVERMONT PARK SUBDIVISION, as recorded in Plat Book 4, at Page 46 and Lots 7 through 10, inclusive, GLENSIDE SUBDIVISION, as recorded in Plat Book 7, Page 142, Public Records of Dade County, Florida, zoned R-4 Multifamily High -Density Residential, is hereby denied and the decision of the Zoning Board is hereby affirmed.
