A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF AN EMERGENCY, WAIVER OF THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS, AND
APPROVAL OF THE EMERGENCY CONTRACTING OF
GOODS AND SERVICES FOR SPECIALTY ITEMS, FROM
PROVIDERS AS HEREIN SPECIFIED, FOR THE
PROJECT ENTITLED "ORANGE BOWL MODERNIZATION
PHASE III, SUPERBLOCK DEVELOPMENT - SOUTH,
B-6249," IN THE TOTAL AMOUNT OF $512,304.40;
ALLOCATING FUNDS THEREFOR FROM THE CAPITAL
IMPROVEMENT PROGRAM, FISCAL YEAR 1995-1996,
PROJECT 404240, INDEX CODE NO. 319302-830;
FURTHER RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S ISSUANCE OF EMERGENCY
PURCHASE ORDERS FOR SAID PURPOSE.
WHEREAS, the City of Miami is committed to the University of
Miami to develop a "campus -like" setting for the site around the
Orange Bowl Stadium prior to the 1996 football season; and
WHEREAS, the City of Miami is committed to the Olympic
Committee, to have all the improvement work completed prior to
June 20, 1996; and
WHEREAS, based upon the conceptual design prepared by Urban
Architects, Inc., the Department of Public Works prepared the
construction plans for the phase to be built in 1996; and

WHEREAS, because of the time restrictions imposed by the
1996 Olympic Games, said project was split into two parts, with
the first part including the actual site work improvements, and
the second part including the purchase of goods and services that
are to be provided by the City to the contractor; and
WHEREAS, the City Manager directed the Public Works
Department to purchase, on an emergency basis, several specialty
items that are to be fabricated to order so they may fit the
specific requirements of the design; and
WHEREAS, the following goods and services were contracted to
the listed suppliers, on an emergency basis:

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
the City Manager's finding of an emergency, waiver of competitive
bidding procedures, and approval of the emergency purchase of
goods and services for specialty items, from providers as
specified in Section 1 hereinabove, are hereby ratified, approved
and confirmed for the Project entitled "Orange Bowl Modernization
Phase III, Superblock Development - South, B-6249," in the total
amount of $512,304.40, with funds therefor hereby allocated from
the Capital Improvement Program, Fiscal Year 1995-1996, Project
404240, Index Code No. 319302-830.
Section 3. The City Manager's issuance of emergency
purchase orders for said purpose is further ratified, approved
and confirmed.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution
ratifying, approving, and confirming the action of the City Manager and authorizing the
EMERGENCY contracting of goods and services for the project "ORANGE BOWL
MODERNIZATION, PHASE III, SUPERBLOCK DEVELOPMENT SOUTH," in the amount
of $512,304.40.
BACKGROUND
The City of Miami is committed to the University of Miami to develop a "campus -like" setting
for the site around the Orange Bowl Stadium prior to the 1996 football season and to the
Olvrnpic Committee to have all the improvement work completed prior to June 20, 1996; The
scope of work includes the demolition and site development of the Orange Bowl Stadium
(South Side), providing for new parking, new access gates, promenades, lvaltiwgys, lighting,
fencing, signage and landscaping.
Based upon the conceptual design prepared by Urban Architects Inc., the Department of Public
Works prepared the construction plans for the phase to be built in 1996.
Because of the time restrictions imposed by the 1996 Olympic Games and the 1996 Football
Season, the City Manager directed the Public Works Department to purchase, on an emergency
basis, several specialty items that are to be fabricated to order so they may fit the specific
requirements of the design. The specific contracts far these items are as follows:

Based on information provided by the Director of the Department
of Public works, i have found that a valid EMERGENCY exists
justifying the purchase of goods for the Orange Bowl Stadium.
The City of Miami is committed to the University of Miami to
complete the development of the "campus -like" setting for the
site around the grange Bowl Stadium prior to the 1996 Football
Season. Also, this year the Stadium will host the preliminary
soccer games for the 1996 Olympic Games scheduled to start on
.July 20, 1996.

! The development of the Orange Bowl Super Block South includes new
parking areas; new access gates, promenades, walkways, lighting,
fencing, signage, and landscaping. A portion of this work
requires several specialty items that ar® to be fabricated to
order so they will fit the specific needs of our design and match
the items installed under the previous Super Block - North.
Also, the anticipated delivery time for most of these items is

between sixty to ninety days.
Since time is of the essence to meet the July 20, 1996 deadline
imposed by the beginning of the Olympic Games, I have directed
the Department of Public Works to prepare specifications and
receive informal bide for the purchase of the following items.
Ticket Booths
High Mast Electric Poles and Fixtures
Canopy Lights
Promenade Lights
Canopy Entrance
Roll -up Doors for Gate Entrances

The direct purchase of the above items will save the City the 25%
mark-up normally charged by the construction industry for
overhead and profit, plus sales tax. Consequently, it is
recommended that the above items be Purchased by the City on an
emergency basis and be provided to the Engineering Contractor
responsible for site development. Funds are available from
moneys already appropriated in CiP No, 404240. These purchases
will be submitted to the City Commission for ratification as soon
as possible.
