A RESOLUTION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING, AND CONFIRMING
THE CITY MANAGER'S FINDING OF AN EMERGENCY,
WAIVER OF THE REQUIREMENTS FOR COMPETITIVE
BIDDING PROCEDURES AND APPROVAL FOR THE
REPRODUCTION OF BID DOCUMENTS FOR THE TOWER
THEATER REHABILITATION PROJECT BY T-SQUARE
EXPRESS FOR THE DEPARTMENT OF PUBLIC WORKS;
ALLOCATING FUNDS THEREFOR FROM CAPITAL
IMPROVEMENT PROJECT NO. 321038, IN AN AMOUNT
NOT TO EXCEED $7,500.00; AUTHORIZING THE CITY
MANAGER TO INSTRUCT THE CHIEF PROCUREMENT
OFFICER TO ISSUE A PURCHASE ORDER FOR SAID
REPRODUCTION SERVICES.
WHEREAS, the Department of Public Works with the assistance
of the Department of Community Planning and Revitalization placed
the Tower Theater Rehabilitation Project out to bid from
December 18, 1995 through February 16, 1996, when the bids were
scheduled to open; and
WHEREAS, the bid package included an extensive number of
plans and specifications to be examined by all potential bidders;
and
WHEREAS, at the time, the Public Works Department lacked the
capability to reproduce such documents, due to the size of the
plans and specifications (two volumes), as well as a very heavy
demand from potential bidders; and

WHEREAS, the Administration directed that the bid documents
be reproduced at T-Square Express at a cost of $7,500.00; and
WHEREAS, the City Manager has made a written finding that
such need for blue print reproduction constituted a valid public
emergency in order to safeguard the welfare and convenience of
the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of an emergency,
waiver of the requirements for competitive bidding procedures,
and approval for the reproduction of bid documents for the Tower
Theater Rehabilitation Project by T-Square Express for the
Department of Public Works are hereby ratified, approved and
confirmed, with funds therefor hereby allocated from Capital
Improvement Project No. 321038, in the amount of $7,500.00.
Section 3. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for said reproduction services.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION;
It is respectfully recommended that the City Commission adopt the attached Resolution,
after a duly advertised public hearing, ratifying, approving and confirming the City
Manager's finding of an emergency and waiver of competitive bid procedures for the
reproduction of bid documents for the Tower Theater Rehabilitation Project by T-Square
Express, in the amount of $7,500 with funds allocated therefor from Capital
Improvements Project No. 321038.
BACKGROUND:
The Department of Community Planning and Revitalization assisted the Department of
Public Works in placing the Tower Theater Rehabilitation Project out to bid from
December 18, 1995 through February 16, 1996 when the bids were scheduled to open.
Emergency actions were necessary in order to provide potential bidders, within a short
period of time, the extensive number of plans and specifications for the Tower Theater.
Due to the size of the plans and specifications (two volumes), as well as a very heavy
demand from potentiai bidders to obtain the bid documents, reproduction was done at T-
Square Express. At that time, the Department of Public Works lacked the capability to
reproduce this size of a job in-house, and T-Square had previously received a small
"blanket" purchase order for this type of service.
The administration determined that emergency action was required to waive competitive
bid procedures for the reproduction of bid documents by T-Square Express. The total cost
for preparing the bid documents for the Tower Theater was $ 7,500. Payment will be
made with funds in Capital Improvement Project No. 321038, the Tower Theater
Rehabilitation Project.
It is respectfully requested that the City Commission adopt the attached Resolution
ratifying, approving and confirming the City Manager's finding of an emergency and his
waiver of competitive bid procedures related to the reproduction of the Tower Theater bid
documents by T-Square Express.

Based on information provided by the Director of the Department of Cornmunity Planning
and Revitalization, I have found that a valid EMERGENCY existed regarding a waiver
competitive bidding procedures for the reproduction of bid documents for the Tower
! Theater Rehabilitation Project by T-Square Express.

During the bidding process conducted from December 18, 1995 through February 1996,
emergency actions were necessary in order to provide prospective contractors, within a
short period of dine, the architectural plans and project specifications related to the
construction for the Tower Theater. Due to the size of the plans and specifications (two
volumes), as well as a very heavy demand from the public to obtain die bid documents,
reproduction was done at T--Square Express. The total cost for reproducing the bid
documents for the Tower Theater was $7,500 The Department of Public Wortcs does not
have the capabilities to reproduce this size of a job In-house, and T-Square had previously
received a small 'blanket" purchase order for this type of service.
By copy of this memorandum, I have Instructed file Department of Community Planning
and Revitalization to issue a purchase order, through Procurement Management, to
T-Square Express for the reproduction of the Tower Theater bid documents. I understand
that funds are available in the Capital Improvement Project No. 321038. This emergency
finding is to be submitted to the City Commission for ratification at the next .available

PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the City
Commission of the City of Miami, Florida, on May 9, 1996 at 9:00 a.m. in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, to ratify,
approve and confirm the City Manager's finding of an emergency and waiver of
competitive bidding procedures for the reproduction of bid documents for the Tower
Theater Rehabilitation Project by T-Square Express, at a cost of $7,500.
All interested persons are invited to appear and may be heard concerning this matter.
Should any person desire to appeal any decision of the City Commission with respect to
any matter considered at this hearing, that person shall ensure that a verbatim record of
the proceedings is made, including all testimony and evidence upon which any appeal
