HomeMy WebLinkAboutR-96-0339J-96-376 4/18/96 RESOLUTION NO.9 6 ` 3 3 9 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE PURCHASE, INSTALLATION AND REPAIR OF AIR CONDITIONING EQUIPMENT AND RELATED COMPONENTS, AT THE BELAFONTE TACOLCY CENTER, FROM CHISHOLM BROS., INC., IN A TOTAL AMOUNT OF $40,000; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 331364; AUTHORIZING THE CITY MANAGER. TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID PURPOSE. WHEREAS, pursuant to Resolution 94-860, adopted December 1, 1994, the bid of All County Air Conditioning, Inc., was accepted by the City Commission for the furnishing and installation of four air conditioning condensing units at the Belafonte Tacolcy Center (Tacolcy), located at 6161 NW 9 Avenue, Miami, Florida; and WHEREAS, following a contract dispute for this work, All County Air Conditioning removed the four units from the premises leaving several areas of the premises without air conditioning; and WHEREAS, the City is pursuing legal action against All County Air Conditioning to recover damages as a result of said removal; and CITY COM?CSSION MEETING OF MAY 2. 3 1996 Resolution Ido. t7{i` 39 WHEREAS, on December 21, 1995, the City Manager determined a valid public emergency existed and authorized the emergency purchase of four air conditioning condensing units and related work from Chisholm Brothers, Inc., in an amount not to exceed i $14,000; and I WHEREAS, following the installation of these four units, on January 21, 1996, three of the four condensing units were stolen; and WHEREAS, the City Manager determined a valid public emergency existed and authorized the emergency purchase of three air conditioning condensing units and the installation of a chain link fence cage to enclose the units; and i WHEREAS, during the weekend of March 23, 1996, vandals cut i the lock to the new chain link fence cage and stole three condensing units; and WHEREAS, these units were recovered from a nearby property I j although no suspects have been found; and WHEREAS, several areas of Tacolcy are without air conditioning and there is lack of ventilation within the premises i as the windows are fixed; and WHEREAS, it is necessary to complete the air conditioning work at the premises in order to provide for the safe operation of the day care, to comply with State HRS licensing requirements i and to avoid loss of grant funds by Tacolcy; and WHEREAS, in order to protect the health, safety and welfare of the citizens of Miami, the City Manager has found a valid 2- 96-- 339 public emergency exists justifying the waiving of formal competitive sealed bid procedures for this work; and WHEREAS, funds are available in the amount of $40,000 from the Capital Improvement Project No. 331364; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, ratifying, approving and confirming the City Manager's finding of an emergency for the purchase, installation and repair of air conditioning equipment and related components, at the Belafonte Tacolcy Center, from Chisholm Bros., Inc., in a total amount of $40,000, for the Department of Public Works, with funds therefor hereby allocated from Capital Improvement Project No. 331364 Section 3. The requirements for competitive sealed bids are hereby waived for the Department of Public Works purchase, installation and repair of air conditioning equipment and related components from Chisholm Bros., Inc. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this acquisition. Section 5. BACKGROUND: The Office of Asset Management has prepared the attached Resolution for consideration by the City Commission. Pursuant to Resolution 94-860 adopted on December 1, 1994, the City Commission accepted the bid of All County Air Conditioning, Inc. for the furnishing and installation of four air conditioning condensing units at the Belafonte Tacolcy Center ("Tacolcy"). After installation of the units, a Contract dispute arose which resulted in All County Air Conditioning removing, without permission from the City, the four units from the premises leaving several areas of the premises without air conditioning. While the City is proceeding with legal action against All County Air Conditioning, on December 21, 1995, the City Manager determined a valid public emergency to exist and authorized the replacement of the four a/c condensing units and related work from Chisholm Brothers in an amount not to exceed $14,000. Following the installation of these 4 units, on January 21, 1996, three of the four condensing units were stolen. The City Manager determined a valid public emergency to exist and authorized the furnishing and installation of three air conditioning condensing units and the installation of a chain link fence cage around the condensing units in an effort to prevent this from reoccurring. During this installation, the Building Division determined certain improvements were required for compliance with the South Florida Building Code including the installation of louver doors around the air handlers. During the weekend of March 23, 1996, vandals cut the lock to the new chain link fence cage and stole three condensing units. These three units were recovered from a nearby property although no suspects have been found. Once again Tacolcy was without air conditioning in several areas. 96- 339 The Honorable Mayor and Members of the City Commission Page 2 Police reports have been filed for both thefts. The use of the property as a day care and compliance with HRS licensing requirements made it of utmost importance to reinstall the units as if quickly as possible. In addition, the windows in the facility are fixed and consequently provideno means of ventilation. This approval was sought following a contract dispute between the City and All County Air Conditioning, which resulted in four units being removed by All County. This issue is being pursued with the Law Department to recover damages. Fallowing your approval, the units were immediately installed. I To minimize the opportunity for vandalism to occur, the City commenced procedures to install a chain link fence cage around the a/c units. Prior to completion of this work, on .January 21, 1996 three of these four units were stolen. Consequently, the City proceeded on an emergency basis to purchase and install three additional units and the furnishing and installation of a chain link fence cage. During this installation, the Building Division determined certain improvements were required for compliance with the South Florida Building Code including the installation of louver doors around the air handlers which resulted in increased costs. Subsequently, during the weekend of March 23, '1996, once again three units were stolen. Vandals cut the locks on the new chain link fence cage and removed three units. Fortunately, these units were recovered in the backyard of a property located adjacent to Tacolcy although no suspects have been found. Once again, several areas of Tacolcy are without air conditioning. Police reports have been filed for both thefts. Additionally, Tacolcy is procuring the installation of monitored security devices to be installed to the chain link fence cage.
