PARK PERMIT FOR USE OF AN AREA IN THE SOUTHERN PORTION OF WATSON ISLAND BY THE QUANTUM GROUP, INC., ("QGI") FOR THE PRESENTATION OP' A NATIVE AMERICAN FESTIVAL TO BE HELD ON A DATE PRIOR TO DECEMBER 21, 1996; AUTHORIZING THE CITY MANAGER TO DIRECT THE PARKS AND RECREATION DEPARTMENT DIRECTOR TO ISSUE THE NECESSARY PARK PERMIT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE CITY CHARTER AND CODE PROVISIONS, FOR THIS PURPOSE. i WHEREAS, Mr. Bruce Haddock of the Quantum Group, Inc. ("QGI") has requested the use of an area in the southern portion of Watson Island for a Native American Festival to be held on a date prior to December 21, 1996; and WHEREAS, the city shall designate an area on the southern portion of Watson Island to be utilized for this festival; and WHEREAS, such proposed use necessitates the establishment of special charges, terms and conditions beyond those mandated under existing City Charter and Code provisions; and WHEREAS, the QGI has agreed to pay the following additional fees and charges 30 days prior to the event: 1) a use fee of $500 per day for set up and dismantle periods; 2) the standard beer/wine permit fee of $300 per day, and 3) concession fees of $75 per booth, per day; and CITY COMMISSION MEETING OF MAY 2 3 '1996 Resolution No. F-I w . WHEREAS, should the City determine that there will be paid parking, the City and/or the Department of Off -Street Parking, will have first choice to operate it, and should the City determine not to operate the parking, the City Manager will have the authority to negotiate a fee arrangement with the promoter; and WHEREAS, QGI will additionally pay for all required and customary City services including such personnel costs as police, fire, solid waste and parks; and WHEREAS, QGI will provide appropriate insurance in a form and in amounts acceptable to the City's Risk Management Department; and WHEREAS, it is recommended that the City Manager be authorized the Parks and Recreation Department Director to issue a park permit for this purpose, in a form acceptable to the City Attorney, containing the special charges, terms and conditions detailed herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Special charges, terms and conditions, as herein specified, are hereby established for the issuance of a park permit for use of an area in the south portion of Watson Island by the QGI for the presentation of a Native American Festival to be held on a date prior to December 21, 1996. Section 3. The City Manager is hereby authorized to direct the Parks and Recreation Department Director to issue the necessary permit, in a form acceptable to the City Attorney, and in compliance with all applicable City Charter and Code provisions for this purpose.
