A RESOLUTION, WITH ATTACHMENT(S), ACCEPTING
THE PROPOSAL OF DR. SHELDON ZEDECK, FOR
FURNISHING CONSULTING SERVICES, TO THE
DEPARTMENT OF HUMAN RESOURCES, IN CONNECTION
WITH EXAMINATION DEVELOPMENT, ADMINISTRATION
AND VALIDITY, FOR A TWO YEAR PERIOD WITH THE
CITY'S OPTION TO EXTEND SAID SERVICE FOR TWO
(2) ADDITIONAL ONE (1) YEAR PERIODS, AT AN
ESTIMATED ANNUAL COST NOT TO EXCEED $80,000
PER YEAR; ALLOCATING FUNDS THEREFOR FROM
FISCAL YEAR 1995-1996 SPECIAL PROGRAMS AND
ACCOUNTS, ACCOUNT NO. 921128; AUTHORIZING THE
CITY MANAGER TO EXECUTE A CONTRACT, IN
SUBSTANTIALLY THE ATTACHED FORM, FOR THIS
PURPOSE.
WHEREAS, pursuant to public notice, sealed proposals were
received on March 15, 1996, for the furnishing of consulting
services fo:i examination development, administration and
validity, on a contract basis for two (2) years, with the option
to extend for additional two (2) year periods for the Department
of Human Resources; and
WHEREAS, Request for Proposals to provide the above service
were mailed to three (3) potential proposers and three (3)
proposals were received; and
WHEREAS, the proposals were evaluated and ranked by a
selection committee which recommended that the proposal received

from Dr. Sheldon Zedeck, for consulting services as requested, be
accepted as the one most advantageous to the city; and
WHEREAS, funds for this service are available from Account
No. 921128, FY '95-96 Special Programs and Accounts; and

WHEREAS, the City Manager and the Director of Human
Resources recommend that the proposal received from Dr. Sheldon
Zedeck, for consulting services as stipulated be accepted as the
one most advantageous to the city;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The proposal submitted by Dr. Sheldon Zedeck,
for furnishing consulting services to the Department of Human
Resources in connection with examination development,
administration and validity, for a two year period with the
City's option to extend said service for two (2) additional one
(1) year periods, at an annual cost not to exceed $80,000 per
year, is hereby accepted, with funds therefor hereby allocated
from Fiscal Year 1995-96 Special Programs and Accounts, Account
No. 921128.
Section 3. The City Manager is hereby authorized to
execute a contract, in substantially the attached form, with Dr.
Sheldon Zedeck for the above purpose.

PROFESSIONAL SERVICES AGREEMENT
This Agreement entered in this day of
199 by and between the City of Miami, a municipal
corporation of the State of Florida, hereinafter referred to as
"CITY," and hereinafter referred to as

II.
SCOPE OF SERVICES:
CONSULTANT Will:
A. Train City staff in job analysis, test construction, test
validation, performance assessment and implementation of
test programs with respect to Uniform Guidelines ;and other
provisions.
B. Work with City staff on job analyses for actual positions,
participate in sessions needed 'to, generate task statements
for job analysis questionnaire, edit statements, analyze
data and prepare reports.
C. Work with City staff in the development of test exercises.
D. Monitor, review and sign off on the work of City staff at
all points of test development and validation stages:

CITY shall pay CONSULTANT
CITY and CONSULTANT estimate that the amount of compensation t
for the services described in Paragraph II hereof shall be
naTmnsze—t4ian $80,000 per year.
Such compensation shall be paid on the following basis:
1. Payment shall be made monthly for work performed the
previous month upon submission of properly certified
invoices.
CITY shall have the right to review and audit the time
records and related records of CONSULTANT pertaining to any
payments by the CITY.
IV
COMPLIANCE WITH FEDERAL, STATE AND LOCAL LAWS:
Both parties shall comply with all applicablelaws,
ordinances and codes of federal, state and local.'governments.
V.
GENERAL CONDITIONS:
A. All notices or other communications which shall or may be
given pursuant to this Agreement 'shall be in writing and
shall be delivered by personal service, or by registered
mail addressed to the other party at the address indicated
herein or as the same may be changed from time to time.
Such notice shall be deemed given on the day on which
personally served; or, if by mail on the fifth day after

1 being posted or the date of actual receipt, whichever is

IX.
AWARD OF AGREEMENT:
PROVIDER warrants that it has not employed or retained any
person employed by the CITY to solicit or secure this Agreement
and that it has not offered to pay,, paid, or agreed to pay any
person employed by the CITY any fee, commission percentage;
brokerage fee, or gift of .any kind contingent upon or resulting
from the award of this Agreement.
X.
CONSTRUCTION OF AGREEMENT:
This Agreement shall be construed and enforced according to
the laws of the State of Florida

correctly sets forth the rights, duties, and obligations of each
to the other as of its _date. Any prior agreements, promises,
i negotiations, or representations not expressly set forth in this
Agreement are of no force or effect.

RECOMMENDATION
It is respectfully recommended that the City Commission
adopt a resolution to award a contract to Dr. Sheldon
Zedeck, Vice -President, CORE Corporation, Pleasant Hill
Executive Park, 391 Taylor Boulevard, Suite 110, Pleasant
Hill, CA 94523-2275, to provide examination validation
services to the Department of Human .-Resources at a proposed
first year annual cost not to exceed $80,000. ` The contract
would be for a two (2) year period with the option to renew
for two (2) additional one (1) year periods.
The Civil .Service Rules identify the Director of Human
Resources for determining the content, format, and rating of
all exams - both entry-level and promotional. The City only
has one staff member assigned full-time to work on the
average of fifteen (15) exams given a year. Appropriate
evaluations and validation of these exams requires the
services of an Industrial and Organization Psychologist with
specialized training in specific screening devices which are
appropriate for these exams, as well as experience in
incorporating these instruments with Consent Decree
requirements.
This individual must provide oversight of all exam
activities, having the specialized experience and
credentials to serve -as the City's expert witness in Federal
and Circuit Court cases. Presently, there is no one in the
department with these credentials. Since an employee of this
calibre would command an extremely high salary, hiring this
individual as a consultant on an as -needed basis is a much
better way of addressing the City's needs in a cost-
effective manner.

City Commission Examination Validation Consultants
In an effort to locate Industrial and Organization
Psychologists with the specialized expertise to represent
the City in deliberations with the Department of Justice's
psychologist in developing the new entry-level firefighter
exam as mandated by the Federal -Court as well as to oversee
other entry-level and promotional exam processes, the City
has identified three consultants with this specific
examination consulting experience and invited them to
respond. Our search revealed no Industrial and Organization
Psychologists locally or in the State of Florida with this
very specialized expertise. Responses by all three -were
received March 15, 1996.
Based on an evaluation reviewed by Angela R. Bellamy,
William Katz, and Alex Vilarello of the three proposals
received, it is jointly recommended that the contract be
awarded Dr. Sheldon Zedeck, Vice --President, CORE
Corporation, for a two (2) year period with the option to
renew for two additional one (1) year periods. Allocations
have been made from Special Programs and Accounts, Fiscal
Year 1995-96 for this service.
