A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION WAIVING j FORMAL COMPETITIVE SEALED BID PROCEDURES FOR THE REPAIR AND SECURITY OF THE PARKING LOTS 16 AND 3_7 LOCATED ADJACENT TO THE CITY ADMINISTRATION BUILDING, THE "MIAMI RIVERSIDE CENTER", IN MIAMI, FLORIDA; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY EXISTS JUSTIFYING SUCH WAIVER FOR SAID SERVICES; AUTHORIZING THE CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE BID FOR SAID SERVICES AT PARKING LOTS 16 AND 17; ALLOCATING FUNDS THEREFOR FROM PROJECT j NO. 311042 AS APPROPRIATED BY THE 1995-1996 CAPITAL IMPROVEMENT ORDINANCE NO. 1.1337, AS AMENDED, IN AN AMOUNT NOT TO EXCEED $23,000.00 FOR SAID REPAIR OF THE PARKING LOTS 16 AND 17; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM I ACCEPTABLE TO THE CITY ATTORNEY, WITH THE } SUCCESSFUL BIDDER. i WHEREAS, in order to fully utilize the City's new administration building, the "Miami Riverside Center" located at 444 Southwest 2nd Avenue, Miami, Florida by March, 1996, the use of the Off -Street Parking Department's under -expressway parking lots numbers 16 and 17 (the "Parking Lots") located adjacent to said "Miami Riverside Center" is necessary to accommodate employee and city vehicle parking; and WHEREAS, the City Manager has made a finding that several problems with the Parking Lots, including surface failures, CITY CO%1T4ISSIQN MEETLVG OF MAY 2 3 1996 �] �a Rosolution No. 9 6 I .' parking stall delineation and lot security require attention prior to full occupancy of the administration building, constituting a valid public emergency; and WHEREAS, the nature of said emergency requires the immediate i repair of the Parking Lots to protect the safety and welfare of the City employees and City property; and WHEREAS, the normally required procedures and scheduling requirements for formal advertising, receipt of bids, award of contract and processing of contracts will needlessly a.ad unwisely delay the repair and security of the Parking Lots; and WHEREAS, Sections 18-52.5 and 18-52.6 of the City Code make provision for the emergency procurement of required goods and services for public works projects and improvements; and WHEREAS, the City Manager, and the Director of the Department of Public Works recommend that informal bid procedures be utilized to procure the needed services, equipment and/or materials for the restoration of the Parking Lots; and WHEREAS, after receipt of informal bids, a contract for said services, equipment and/or materials will be awarded to the lowest responsive and responsible bidder by the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference 96- 327,1 T-i thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's finding that a valid public emergency exists justifying such waiver for the repair and security of the Parking Lots is hereby ratified, approved and confirmed. Section 3. By an affirmative vote of 4/5ths of the members of the City Commission, formal competitive sealed bid procedures for the procurement of services, equipment and/or materials for the repair of the Parking Lots are hereby waived. Section 4. The City Manager is hereby authorized to 1 accept the lowest responsive and responsible bid for the I necessary repair and security of the Parking Lots. Section S. An amount not to exceed $23,000.00 is hereby allocated therefor from Project No. 311042 appropriated by the 1995-1996 Capital Improvement Ordinance No. 11337, as amended. i Section 6. The City Manager is hereby authorized to execute and/or issue the necessary documents', in a form j acceptable to the City Attorney, with the successful bidder for said repair and security of the Parking Lots. 1` The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Code and Charter provisions. BACKGROUND: In order to fully utilize the City's new administration building, the "Miami Riverside Center", the use of the Off Street Parking Department's under expressway parking lots no. 16 and 17 is necessary to accommodate employee and city vehicle parking. The Public Works Department has identified several problems with the parking lots including lot security, parking stall delineation and surface failures, that require attention prior to the full occupation of the building. The administration building is scheduled to be occupied in March, 1996. Such conditions indicate the need for extraordinary measures to protect the health, safety and welfare of the community, citizens and employees utilizing the building. In order to initiate the construction as soon as possible, the formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said emergency pursuant to Section 18- 52.5 and 18-52.6 of the City Code. Informal bids shall be obtained and a contract shall be awarded by the City Manager to the lowest responsive and qualified bidder. 96-- 327,E CITY OF MIAMI.
