RESOLUTION NO. 9 316
A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING THAT AN EMERGENCY NEED
EXISTS, WAIVING THE REQUIREMENT'S FOR
COMPETITIVE SEALED BIDS AND ACCEPTING THE BID
OF JAFFER ASSOCIATES, LTD., FOR THE PURCHASE
AND INSTALLATION OF AN IRRIGATION SYSTEM FOR
THE SOUTH END OF THE MILDRED AND CLAUDE
PEPPER BAYFRONT PARK IN THE AMOUNT OF
$15,000; ALLOCATING FUNDS THEREFOR FROM THE
CAPITAL _IMPROVEMENT PROGRAM, ACCOUNT NO.
331305.
WHEREAS, the Bayfront Park Management Trust has managed
Bayfront Park with the goal of insuring maximum community
involvement; and
WHEREAS, Bayfront Park's irrigation system does not
currently extend to the south end of the Park; and
WHEREAS, with the approach of the dry season, the City
Manager has made an emergency finding that the immediate
installation of an irrigation system in the south end of the Park
is necessary to maintain the appearance and healthy growth of the
Park's trees, shrubs and lawns; and
WHEREAS, three bids were obtained for this project and that
of Jaffer Associates, Ltd. was the most responsible and
responsive; and

WHEREAS, funds for said irrigation system are available from
the Capital Improvement Program, Account No. 331305;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, ratifying, approving and confirming the
City Manager's finding that a valid emergency need exists, and
accepting the bid of Jaffer Associates, Ltd. for the purchase and
installation of an irrigation system for the south end of the
Mildred and Claude Pepper Bayfront Park in the amount of $15,000,
with funds therefor hereby allocated from the Capital Improvement
Program, Account No. 331305.
Section 3. The requirements for competitive sealed bids
are hereby waived for the purchase and installation of the above
irrigation system.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
I find that an emergency situation exists and herewith recommend
the waiving of formal competitive bidding procedures .tor the
installation of the South End Irrigation system in Bayfront Park,
and further recommend said contract be awarded to Jaffer
Associates, Ltd.
BACKGROUND:
The Bayfront Park Management Trust is in the process of planting
new landscaping in the South End of Bayfront Park in preparation
for the upcoming Centennial Celebration. As the South End of the
Park does not currently possess an irrigation system, it is
essential that one be installed prior to the landscaping. Three
informal bids were sought for this project and Jaffer Associates,
Ltd., submitted the lowest bid.

for objections to the waiving of competitive bids for the emergency
authorization for the installation of an irrigation system in the

A Public Hearing will. be held by the Comm'ffsion of the City of
Miami, Florida on April 11, 1996, at 1 _ o a.m. In the City
Commission Chambers at City Hall, 35 u Pan American Drive, Miami,
Florida for the purpose of hearing any comments by the City
Commission from any interested parties ffected by the
installation of an irrigation system ' the South End of Bayfrorit
Park.
All interested persons are invited to appear and may be heard
concern.ing'the proposed measures. Should any person desire to
appeal any decision of the City Commission with respect to any
matter considered at this hearing, that person shall ensure that
a verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
